The meeting was called to order at 7:01pm.

ATTENDANCE
Present were Daniel Heney (Chairman), Pamela Holmes (Vice Chairman), Sean Holland (Member), Leonard Demers (Alternate) and Maria Lajoie (Administrative Secretary). Absent was John Bombara (Alternate)

PUBLIC HEARING CONTINUED: GUARANTEED BUILDERS, INC.
160 Southwest Main Street
Request for Variance
Hearing this Case is Daniel Heney, Pamela Holmes and Sean Holland. Present was the Applicant’s representative, William Pybas. The Board received a Memo from the Conservation Commission dated 12/5/12 requesting that ZBA consider a Variance of a 5-foot side yard setback to lessen the impact to the resource area. The Applicant requests a 5-yard setback, the Bylaw requires a 25-foot side yard setback and during the hearing process an abutter had concerns about the 5-foot setback and the Board agreed to a compromise of a 15-foot setback. Heney said that the Board has already gone from 25-feet to 15-feet and cannot go any less. Pybas said there is no way to keep out of the buffer zone because it is a strange shaped lot to begin with. Holmes said the buyer must have known there would be limitations. A Motion was made by Holmes to close the Public Hearing, seconded by Holland. Vote: Unanimous.
A Motion was made by Holmes to grant a Variance with an amendment for a 15-foot side yard setback to Guaranteed Builders, Inc., 160 Southwest Main Street -
Case #2012-06, seconded by Holland. Vote: Unanimous.

MEETING MINUTES OF 10/3/2012
After review, a Motion was made by Holland to approve the Meeting Minutes of Wednesday, October 3, 2012, as written, seconded by Demers. Vote: Unanimous.

MEETING MINUTES OF 11/7/2012
After review, a Motion was made by Holland to approve the Meeting Minutes of Wednesday, November 7, 2012, as written, seconded by Demers. Vote: Unanimous.

2013 MEETING SCHEDULE
A Motion was made by Holland to approve the 2013 Hearing Dates & Deadlines for 2013, as amended, seconded by Holmes. Vote: Unanimous.



MAIL
1. Planning Board Application: NextSun Energy, 436-440 Northeast Main Street (Site Plan Review for Solar Farm). The Board had no issues with this application.
2. Planning Board Application: Guaranteed Builders, Inc., 10 Riedell Road (Site Plan Review for building). The Board had no issues with this application.

ADJOURNMENT
At 7:32pm, a Motion was made by Demers to adjourn the meeting, seconded by Holland. Vote: Unanimous.
