The meeting was called to order at 7:05pm.

ATTENDANCE
Chairman Michael Yacino, Linda Brown, Brandi Van Roo, Tracy Sharkey, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer)
and Maria Lajoie (Administrative Secretary). Absent was David Windoloski.

7:05 PM (NOI) #143-0835 PUBLIC HEARING CONTINUED – Whitin Reservoir / WHITIN RESERVOIR WATERSHED DISTRICT
Present was John Bombara on behalf of WRWD. The Commission reviewed “Draft #2” of the Special Order of Conditions and was also given a copy of an e-mail from Robert Sullivan, Water/Sewer Department sent this afternoon. Yacino asked the members if they had anything to add or remove. Brown felt that #2 (48-Hours Notice), #14(Pesticides, etc) & #18 (Certificate of Compliance) should be removed from the Special Orders because they do not apply to this project. Bombara asked Zisk to e-mail the Water/Sewer letter to him so that he may respond since it is not in the Commission’s jurisdiction. The Commission discussed #4 (Stream Flow Data). Yacino said that a plan is needed. Bombara said that the plan is in the Operations Manual and that he, Lawrence Bombara and Ronald Forget are always checking the stream flow every week. Yacino asked Bombara to submit the stream flow data to Zisk on a monthly basis. Brown agreed and suggested e-mailing the information to Zisk. After much discussion, a Motion was made by Brown to close the Public Hearing and issue an Order of Conditions, with the amendments to the Special Conditions, seconded by Van Roo. Vote was unanimous.
7:15 PM (NOI) #143-0837 PUBLIC HEARING – Monroe Street / EXXON MOBIL PIPELINE COMPANY, INC.
Present on behalf of the applicant was Seth Lajoie of Seth L. Lajoie & Associates. Zisk said he walked the site with Lajoie. When the wetlands were flagged an area was missed and the plan was modified to show the flagged area. Lajoie submitted Flood Insurance Rate Maps and the Bordering Vegetated Wetland Forms. Lajoie said that this work will be done when the ground is dry. The Secretary submitted copies of DEP’s comments to the members. Yacino asked Lajoie for a work schedule and Lajoie said he would provide it to the Commission. Yacino said that Exxon should work on one section at a time and Lajoie said they would be working 100-feet at a time. Lajoie said he needs to contact DEP and address their comments. Yacino said that DEP is looking at the project as one job instead of three separate areas. Van Roo asked about the work process. Lajoie said that the pipe is 6-inches in diameter and 1-1 ½ feet deep in the ground. The workers remove the soil from around and under the pipe, brush on a protective sealant, wrap the pipe with a polymer wrapping, cover the pipe with a mesh blanket, and cover the pipe back up with soil. Sediment shall be removed from the site. Van Roo said that placing the topsoil back in is much better than soil being brought on site. Zisk told Lajoie that he needs to have Exxon sign the Notice of Intent prior to the next meeting. After discussion, a Motion was made by Brown to continue the Public Hearing on Tuesday, January 3, 2012 at 7:30pm, seconded by Van Roo. Vote was unanimous.

7:30 PM (NOI) #DCC-05 PUBLIC HEARING CONTINUED – 34 & 36 Davis Street / COOPERTOWN REALTY TRUST
Zisk received an e-mail from James Pyne dated 11/22/11 requesting a continuance of this Public Hearing because the Hearing with the Planning Board is not until 12/13/11. A Motion was made by Brown to continue the Public Hearing on Tuesday, January 3, 2012 at 7:45pm, seconded by Sharkey. Vote was unanimous.

7:35 PM DISCUSSION: SCHOOL PROJECT UPDATE
Present was Ken DiNisco and Fred King. DiNisco said that there are two changes to the original approved plan regarding a water pipe and a proposed concrete walkway. Water Pipe: DiNisco said the workers found a clogged water pipe located near the courtyard at the primary school which seems to have settled into the ground caused by sink holes due to water and buried stumps and also said that it would be a simple fix by using a filtering berm to the street, (a temporary fix), put in a man hole and the water will recharge and flow out. This will handle two (2) acres of impervious surface. Cundiff said that a trench was located at the bottom of the slope eight years ago. DiNisco said that this temporary fix will help this issue. Concrete Walkway: King said they need to install a 4-foot wide walkway, being less intrusive. DiNisco said the open space has some impervious surface, less than 2% and is not connected to a drain and there will be no increase in flow. The sidewalk will have a slight pitch toward the grass area. The project is out to bid and will give the Commission an Addendum to the Order of Conditions. The Commission had no objection and said that the road looks good.

7:45 PM (NOI) #143-0836 PUBLIC HEARING CONTINUED – 8 Southwest Main Street / SMALL, MARK
Present was Applicant Mark Small. A site walk was done by the members. Yacino said there are three dead trees to the right of the property that Small would like to remove and after viewing the pictures the members did not have an issue with this request. A Motion was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Sharkey. Vote was unanimous.
8:00 PM (RDA) PUBLIC MEETING – 7 Laurel Glades / BERKOWITZ, JAMES
Present was Applicant James Berkowitz. Requesting permission to remove the original retaining wall and rebuild a new stronger wall with steps in the same footprint 25-feet from the Whitin Reservoir. Berkowitz informed the Commission that he placed straw bales after being issued a Violation Notice from Zisk. Berkowitz also said that the majority of the work that he had already done was done by hand but did use a bobcat for the larger boulders. Van Roo said that the procedure is to issue a fine when someone does work in a wetland resource area without getting the proper permits from the Commission. A Motion was made by Brown to issue a fine of $100, seconded by Van Roo. Vote was unanimous. Brown asked Berkowitz what the length of the wall was and Berkowitz said 36-feet and 4-4 ½” high. Van Roo is concerned with the proximity of the water and being consistent with similar filings. Zisk said that by Berkowitz filing this RDA, there is a paper trail with conditions and the Commission has issued similar DOA’s in the past. After discussion, a Motion was made by Brown to issue a Negative Determination of Applicability with the condition that erosion controls remain in place and no machinery is allowed, seconded by Van Roo. Vote was unanimous.

DISCUSSION:
1. Meeting Minutes of 9/19/11. After review, a Motion was made by Brown to approve the Meeting Minutes of September 19, 2011, as amended, seconded by Van Roo. Vote was unanimous.
2. Meeting Minutes of 10/3/11. After review, a Motion was made by Brown to approve the Meeting Minutes of October 3, 2011, as amended, seconded by Sharkey. Vote was unanimous.
3. Meeting Minutes of 11/7/11. After review, a Motion was made by Brown to approve the Meeting Minutes of November 7, 2011, as amended, seconded by Sharkey. Vote: Yes-3, Abstained-1. Vote was passed.
4. 2012 Conservation Commission Meeting Schedule. A Motion was made by Brown to approve the 2012 Meeting Schedule, seconded by Sharkey. Vote was unanimous.
5. The Commission acknowledged a copy of a resignation letter from Kelley Donley.
6. Request for Certificate of Compliance: Douglas Camp Meeting Association, 25 South Street (DEP #143-0801). A site walk was scheduled for 12/20/11 after 12:00pm.
7. Request for Certificate of Compliance: Dennis Michalik, 48 Davis Street (DEP #143-0637). A site walk was scheduled for 12/20/11beginning at 12:00pm.
8. Conservation Land/Manchaug Street. Zisk told the members that he took the Cub Scouts to this parcel last Friday morning and had them navigate the property lines and mount the boundary markers.

At 9:00pm, a Motion was made by Van Roo to adjourn the meeting, seconded by Brown. Vote was unanimous.
