The meeting was called to order at 7:00pm.

Chairman Michael Yacino, Linda Brown, Brandi Van Roo, David Windoloski, Tracy Sharkey, David Gallant, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Jason Talerman (Town Counsel). Absent was Maria Lajoie (Administrative Secretary).

1. Stormwater Pollution Prevention Plan for Construction Activities: School Project. Present was Mike Bital of CTA Construction to give an update of the field area, taking down trees, straw bales, silt fence and waddles being in place. Zisk said that they filed with EPA and that revisions are a part of the living document in the Order of Conditions as the project progresses such as cleaning sediment basins and erosion control. Zisk said that temporary overspill over land and dissipate into upland to stabilize project. Cundiff said this is a standard procedure if you disturb more than one (1) acre of land and there is maintenance and inspections for structures and after rain storms, a form is filled out and kept on file. Cundiff said that CTA will come in at each phase to update the Commission.
2. Wetland Protection Fund. Yacino said that he and Zisk met with Michael Guzinski, Town Administrator and did not get any specific information as to what the Wetland Fund money would be used for however, said there are shortfalls due to the new school project. Yacino said that no other entities (4 existing) were giving money toward the general fund. The Commission discussed the $25,000 that was already given on top of the money collected from applications that went into the general fund. The Commission does not want to give more money at this time. Yacino said that Guzinski wants a letter from them with reasons for not giving additional money. Yacino said that the $60,000 in the Wetland Fund is critical due to the economy and Van Roo said the Commission needs to access what they may need first. After much discussion, the members were polled and five (5) out of six (6) agreed not to give any more money at this time.
3. Street Clean-up: 3/24/12

7:15 PM (RDA) PUBLIC MEETING – 86 Island Road /
Present was Applicant Donald Youngsma who is requesting permission to construct a 14-foot by 20-foot addition with a wrap-around porch with a crawl space underneath. Youngsma said the septic tank will be moved and will be 20-feet from the work and the leach field. Van Roo feels that Youngsma should file a Notice of Intent so the Commission will have an official plan. Brown said she wants to see where the stockpile and erosion control will be. Yacino asked Youngsma if he had Board of Health approval and Youngsma said that it is an upgrade and doesn’t think he needs to file with them. Due to the proximity of the Whitin Reservoir, the Commission felt that a full Notice of Intent should be filed. Yacino said besides the addition, show the septic tank, stockpile and erosion control on the plan. After discussion, a Motion was made by Brown to issue a Positive Determination of Applicability, seconded by Van Roo. Vote was unanimous.

Present on behalf of the Applicant was Michael Weaver of Guerriere & Halnon and William Cundiff. Cundiff informed the Commission that the Planning Board closed their hearing on March 13, 2012. The project is being done with grant money. Northbridge closed their hearings and Sutton will close their hearing next week. The detention basins were designed for the 100-year storm. A revised drainage report was submitted. Weaver said that he sent DEP an alternatives analysis but have not heard back from them yet. Cundiff said soil testing was done in the detention ponds and they comply with the Stormwater Standards. Weaver said that the basins have a 6-inch pvc pipe at the bottom of the basin and is surrounded by 6-inches of stone. Van Roo asked why a valve is necessary and Weaver said that the water will fill up to a certain amount and then will go into the pipe and infiltrate into the ground. The basin will have a town easement and a cover on the top and gated. After discussion, a Motion was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Van Roo. Vote was unanimous.

7:45 PM (NOI) #143-0842 PUBLIC HEARING – 37 Hough Road / BRIAN GUILFOYLE
Present on behalf of the Applicant was Paul Hutnak of Andrews Survey. The proposed project is the reconstruction of an existing single family house and septic system component replacement within 100-feet of a bordering vegetated wetland. The house will be 45-feet from Manchaug Pond and will increase in distance with limited grading. Straw bales and silt fence will be placed around the property during demolition and construction. Cundiff said that Guilfoyle is before the Zoning Board of Appeals also and Hutnak said that the ZBA will not close their hearing until the Commission issues an Order of Conditions. Brown asked if this house would be on the same footprint and Hutnak said it was smaller and on a foundation. Brown asked where the excavated materials would be stored and Hutnak said in the driveway. Brown asked as a condition that excavated stockpiled material be stored outside the 100-foot buffer zone. A Motion was made by Brown to close the Public Hearing and issue an Order of Conditions with the condition that “excavated stockpiled material be stored outside the 100-foot buffer zone”, seconded by Van Roo. Vote was unanimous.

