The meeting was called to order at 7:00pm.

ATTENDANCE
Chairman Michael Yacino, Linda Brown, Brandi Van Roo, David Gallant, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Lajoie (Administrative Secretary). Absent were David Windoloski and Tracy Sharkey.

7:05 PM DISCUSSION
1. Northwest Main Street: Wetland Violation. Certified letters were sent to the owners of 60, 64, 70, 74 & 76 Northwest Main Street and the owner (s) of Parcel 186-3 on May 16, 2012 by the Conservation Commission, informing them that potential wetland violations may have occurred in the woods located between 60 and 76 Northwest Main Street and that there seems to have been some clearing and excavating work performed within 100-feet of a resource area, along with the potential filling of a resource area with horse manure and other materials dumped into the wetlands. Abutters/Owners present were Lee & Lynn Paresky, Kim Souter, Barbara Stewart, Paul & Joyce Guzewicz, Gerald & Shelia LeClair and Paul Mateer. A letter was received from Attorney Jerry Effren dated 5/21/12 stating that his clients Lee & Lynn Paresky, 76 Northwest Main Street may have been engaged in the specified activities. Lee Paresky said that his wife rides her horse and walks their dog on Donald Oikle’s property and has asked Oikle in the past if they could purchase some of his property. Paresky also said that Oikle gave him permission to go through his land. Yacino and Zisk walked the affected areas and found two potential areas of violation on two separate properties. Paresky admitted that he and his wife were at fault for this violation. There was much discussion with the owners about how to remedy this violation and the impact it has created. Van Roo asked where the machine is now and the Paresky’s said on their property. Yacino said that the letter from Paresky’s Attorney’s states that they want to hire an engineer to delineate the area. Van Roo suggested that an engineer is unnecessary for manure removal and she suggested placing straw bales and to remove the manure and debris out of the resource area. Brown wants the manure removed by hand and Van Roo agreed that no machinery should remove the debris because it will disrupt the area. Yacino asked the Commission to go look at the areas of concern. The Commission will do a site walk on 5/24/12 @ 5:15pm. Lynn Paresky agreed to take the new manure out with a shovel as soon as possible and will place straw bales. Stewart said that Oikle did not give the Paresky’s permission to go on his property and also said that the smell is unbearable. Yacino asked if the Paresky’s could go on the owners properties and remove the manure and Guzewicz said yes. Paul Mateer said that he has not been out back on his property but said he would look to see if there are any violations and he gave the Commission permission to go on his property. Zisk said he would go to the property tomorrow and show the Paresky’s what to do right now. Van Roo said that a violation fine should be issued and will be discussed at the next meeting on 6/4/12.
2. Emergency Certificate/Route 16 Culvert. Cundiff said that the Highway Department will remove two 42-inch diameter culvert pipes and replace them with two new 48-inch diameter culvert pipes. They will backfill around the new pipes and then pave over the disturbed area. Erosion controls (straw bales) shall be placed downstream of the excavation area as approved by the Commission or its Agent. The work is to take place within a day or two. The Commission approved this work to be done.
3. Request for Extension Permit for Order of Conditions: “Evergreen Estates”, 209 South Street. A Motion was made by Van Roo to issue an Extension Permit for two (2) years, seconded by Brown. Vote was unanimous. This Extension will end on 5/21/2014 and there are no more extensions at the end of this date.
4. Chestnut Street. Dale Bangma present. A wetland crossing was approved and Bangma is in to request permission to begin the work by placing logs across the stream in the location of the crossings in order to access either side of the stream during the logging operation of the project. Once the tree logging has been completed, the crossing logs will be removed and construction on the permanent crossing shall commence right away. Bangma said he is supposed to do this work during the low flow but the water never froze this past winter and then it never stopped raining. Zisk suggested prepping the replication area now and do the work later when the ground water drops and stops flowing. Van Roo asked what the crossing is for and Bangma said he is constructing a driveway and it is a typical wetland crossing with the least disturbance. Brown wants to make sure that the bonds are in place prior to working and Zisk said they were (one for the wetland crossing and one for the replication). Zisk said he would go out and look at the site. Bangma said the logs are to be taken out by the end of July and the (2) culverts will be constructed as soon as possible. Bangma is asking to do this work now (two weeks early) instead of waiting until July 15th. There was much discussion about how Bangma wants to proceed with the work. Van Roo asked that straw bales be placed during replication and remove the logs over the crossing by July or sooner. Zisk will periodically check the work being done at the site. A Motion was made by Van Roo to allow Bangma to begin work on the crossings by placing the logs across the stream in the location of the crossings and to place erosion controls prior to the commencement of work, seconded by Brown. Vote was unanimous.

7:15 PM (NOI) #143-0847 PUBLIC HEARING – 32 Olde Carriage Lane / KTKM REALTY TRUST
Neither the Applicant nor representative were present, therefore the Commission could not open this hearing.



7:30 PM (RDA) PUBLIC MEETING – 12 Bigelow Road / SALMONSEN, LANCE
Present on behalf of the Applicant was Ron Desjardin, Contractor. The Applicant is requesting permission to dig six (6) footings to replace the existing landing and stairs with new deck and stairs. The footings are to be approximately 41-feet from the edge of the water. Desjardin said the work will be completed within 28 hours and no trees will be removed. The Commission did a site walk. After discussion, a Motion was made by Brown to close the Public Meeting and issue a Negative Determination of Applicability, seconded by Van Roo. Vote was unanimous.

7:45 PM (RDA) PUBLIC MEETING – 7 Laurel Glades / BERKOWITZ, JAMES
Present was the Applicant James Berkowitz. The Applicant is requesting permission to remove driveway extension and replace with stairway that will be 5-feet across and lawn with a patio and will be leveled with slight grade from drainage and 30-feet across. Berkowitz said his intention is to stabilize the side yard and plant grass. The Commission did a site walk and had no issues. After discussion, a Motion was made by Van Roo to close the Public Meeting and issue a Negative Determination of Applicability, seconded by Brown. Vote was unanimous.

8:00 PM (NOI) #143-0848 PUBLIC HEARING – 362 Southwest Main Street / GLIDDEN, THERESA
Linda Brown recused herself. Present was the Applicant Theresa Glidden and is requesting permission to construct a 16-foot by 22-foot addition on the existing home within the 100-foot buffer zone. A site walk was done by the Commission and had no issues. A Motion was made by Van Roo to close the Public Hearing and issue an Order of Conditions, with the condition that straw bales be placed prior to construction, seconded by Gallant. Vote was unanimous.

1. 3/5/12. A Motion was made by Brown to approve the Meeting Minutes of March 5, 2012, as amended, seconded by Van Roo. Vote was unanimous.
2. 3/19/12. These minutes are on hold.
3. 4/2/12. A Motion was made by Brown to approve the Meeting Minutes of April 2, 2012, as presented, seconded by Van Roo. Vote was unanimous.
4. 4/17/12. A Motion was made by Brown to approve the Meeting Minutes of April 17, 2012, as amended, seconded by Van Roo. Vote was unanimous.

A moment of silence was held for the passing of Ralph “Ned” Dudley, a former Conservation Commission Member and employee of the Water/Sewer Department. Ralph was an asset to the Commission and we will miss our friend.

ADJOURNMENT
At 8:50pm, a Motion was made by Brown to adjourn the meeting, seconded by Van Roo. Vote was unanimous.
