The meeting was called to order at 7:00pm.

ATTENDANCE
Acting Chairman Michael Yacino, Leon Mosczynski, Linda Brown, Ralph Dudley, Tracy Sharkey (Associate Member), Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Lajoie (Administrative Secretary). Absent were Chairwoman Marylynne Dube, Brandi Van Roo, David Windoloski and Kelley Donley (Associate Member).

7:00 PM DISCUSSION
1. Eugene Gumienny, 321 Southwest Main Street: Bad Luck Pond. Present were Eugene & Karen Gumienny and Aaron Socrat of Lindberg Avenue. Zisk said he received a telephone call from Socrat stating that the Gumienny’s were using a snow blower to clear a path in the snow to the water and also clearing an area on the pond. Gumienny said they were clearing the snow so their family could go ice skating and also said that the previous owner had clear cut brush and some trees along the path to the water. Yacino asked the members if they had any issues with this and Brown, Dudley and Mosczynski said no. Socrat said that the path and pond were not the Gumienny’s property but belongs to an unknown owner. Socrat said that he would like to see the trees grow back and no dock built on this parcel and just wants to make sure no one harms the wetlands and trees. It was the consensus of the Commission that the Gumienny’s do not have to file an RDA or NOI.
2. Request for Partial Certificate of Compliance: Danlyn Realty, LLC, “Stonegate at Douglas” located off Franklin Street, Lot #33. A Motion was made by Brown to issue a Partial Certificate of Compliance to Danlyn Realty, Stonegate at Douglas, Lot #33, seconded by Dudley. Vote was unanimous.
3. Request for Partial Certificate of Compliance: Orbison Corp, “Stonegate at Douglas” located off Franklin Street, Lot #34. A Motion was made by Brown to issue a Partial Certificate of Compliance to Orbison Corp, Stonegate at Douglas, Lot #34, seconded by Dudley. Vote was unanimous.
4. Request for Certificate of Compliance: KTKM Realty Trust, “Stonegate at Douglas” located off Franklin Street. A Motion was made by Brown to issue a Certificate of Compliance to KTKM Realty Trust for “Stonegate at Douglas” Subdivision, seconded by Mosczynski. Vote was unanimous.
5. Peter Coffin: Blackstone River Coalition/Mumford River Low Flows. Mr. Coffin not present. Cundiff said that Coffin was too late to submit the grant application but will continue to pursue other grants.
6. Reschedule 1/18/11 Meeting to 1/25/11 to attend the School Building Committee Meeting. Cundiff said that the Committee will be filing with the Commission after spring. Yacino does not feel it is necessary to cancel their 1/18/11 meeting but during discussion Brown, Sharkey and Cundiff will attend this meeting and report back to the Commission. A meeting for 1/25/11 will be posted for the Commission just as a precaution if other members not present tonight choose to attend.
7. Whitin Reservoir Watershed District. Yacino informed the members that he and Zisk went to the Uxbridge District Court regarding the $100 fine. The Magistrate was very surprised about the $100 fine. There was much dialog between the Magistrate, WRWD and Yacino/Zisk. Yacino said that Zisk was well prepared for this hearing. The Magistrate suggested that both parties get together to iron things out. The WRWD is meeting on 1/5/11 to discuss paying the $100 fine. Yacino asked Zisk to set up a time to meet with the WRWD preferably for the Commission’s meeting on 1/18/11 and to reserve one hour. Yacino also asked Zisk to contact the WRWD to ask for a copy of the Draw Down Schedule prior to the 1/18 meeting.
8. DCR Stewardship Grant Program. Zisk informed the members that the Commission has received two grants that are to be used for long term planning to take care of these properties. The grant money is for the properties on Chestnut Street and Mumford and Manchaug Road and the Southeast Main Street (French property). Zisk was asked to e-mail these grants to Van Roo and Donley.

7:30 PM DEP #143-0 (NOI) PUBLIC HEARING - 43 Southeast Main Street /KIBBE, RANDY – EXCEED REALTY LLC
Present on behalf of the Applicant was Steven O’Connell of Andrews Survey. Previously an RDA had been filed but the Commission required a more detailed plan. O’Connell said that the Board of Health has approved this plan and submitted a copy of the tax bill that was paid in full, a flood map and an endangered species map. The work includes the repair of the septic system within the 100-foot buffer zone of a bordering vegetated wetland. A pump chamber will be added. After discussion, a Motion was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Mosczynski. Vote was unanimous.

DISCUSSION CONTINUED
9. West Street Update. Yacino said that he had sent a letter to Capt. George Agganis of the Inland Enforcement Bureau Headquarters in Westboro along with photos of the well site. This letter was copied to the Board of Selectmen. Agganis is working on this and will send the Commission his decision/comments to Yacino.
10. Open Space Committee. The Commission received a letter from Sue Perkins, member, regarding property on Orange/Southeast Main Streets owned by Thomas Schwartz. Yacino said that he spoke to Schwartz with recommendations for Orange/Southeast Main Street (not Perry Street Extension). Schwartz told Yacino that he would be in town next month and would like to get together him.
11. FY12 Budget. The Commission agreed to “level fund” their Expense Budget and fulfill their last $5,000 obligation from the Wetland Protection Fund to the Town’s General Fund.
12. GPS System. Cundiff informed the Commission that he placed the order and said that 50% of this equipment is made in the USA.

After review, a Motion was made by Brown to approve the Meeting Minutes of December 6, 2010, as amended, seconded by Mosczynski. Vote was unanimous.
