The meeting was called to order at 7:00pm.

Vice Chairman Michael Yacino, Linda Brown, Ralph Dudley, Brandi Van Roo, David Windoloski, Tracy Sharkey (Associate Member), Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer), Maria Lajoie (Administrative Secretary) and Attorney Adam Costa of Blatman, Bobrowski & Mead (Town Counsel). Absent were Chairwoman Marylynne Dube, Leon Mosczynski and Kelley Donley (Associate Member).

1. Memo from Town Administrator. The Commission received a memo from Michael Guzinski dated 5/24/11 on behalf of the Finance Committee requesting an additional $5,000 in addition to the $5,000 that the Commission will be giving the town for FY12. After much discussion, a Motion was made by Brown to maintain the original contribution amount of $5,000 for FY12 which completes the total original amount of $25,000, seconded by Van Roo. Vote was unanimous. A memo will be sent to the Town Administrator.
2. Schedule Site Walk: School project. Zisk asked the members to do a site walk prior to the meeting with the designers on 6/20. Van Roo said she would like to see the information and a plan before she does a site walk and the Commission agreed.
3. Conservation Appointments. In light of a new application received, Yacino said that the original vote to reappoint Leon Mosczynski and to appoint Kelley Donley as a member still stands. The Commission agreed and asked Lajoie to send a memo to the Selectmen’s Office.
4. Tennessee Gas Pipeline: 2011 Vegetation Management Plan. Acknowledged.
5. Meeting Minutes of 5/16/11. After discussion, a Motion was made by Brown to approve the Meeting Minutes of May 16, 2011, as amended, seconded by Van Roo. Vote was unanimous.
6. Ross Smith, 151 Davis Street. Mr. Smith was told to file an NOI and to have his public hearing held tonight. Zisk said that Michael Yerka of Yerka Engineering came in to the office and said that he was in the process of drawing up a plan for Smith. A Motion was made by Van Roo to have Ross Smith, property located at 151 Davis Street, file a Notice of Intent by June 20, 2011 and the Public Hearing will be held on Monday, July 11, 2011 at 7:30pm, seconded by Brown. Vote was unanimous.
7:30 PM DEP #143-0829 (NOI) PUBLIC HEARING – Olde Carriage Lane, Lot #30 / KTKM REALTY TRUST
Present on behalf of the Applicant was Normand Gamache of Guerriere & Halnon. Also present was Daniel Heney. A site walk was done. The scope consists of proposed grading for the back yard of the proposed house, a portion of which falls within 100-feet of a bordering vegetated wetland. A revised plan dated 6/2/11 was submitted. Gamache said that there are four other lots on the left side, the house is at 110-feet, the well and septic system is outside the buffer zone. Behind the house it is very flat. Zisk said there will be no work done on the slope. After discussion, a Motion was made by Van Roo to close the Public Hearing and issue an Order of Conditions, seconded by Brown. Vote was unanimous. Heney asked if he could use sock (waddles) instead of straw bales and the Commission said yes.

1. Mumford River. Zisk told the Commission that there is a log stuck in the dam on Cook Street and the Highway Department is asking permission to remove the log by pulling it out with a backhoe. The Commission approved this request.
2. Site Walk. The Commission will do a site walk at 4 Kerney Road on Thursday, June 9 at 5:00pm.The members will go on their own. Lajoie will contact the owner.

Present was the Applicant Charles Mabey. Mabey is requesting permission to install a 16-foot by 16-foot shed on piers and there will be no digging by machine. A site walk was done. The Commission had no issues. A Motion was made by Van Roo to close the Public Meeting and issue a Negative Determination of Applicability, seconded by Brown. Vote was unanimous.

The Commission recessed at 7:55pm and returned at 8:27pm.

The Commission received a letter dated 5/31/11 from Matthew Bellisle of Pare Corp on behalf of the WRWD withdrawing the RDA without prejudice. Bellisle also stated in the letter that WRWD will continue to maintain the low level channel flow by raising and lowering the low flow outlet gate valve as historically done by previous owners. The Commission acknowledged the letter and understood that WRWD would be filing a Notice of Intent, which will include a management plan which will cover draw downs and stream level maintenance.

8:30 PM DEP #143-0818 (Amendment to Order of Conditions) PUBLIC HEARING – 187 Maple Street / CREATIVE DEVELOPMENT ASSOCIATES
Present on behalf of the Applicant was Susan Vanderzicht (Realtor) and Tim Riffle and Karen Murray (prospective buyers). The scope of work is to construct an in-ground swimming pool within 55-feet of the wetland and to level the back yard for the pool. The house is already built and the septic system and well are in. Zisk said this application is straight forward and the Commission agreed. A Motion was made by Brown to close the Public Hearing and issue an Amended Order of Conditions, seconded by Van Roo. Vote was unanimous.

At 8:40pm, a Motion was made by Van Roo to adjourn the meeting, seconded by Brown. Vote was unanimous.
