The meeting was called to order at 7:15pm.

ATTENDANCE
Present were Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo, Michael Greco, Jack Pruitte, Stephen Zisk (Conservation Agent) and Maria Lajoie (Administrative Secretary). David Windoloski and David Gallant were absent.

7:15 PM DISCUSSION
1. Meeting Minutes of 9/4/12. After review, a Motion was made by Van Roo to approve the Meeting Minutes of Tuesday, September 4, 2012, as amended, seconded by Sharkey. Vote unanimous.
2. Negative Determination of Applicability: Jesse & Debra Speckhard, 93 Chestnut Street. The Commission signed.
3. Certificate of Compliance: Douglas Properties, LLC, 143 Martin Road. This Certificate is on hold until the owners complete the remaining work.
4. Mowing Conservation Land. Brown asked Zisk to have the Makowski Drive property mowed and also asked Zisk to look at the property on Manchaug Street to see if it also needed mowing.
5. Request for Determination, Intermediate/Elementary School, 21 Davis Street. The Intermediate/Elementary School filed a Request for Determination for work that had already been done in a resource area. The Facilities Maintenance man from the school created a path by laying down stone dust in order for the students to temporarily pass through. The Commission will discuss this issue later while Zisk goes to the office to get the pictures he took of the site.

7:35 PM (RDA) PUBLIC MEETING – Brookline Terrace / DOUGLAS SOLAR, LLC & NATIONAL GRID
Present on behalf of the Applicant was Stephen O’Connell of Andrews Survey. The Applicants are requesting permission to install one (1) new utility pole and replace two (2) existing utility poles within 100-feet of Centerville Brook. The closest pole is 30-feet from the brook where there is also a 36-inch culvert. O’Connell said National Grid would dig the holes using an auger and will backfill. Van Roo asked about erosion controls and O’Connell said half-moon straw wattles will be used. A Motion was made by Sharkey to issue a Negative Determination of Applicability with the condition that prior to the commencement of work, half-moon straw wattles shall be installed between the telephone poles and the wetland area, seconded by Van Roo. Vote Unanimous.

DISCUSSION
Request for Determination, Intermediate/Elementary School, 21 Davis Street (Continuation). Zisk showed the Commission pictures that he had taken of the path at the school. Van Roo asked how close the path was to the resource area and Zisk said approximately 45-feet. Van Roo asked how deep the stone dust was on the path and Zisk said a couple of inches. The Commission read the legal notice that the School Department placed in the Telegram and they were concerned with their wording “to reopen the existing pathway”. Van Roo said a violation notice should have been issued. The Commission agreed that the material that was placed on the path where the stream flow is located is to be removed by hand and stored outside of the buffer zone and a representative from the school Department is to attend the Conservation Meeting on October 1, 2012 at 7:30pm to discuss this violation. Zisk reminded everyone that “nothing is exempt in a resource area.”

ADJOURNMENT
At 8:15pm, a Motion was made by Greco to adjourn the meeting, seconded by Sharkey. Vote unanimous.