8:00 PM (NOI) #143-0841 PUBLIC HEARING – 115 Shore Road / MILLER, ROBERT
Present on behalf of the Applicant was Seth Lajoie of Seth Lajoie and Associates. The project consists of a sewage disposal system upgrade with new house. Much discussion was held about moving the house back 5-feet and allow only one middle tree of the three trees between the house and the water be cut for scenic view. Straw waddles to be used during construction. Brown said the proposed house is bigger and 4-feet closer to the water and suggested shortening the house. Lajoie said he has to go before the Zoning Board of Appeals for a variance of the 5-feet and to the Board of Health for an upgrade. Van Roo said the trees are close to the water and is concerned with the roots near the shoreline and to plant some type of shrubs. After much discussion, the Commission agreed to save one tree and move the house back 5-feet and submit a planting plan. The Commission asked that the above be shown on a revised plan. A Motion was made by Sharkey to continue the Public Hearing on Tuesday, April 17, 2012 at 7:15pm, seconded by Brown. Vote was unanimous.

This Hearing is under the Wetland Local Bylaw. Present was Gary Vecchione of Coopertown Realty Trust and Michael Weaver of Guerriere & Halnon. Also present were Attorney Jason Talerman (Town Counsel), abutters Andrew Smith and Jeremy Flansburg. The project consists of crossing an intermittent stream and associated bordering vegetated wetland for construction of access drive to a proposed farmstand/greenhouse. The driveway crossing is to access the rear upland portion of the lot. Vecchione said that he would be using a tire scrubber on the site. Weaver discussed changes to the original plan and shown on the revised plan dated 12/23/11 such as the guard rail was moved for an entrance, the parking area has increased 2-feet, stabilize slopes and loam and seed. Brown asked about phasing and Weaver said he added a sequence phasing plan on the plan, which there are 28. Sharkey asked how can Zisk and Cundiff go onto the property if Vecchione wrote a letter stating that Cundiff, Zisk and the Commission were not allowed on the property. Vecchione said that he gave Cundiff and Zisk permission and will put this in writing upon approval. Brown stated that bonding for replication and the wetland crossing should be submitted prior to construction. Weaver said that the crossing would be done first. Brown wants the bonding added as a condition. Yacino asked about getting a letter from James Pyne and Weaver said he gave it to the Commission. Yacino asked if the erosion controls were in and Vecchione said that there was no swale at the bottom of the property but is planning on placing straw bales by October in order to cut the trees. Yacino said there are no straw bales in the pictures that were submitted and would like to see 20 to 30 straw bales placed up at the crossing. Abutter Andrew Smith asked if another crossing was going to be constructed as described and Weaver said yes with walls and pipe. Vecchione said he plans to take down 3 ½ acres of trees (for wood) and put up greenhouses. Much discussion about stream crossing and it will be a condition that the crossing of the stream over the existing crossing by use of any mechanical, electric or motorized vehicles of any kind is prohibited until the stream crossing proposed in the approved plan is constructed. Attorney Talerman said that Pyne and Fitzpatrick need to give their permission for this project (Power of Attorney). Yacino said this would be added as a condition. After much discussion, a Motion was made by Brown to close the Public Hearing and issue an Order of Conditions, seconded by Sharkey. Vote was unanimous.

8:30 PM (NOI) #143-0 PUBLIC HEARING – Northwest Main Street / MORSE HOMES, LLC
Present on behalf of the Applicant was Paul Hutnak of Andrews Survey. The project consists of the construction of a single family house, septic system and associated site work within 100-feet of a bordering vegetated wetland. Zisk gave a background about the original 6 lots. Hutnak said they would be staying out of the 50-foot buffer zone and would be placing straw bales and silt fence prior to construction. The Commission has not received a DEP Number yet and the Hearing will have to be continued. A Motion was made by Brown to continue the Public Hearing on Monday, April 2, 2012 at 7:15pm, seconded by Van Roo. Vote was unanimous.

1. Street Clean-Up. Open Space and Becky Perry set a date for Saturday, March 24, 2012. The Highway Department will pick up the trash on Monday and the Board of Health approved the trash being brought to the Transfer Station on Tuesday. If anyone has any questions or wants to get involved they can contact Becky Perry at 476-3486.
2. Meeting Minutes of 3/5. These minutes are on hold to have Lajoie watch the video to find out about the straw bales at the wetland crossing, Davis Street property.
3. Interface Land. Zisk said that Open Space contacted him and said that Interface wants to donate the parking lot and the dam to the Town. A site walk is scheduled for 3/25/12. The Commission is interested in obtaining this property but more information is necessary. In order to acquire donated land, the Board of Selectmen have to approve it also. Zisk to find out what fund can be accessed for costs. Yacino said he would attend the site walk on Sunday.

At 9:15pm, a Motion was made by Van Roo to adjourn the meeting, seconded by Brown. Vote was unanimous.
