The Town of Douglas, Massachusetts acting by and through the Board of Selectmen, hereinafter referred to as the "Owner" invites sealed bids for construction of:

Douglas Municipal Center Building
First Floor Window Replacement
29 Depot Street
Douglas, MA 01581

in accordance with the Bidding and Contract Documents prepared by:

hereinafter referred to as the "Architect", will be received at the offices of the Owner as follows:

1. Project Value is estimated to be $ 115,000.

2. Sealed Bids for General Bids Due - Date and Time of Day: Wednesday, June 7, 2017 at 2:00 pm at which time and place they will be publicly opened and read aloud. Included with General Bids shall be an Update Statement, DCAM Certification and 5% bid deposit.

3. Bid Documents will be available electronically and must be obtained by going online to http://tinyurl.com/douglaswindows after May 17, 2017. Electronic sets of drawings and specifications shall be available to Contractors at the Douglas Board of Selectmen’s office, 29 Depot Street, Douglas, MA 01516 as well as a hardcopy set on file for Contractor review.

4. Pre-Bid Conference: A non-mandatory pre-bid conference will be held on Thursday, May 25, 2017 at 10:00 am at the project site, Douglas Municipal Center Building, 27 Depot Street, Douglas, MA 01516. Following the pre-bid conference, bidders will be permitted to view the interior work areas of the project.

5. A DCAMM Certified General Contractor is required for this project. The General Contractor shall be DCAMM certified in the following category:  GENERAL CONSTRUCTION

6. Deposit for Documents: A deposit for the documents is not required.

7. Bid Security: A Bid Security for both Filed Sub-bids and General Bids is required per Chapter 149 in the amount of 5% of value of total bid. Each Bid must be accompanied by a bid security consisting of a BID BOND, CASH, CERTIFIED CHECK or a TREASURER'S or CASHIER'S CHECK issued by a responsible bank or trust company, payable to West Broadway Redevelopment LP.

8. Insurance:

a. Upon award of the contract, the awarded contractor shall submit proof of Insurance.

b. The General Contractor shall carry and pay for Liability Insurance including Workers Compensation, General Liability and Automobile Insurance as well as Property or Builders Risk Insurance for all risks up to the complete value of the project.

9. Bonds:

a. A PERFORMANCE BOND and LABOR AND MATERIALS PAYMENT BOND for 100% of the value is required. Each bidder shall submit evidence of bondability for the entire value of the work.

b. Bonds must be executed by a surety company licensed to do business at the location of the project. Bond form shall be as enclosed.

10. Addenda: Addenda will be issued to all bidders simultaneously.

11. Adjustments to the Bid Due Date will be made if deemed appropriate by the Architect.

12. Project Schedule:

a. Time is of the Essence, and as such the following Project Schedule has been established:

b. Commencement of Work, and Dates for Substantial and Final Completion:

i. Award of Contract: ................... on or about Wednesday, June 28, 2017

ii. Commencement of work begins: ....................... following shop drawings and window fabrication period installation of work is anticipated to begin on or about Thursday, August 17, 2017

iii. Substantial Completion Date .............................. based upon an 8-week installation period and 1 week punch list period, Substantial Completion is estimated to occur on or about Wednesday, October 18, 2017, including Certificate of Occupancy.

iv. Final Completion Date: Fourteen (14) Calendar days following Substantial Completion.

13. Cost of preparation of bids is entirely the responsibility of the Bidder.

14. All bids for this project are subject to applicable public bidding laws of the Commonwealth of Massachusetts, including M.G.L. c.149, §44A through 44H, as amended.

15. Attention is directed to the minimum wage rates to be paid as determined by the Commissioner of Labor and Workforce Development, Division of Occupational Safety, under the provisions of Commonwealth of Massachusetts General Laws, Chapter 149, Section 26 and 27D inclusive.  1.11 Attention is further directed to the requirements of Commonwealth of Massachusetts M.G.L. c.149, §44D requiring submission of a Division of Capital Asset Management (DCAM) approved Contractor’s ‘Certificate of Eligibility’ and ‘Update Statement’ with each General Bid.

16. Selection of the Contractor will be based upon bidder qualifications, including evidence of past performance in similar projects, and bid price. The Contract will be awarded to the bidder deemed by the Awarding Authority to be the lowest responsible and eligible bidder in accordance with Massachusetts General Laws.

17. The Work of this Project shall require Minority/Women Owned Business participation pursuant to Chapter 193 of the Acts of 2004, and MGL Chapter 23A, Section 44 and MGL Chapter 7, Section 40N, as amended.

18. The Bidder agrees that its bid shall be good and may not be withdrawn for a period of 30 days, Saturdays, Sundays and legal holidays excluded, after the opening of the bids.

19. The Owner reserves the right to waive any informalities and to reject any or all bids if it be in the public interest to do so.
