DOUGLAS PLANNING BOARD NOTICE OF PUBLIC HEARING
Notice of Planning Board Public Hearing
Relative to
Proposed Zoning By-law Amendments
Pursuant to M.G.L. c. 40A, § 5
The Planning Board of the Town of Douglas will hold a public hearing to discuss proposed amendments to the Town’s Zoning Bylaws. The Public Hearing will be held on Tuesday, March 23, 2010, at 7:00pm in the Community Meeting Room, 29 Depot Street, Douglas, MA.
The subject matter of the proposed amendments is indicated below. A copy of the proposed amendments is available for viewing in the Community Development Department during regular business hours within the Douglas Municipal Center, 29 Depot Street, Douglas, MA.
The changes to the Town of Douglas Zoning Bylaws are to the last sentence of Section 9.5 (Repetitive Petitions)
From:
“No application for a special permit or petition for a variance which has been unfavorably acted upon by the Board of Appeals or the Planning Board as the case may be shall be considered on its merits by said Board(s) within two (2) years after the vote of such unfavorable action except with the unanimous consent of the Planning Board, as set forth in G.L. Chapter 40A, Section 16.”
To be replaced with:
“No application for a special permit or petition for a variance which has been unfavorably acted upon by the Board of Appeals or the Planning Board as the case may be shall be considered on its merits by said Board(s) within two (2) years after the vote of such unfavorable action as set forth in G.L. Chapter 40A, Section 16.”

The Planning Board of the Town of Douglas will hold a public hearing to discuss proposed amendments to the Town’s Zoning Bylaws allowing for Residentially-Scaled, Land Based Wind Energy Conversion Facilities (RWECF) and Commercially-Scaled, Land-Based Wind Energy Conversion Facilities (CWECF), subject to compliance with applicable substantive and procedural standards.
The Public Hearing will be held on Tuesday, March 9, 2010, at 7:00pm in the Community Meeting Room, 29 Depot Street, Douglas, MA.
The proposed amendments are set forth in outline form, below. Copies of the full text of said proposed amendments are available for viewing in the Community Development Department during regular business hours within the Douglas Municipal Center, 29 Depot Street, Douglas, MA.

The subject matter of the proposed amendments is indicated below. A copy of the proposed amendments is available for viewing in the Community Development Department during regular business hours within the Douglas Municipal Center, 29 Depot Street, Douglas, MA.
The changes to the Town of Douglas Zoning Bylaws primarily of the following revisions:
Section 9.4 (Site Plan Review), Section 5.1 (Off-Street Parking Regulations), Section 5.2 (Loading Requirements) and Section 5.3 (General Landscaping Requirements). Transfer Site Plan Review Authority from Zoning Board of Appeals to Planning Board:
To designate the Planning Board as the Special Permit Granting Authority by replacing the text “Board of Appeals” with “Planning Board” in all of the aforementioned Sections of the Douglas Zoning Bylaws.
Furthermore, by allowing Site Plan Review decisions to be appealed to the Zoning Board of Appeals, and to revise the Board review time from 60 days from submittal to 90 days from the date of the public hearing.
