11/7/2011 - Meeting Minutes

The meeting was called to order at 7:00pm.

ATTENDANCE
Chairman Michael Yacino, Linda Brown, David Windoloski, Tracy Sharkey, Stephen Zisk (Planning/Conservation Agent) and Maria Lajoie (Administrative Secretary). Absent were Chairwoman Marylynne Dube, Brandi Van Roo, Kelley Donley and William Cundiff (Town Engineer).

7:00 PM (NOI) #143-0835 PUBLIC HEARING CONTINUED – Whitin Reservoir / WHITIN RESERVOIR WATERSHED DISTRICT
Present was John Bombara on behalf of WRWD and Robert Josey, Water/Sewer Commissioner. Zisk said that he did not receive the updated Manual changes from Matthew Bellisle of Pare Corporation that was requested by the Commission at the last meeting. Bombara was unaware of this and said he would contact Pare tomorrow. Zisk said that he had most of the “Special Conditions” done. Yacino said that if the changes are made to the Operations Manual, it can be referenced as the “Special Order of Conditions”. Josey was given a copy of the Manual and he asked who was going to be maintaining the water levels and Yacino said a couple of people would be operating the dam. Josey asked Bombara for the phone numbers of the operators in case problems arise at the Water/Sewer Treatment Plant and Bombara said he would contact Josey with the information. After discussion, a Motion was made by Brown to continue the Public Hearing on December 5, 2011 at 7:00pm, seconded by Windoloski. Vote was unanimous.

DISCUSSION:
1. Meeting Minutes of 10/17/11. After review, a Motion was made by Brown to approve the Meeting Minutes of October 17, 2011, as written, seconded by Sharkey. Vote was unanimous.
2. 2012 Conservation Commission Meeting Schedule. Lajoie was asked to e-mail this to the Commission and be approved at their meeting on December 5, 2011.
3. Updated Chart for Permits. Zisk was asked to give the Commission an updated chart for open Permits at the next meeting.
4. Meeting Minutes of 9/19, 10/3. These minutes will be approved on December 5, 2011




7:15 PM (NOI) #143-0 PUBLIC HEARING – 8 Southwest Main Street / SMALL, MARK
Present was Applicant Mark Small and his representative Paul Knapik of Guerriere & Halnon. The Applicant is requesting permission to construct a three-car garage, installation of a new septic system and associated grading and site work. Small said he received Planning Board approval for an Accessory Apartment. The total Riverfront area (Dudley Brook) is 68,211 square feet and the proposed alteration area is 6,906 square feet, which is 10% of the riverfront area. Knapik said there would be no clearing of trees and no adverse impact on the resource areas. Brown asked that straw bales be used. Zisk asked that the straw bales, foundation drain and stockpile area be shown on the plan. Yacino said that the Commission will do a site walk and asked Knapik to stake the corners of the garage and elevation. After discussion, a Motion was made by Brown to continue the Public Hearing on Monday, December 5, 2011 at 7:45pm, seconded by Sharkey. Vote was unanimous.

DISCUSSION:
1. 133 Shore Road. The Commission did a site walk on 11/2/11 and felt that there are a number of concerns. The approved plan states that witch hazel shrubbery is to be planted along the shoreline. After discussion, it was the consensus of the Commission that the owner must adhere to the original Order of Conditions by planting the witch hazel shrubbery along the shoreline according to the plan. Zisk to contact the owner.
2. Request for an Extension Permit for Order of Conditions: Suzanne Gagnon, off Potter Road. A Motion was made by Brown to grant a one-year extension ending 10/16/2012, seconded by Windoloski. Vote was unanimous. The Commission signed the Permit.

7:45 PM (NOI) #143-0 PUBLIC HEARING CONTINUED – 151 Davis Street / Smith, Ross
Present was Applicant Ross Smith and his representative Robert Murphy of Murphy Associates. Revised Plan dated 11/3/11showing the septic system, which meets the 50-foot regulation and straw wattles and silt fence was submitted to the Commission. Murphy said the roof drainage will be recharged into the ground. Murphy said that the original Order of Conditions had expired and no longer applicable. Zisk suggested that when the Commission is ready to issue a Certificate of Compliance, close out the old Order of Conditions and issue Certificates of Compliance for both Orders of Conditions and the Commission agreed. After discussion, a Motion was made by Brown to close the Public Hearing and issue an Order of Conditions. Vote was unanimous.





ADJOURNMENT
At 7:55pm, a Motion was made by Brown to adjourn the meeting, seconded by Sharkey. Vote was unanimous.
