The meeting was called to order at 7:00pm.

ATTENDANCE
Linda Brown (Chairman), Brandi Van Roo, Michael Greco, Jack Pruitte, Stephen Zisk (Planning/Conservation Agent), William Cundiff (Town Engineer) and Maria Lajoie (Administrative Secretary). Tracy Sharkey (Vice Chairman) arrived at 7:45pm. Absent was David Windoloski David Gallant.

7:00 PM DISCUSSION
1. Minor Plan Change Request: 362 Southwest Main Street. Brown recused herself which left the Commission without a quorum. This issue will be discussed later tonight when Sharkey arrives.

7: 03 PM SIGNED:
1. Certificate of Compliance: John & Stacey Bagaglio, 9 Potter Road. A Motion was made by Van Roo to grant a Certificate of Compliance to John & Stacey Bagaglio, 9 Potter Road, seconded by Pruitte. Vote Unanimous.
2. Certificate of Compliance: Harold Davis, 80 Orange Street. A Motion was made by Van Roo to grant a Certificate of Compliance to Harold Davis, 80 Orange Street, seconded by Greco. Vote Unanimous.
3. Meeting Minutes of 6/18/12. After review, a Motion was made by Van Roo to approve the Meeting Minutes of June 18, 2012, as amended, seconded by Greco. Vote Unanimous.
4. Meeting Minutes of 7/9/12. After review, a Motion was made by Van Roo to approve the Meeting Minutes of July 9, 2012, as amended, seconded by Greco. Vote Unanimous.
5. Meeting Minutes of 5/21/12. These minutes are on hold for the next meeting. Lajoie to check video for one agenda item.

7:15 PM (NOI) #143-0841 PUBLIC HEARING CONTINUED – 115 Shore Road / MILLER, ROBERT
Seth Lajoie of Lajoie & Associates, representative for the Applicant, had telephoned and verbally asked Zisk for a continuance of this Public Hearing for one month. A Motion was made by Van Roo to continue the Public Hearing on Monday, October 1, 2012 at 7:15pm, seconded by Pruitte. Vote Unanimous.

7:30 PM (RDA) PUBLIC MEETING – 187 Southwest Main Street / WISHART, MARY
Present on behalf of the Applicant was Paul Hutnak of Andrews Survey. The Applicant is requesting permission to install a replacement septic system and only the new septic tank will be within the 100-foot buffer zone. Hutnak said that after the work is complete they will backfill and loam and seed. Brown asked if it is a raised system and Hutnak said yes. Brown asked if there would be any stockpiling and Hutnak said no they will be bringing in fill. Hutnak said the property is fairly flat and nothing is heading toward Laurel Lake. After discussion, the Commission asked that straw wattles and silt fence be used for erosion control and a 20-foot elbow be placed along the left side of the property line. A Motion was made by Van Roo to issue a Negative Determination of Applicability with the above conditions, seconded by Pruitte. Vote Unanimous.

DISCUSSION
Minor Plan Change Request: 362 Southwest Main Street. Brown recused herself.
Present was Brian Provencal, Contractor, on behalf of the Owner Theresa (Glidden) Arpin. Provencal is requesting permission to install four concrete sona tubes by hand to extend the deck. The Commission had no problem with this request but asked for a revised copy of the plan. A Motion was made by Van Roo to approve the minor change to dig 4 sona tubes by hand, seconded by Greco. Vote Unanimous.

7:50 PM (RDA) PUBLIC MEETING – 160 Southwest Main Street / GUARANTEED BUILDERS AND DEVELOPERS, INC.
Sharkey recused herself. Present on behalf of the Applicant was William Pybas, employee for Guaranteed Builders. The Applicant is requesting permission to construct a 24-foot by 24-foot detached garage with a 12-15% slope toward the wetlands. The proposed garage will be located in the rear of the property. Pybas also said that the gravel driveway is located at the end of the paved driveway. Brown asked about stockpiling and Pybas said everything will be taken off the site. Van Roo is concerned about the large excavation area so close to the 25-foot no disturb line and feels that a Notice of Intent should be filed showing the work involved and straw bales on an engineered plan. After discussion, a Motion was made by Van Roo to issue a Positive Determination of Applicability, seconded by Greco. Vote Unanimous.

1. Certificate of Compliance: Fidelity Financial, “Shady Knoll Estates II”. A Motion was made by Van Roo to grant a Certificate of Compliance, seconded by Sharkey. Vote Unanimous.
2. Negative Determination of Applicability: Mary Wishart, 187 Southwest Main Street
3. Positive Determination of Applicability: Guaranteed Builders and Developers, Inc., 160 Southwest Main Street

ADJOURNMENT
At 8:12pm, a Motion was made by Van Roo to adjourn the meeting, seconded by Sharkey. Vote Unanimous.
