The meeting was called to order at 7:00pm.

ATTENDANCE
Chairman Michael Yacino, Linda Brown, Brandi Van Roo, David Windoloski, Tracy Sharkey, Stephen Zisk (Planning/Conservation Agent) and Maria Lajoie (Administrative Secretary). Absent was David Gallant.

7:00 PM DISCUSSION
1. Wallum Lake State Park: Proposed work. Present was Cary VandenAkker, Park Supervisor. VandenAkker said that the Department of Conservation and Recreation has money until the end of June to repair the access roadway along the Southern New England Trunk Line. There was much discussion about the beaver problems and how the work will be done. The scope of work is to repair a stone line ditch along the trail on the gravel base of the roadway trail along with installing stone water bars along the edge of the trail for 500-feet to prevent flooding and runoff. Straw bales shall be placed at the edge of the trail when the work is performed along the edge of the wetlands. A Request for Determination will be filed with the Commission within 30-days after the completion of work. After much discussion, a Motion was made by Brown to issue an Emergency Certification Order and to have DCR file a Request for Determination with the Commission within 30-days after the completion of work, seconded by Van Roo. Vote was unanimous.

7:15 PM (NOI) #143-0849 PUBLIC HEARING – Isabella Drive, Lot #3 / MALTZ, BRAD & AMANDA
Present on behalf of the Applicant was their representative, Paul Hutnak of Andrews Survey. Hutnak stated that the Legal Notice was not in the newspaper and asked if this hearing could be placed on the next meeting. The Commission told Hutnak that this hearing will be held on June 18, 2012 at 7:30pm.

DISCUSSION
1. Schedule Site Walks - Request for Certificates of Compliance (4): Douglas Development Group/Joel Smith, 125 Perry Street, 143 Perry Street, 109 Perry Street, 137 Perry Street & 73 Linden Street. Zisk said that these site walks are not necessary because Joel Smith’s properties were split up into 4 lots and it did not affect 73 Linden Street. Zisk contacted Gerald Madaus, Attorney for the owners/sellers of 73 Linden Street, to let him know that there weren’t any issues.
2. Schedule Site Walk/Final Inspection: 8 Arnold Road. Zisk said that DEP is looking for final approval from the Commission regarding the oil spill clean-up. Zisk went to the property and said that there is no erosion occurring and it looks good. A Motion was made by Van Roo that DEP has met the conditions of the Emergency Certification Order, seconded by Brown. Vote was unanimous. A letter will be sent to DEP.
3. Northwest Main Street Wetland Violation: Update. A site walk was done by the Commission. Erosion controls are placed and the area is stable. Adverse runoff or sediment was not noticed, however, the Commission did not have Mr. Oikle’s permission to enter his property. Van Roo said she is not comfortable in case of a storm event and asked that straw bales be placed. Abutter Barbara Stewart said that the homeowners do not want the Paresky’s on their property unless they sign a waiver and Yacino said that Paul Mateer said that he does not want the Paresky’s on his property due to liability. There was much discussion about the homeowners not allowing the Paresky’s on their property to repair the violations. It was the consensus of the Commission that if a homeowner does not want anyone on their property, the homeowner owns the violation. Zisk said he would contact Paul Mateer and Gerald LeClair tomorrow to ask if the Paresky’s or someone the Paresky’s hire can access their property to repair the violations.

7:30 PM (NOI) #143-0847 PUBLIC HEARING – 32 Olde Carriage Lane / KTKM REALTY TRUST
Present on behalf of the Applicant was their representative Robert Poxon of Guerriere & Halnon. The Applicant is requesting permission to construct a single family house, installation of all utilities and associated grading occurring within the 100-foot buffer to a bordering vegetated wetland. Poxon said the proposed house and deck are in a portion of the buffer zone and that the remainder of the property in that area will be lawn. The Commission asked that the straw bales be moved closer to the work site. A site walk was scheduled for 6/11/12 and will meet in the Municipal parking lot at 5:15pm. A Motion was made by Van Roo to continue the Public Hearing on June 18, 2012 at 7:45pm, seconded by Brown. Vote was unanimous.

MEETING MINUTES OF 3/19
After review, a Motion was made by Brown to approve the Meeting Minutes of March 19, 2012, as amended, seconded by Van Roo. Vote was unanimous.

ADJOURNMENT
At 7:55pm, a Motion was made by Van Roo to adjourn the meeting, seconded by Brown. Vote was unanimous.
