PLANNING BOARD MEETING MINUTES
TUESDAY, SEPTEMBER 10, 2013

A meeting of the Planning Board was held on Tuesday, September 10, 2013. Mr. Marks called the meeting to order at 7:02 PM and announced that the meeting is being recorded and will be available on cable and on the website.

ATTENDANCE
PRESENT: Ernest Marks (Chairman), Derek Brown, Eben Chesebrough, Michael Greco, Tracy Sharkey, Robert Werme, Jr., Michael Zwicker, William Cundiff (Town Engineer)
ABSENT:

7:02 PM #2013-14 ANR PLAN: SHIRLEY DOWNS, 75 SOUTH STREET
Atty. Edwin Taipale joined the meeting and presented the plan. Mr. Cundiff stated that the address concerns have been addressed, and the applicant is aware that the second lot could be a lot frontage exemption lot, but they are not filing for that. Mr. Cundiff informed the board that Old Farm Road has been accepted as a public way.
Mr. Chesebrough made a motion to endorse the ANR Plan, Richard A. & Shirley A. Downs, 89 South Street, as presented to the board. Ms. Sharkey seconded the motion. Vote: Unanimous.

MINUTES
Mr. Chesebrough made a motion to approve the revised minutes of the May 28, 2013 Planning Board meeting as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.
Mr. Zwicker made a motion to approve the minutes of the July 9, 2013 Planning Board meeting as amended. Mr. Chesebrough seconded the motion. Vote: Unanimous

DISCUSSION
1. Application for Accessory Apartment Special Permit Extension: Michael & Jeanne Denomme, 102 Perry Street.
Mr. Chesebrough made a motion to approve the renewal of the Accessory Apartment Special Permit Extension: Michael & Jeanne Denomme, 102 Perry Street. Mr. Greco seconded the motion. Vote: Unanimous.

7:35 PM PUBLIC HEARING CONTINUED: AMERICAN PRO WIND (SPR-100614) APPLICATION FOR SITE PLAN REVIEW, LOCATED ON THE SOUTH SIDE OF ROUTE 16 (WEBSTER STREET) ABUTTING THE WEBSTER TOWN LINE
Mr. Marks continued the public hearing and read a letter from the applicant withdrawing the application. A discussion was held Mr. Cundiff stated that the applicant has a PILOT agreement with them and they are obligated to honor that agreement with the Board of Selectmen. Some of the parcels are still owed some back taxes.
Mr. Chesebrough made a motion to close the public hearing: American Pro Wind (SPR-100614) Application for Site Plan Review, located on the south side of Route 16 (Webster Street) abutting the Webster Town Line. Mr. Werme seconded the motion. Vote: Unanimous.
Mr. Chesebrough made a motion to vote to accept the withdrawal, as outlined in a letter from Maurice Caparrotta dated September 5, 2013, without prejudice of the Site Plan Review Application for the project titled, Douglas Woods Wind Farm Project, as proposed by American Pro Wind, LLC, and consider this Site Plan Review closed. Ms. Sharkey seconded the motion. Vote: Unanimous.

OPEN SESSION
Mr. Cundiff stated that he prepared a draft of the proposed Sign Bylaw. He suggested scheduling one last meeting of the Sign Bylaw Study Group to review any comments on the latest draft.
Louis Tusino (MOD-130225) Application for a Modification of a Subdivision Plan, Cardinal Drive, dated February 10, 2003. Ms. Sharkey recused herself. Mr. Cundiff distributed a copy of the decision for Cardinal Drive. He stated that town counsel has reviewed it. The clarity of Items 6 & 8 was discussed. The conditions were discussed. The board will review the decision and place it on the agenda for September 24, 2013. Atty. Jay Talerman will be invited to the next meeting.
Ms. Sharkey rejoined the meeting.
Mr. Cundiff stated that Conservation Drive and Old Farm Road are now public ways.

8:03 PM ADJOURNMENT
Mr. Chesebrough made a motion to adjourn the meeting at 8:03 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
