The meeting was called to order at 7:05pm.

ATTENDANCE
Present: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), David Windoloski, Michael Greco, Jack Pruitte, Stephen Zisk (Conservation Agent) and Maria Lajoie (Administrative Secretary).
Absent: Brandi Van Roo and David Gallant.

7:05 PM (NOI) #143-0852 PUBLIC HEARING CONTINUED– 91 Chestnut Street / TIMOTHY ROBAR
The Commission received a letter from Michael Yerka of Civil Site Engineering dated 3/14/2013, requesting a continuance of this hearing and site walk to replace the missing wetland flags. A site walk has been scheduled for Saturday, March 30, 2013 at 10:00am. A Motion was made by Sharkey to continue the Public Hearing on April 1, 2013 at 7:00pm, seconded by Pruitte. Vote: Unanimous.

7:07 PM (RDA) PUBLIC MEETING – 36 Davis Street /
MICHAEL FITZPATRICK
Present was Michael Fitzpatrick requesting permission to construct a 12-foot by 16-foot shed on blocks. The shed is partially within the 50-foot buffer zone and the Commission asked that the shed be moved 8-feet along the fence line and the shed would no longer be in the buffer zone. Fitzpatrick had no problem with this request. Zisk mentioned that there is still an outstanding Order of Conditions and suggested Fitzpatrick to write a letter to the Commission requesting a Certificate of Compliance. A Motion was made by Sharkey to issue a Negative Determination of Applicability with the condition that the shed be moved 8-feet out of the buffer zone, seconded by Pruitte. Vote: Unanimous.

DISCUSSION:
1. 91 Chestnut Street. Present was Michael Yerka and Margaret Bacon of Civil Site Engineering asking the date and time of the site walk for 91 Chestnut Street. Brown told them it was scheduled for 3/30/13 @ 10:00am and the Public Hearing was continued until 4/1/13 @ 7:00pm.
2. Mather Construction. Zisk said that Mr. Mather is looking for something in writing stating that the Violation Notice that he received in the amount of $800 for a wetland violation on Webster Street (American Pro Wind) has been resolved. Brown gave Zisk permission to write Mather a letter.
3. NextSun Energy, Northeast Main Street. Brown said she went to the site and said they were working too close to the tree line and tearing up the field and there is no topsoil left. Zisk said he went to the site and talked to a construction worker regarding the topsoil. Zisk said that the plans show grading and that this work is outside the Commission’s jurisdiction. All erosion controls are in place. The Commission asked Zisk to get a construction sequence plan from Steve O’Connell at Andrews Survey.
4. Elementary School/Middle School Project. Zisk has been checking the site and said that the construction is going well.
5. Meeting Minutes: 12/3/12. After review, a Motion was made by Pruitte to approve the Meeting Minutes of December 3, 2012, as amended, seconded by Sharkey. Vote: Unanimous.
6. Beaupre Recycling, Cliff Street. Zisk did a site walk and said that the work being done is all outside the 100-foot buffer zone.
7. Meeting Minutes: 2/4/13. After review, a Motion was made by Pruitte to approve the Meeting Minutes of February 4, 2013, as amended, seconded by Windoloski. Vote: Yes-4, Abstained-1. Vote passed.
8. Meeting Minutes: 2/19/13 (Did not have a quorum). After review, a Motion was made by Sharkey to approve the Meeting Minutes of February 19, 2013, as written, seconded by Pruitte. Vote: Yes-3, Abstained-2. Vote passed.
9. Meeting Minutes: 3/4/13. After review, a Motion was made by Sharkey to approve the Meeting Minutes of March 4, 2013, as written, seconded by Pruitte. Vote: Unanimous.

ADJOURNMENT
At 7:37pm, a Motion was made by Pruitte to adjourn the meeting, seconded by Windoloski. Vote: Unanimous.
