CONSERVATION COMMISSION MEETING MINUTES
MONDAY, JULY 8, 2013

The meeting was called to order at 7:00pm.

ATTENDANCE
Present: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo, Michael Greco, Stephen Zisk (Conservation Agent) and Maria Lajoie (Administrative Secretary).

7:00 PM (NOI) #143-0857 PUBLIC HEARING – 1 Laurel Glades / CORREIA, DANIEL
Present was the owner Daniel Correia and Angela Rose. Mr. Correia is requesting permission to raise an existing dwelling and build a new single family dwelling and garage. The house will be moved 14-feet further away from the reservoir. Mr. Correia said he will be using the existing septic system and installing a new well. Erosion controls will be placed along the tree line extended beyond proposed garage and there will be an area for stockpiling during construction. The Commission wants to see the existing patio, erosion controls and distances shown on the plan. The Commission scheduled a site walk for Wednesday, July 10, 2013 at 6:00pm. After discussion, a Motion was made by Ms. Sharkey to continue the Public Hearing on Monday, August 5, 2013 at 7:30pm, seconded by Ms. Van Roo. Vote: Unanimous.

7:20 PM (RDA) PUBLIC MEETING – 92 Webster Street / MICHAUD, SCOTT
Present was the Applicant Scott Michaud and his representative Timothy Callahan. A Violation Notice was issued for clearing the buffer zone and constructing an access way when Zisk saw that work had begun on this property. Erosion controls were placed along the limit of disturbance line that was within the 100-foot buffer zone of a resource area and stopped all activity. The Applicant filed this RDA to request permission to construct a driveway with pervious material that borders an intermittent stream which crosses under the road on the left side. The Commission said that the plan that was presented does not have enough information. Mr. Zisk asked what would be done to the side slopes and Mr. Callahan said they wanted to place large rocks that will go upward 100 to 150 feet. Ms. Sharkey asked what they were going to do to prevent sediment and Mr. Michaud said they would grade, loam and seed. Mr. Zisk said that they still need to prep the driveway before stabilizing. Ms. Van Roo feels that the Applicant should file a Notice of Intent due to considerable disturbance and also said that a native seed mix should be used. After discussion, a Motion was made by Ms. Van Roo to issue a Positive Determination of Applicability and to file a Notice of Intent, seconded by Mr. Greco. Vote: Unanimous.
A Motion was then made by Ms. Van Roo to issue a fine of $100 for the violation, seconded by Ms. Sharkey. Vote: Unanimous.

7:35 PM (NOI) #143-0856 PUBLIC HEARING – 19 Cobblestone Lane, Lot #14 / KTKM REALTY TRUST
Present was Applicant Kevin Rafferty, his son Michael Rafferty and their representative Norman Gamache of Guerriere & Halnon. The Applicant is requesting permission to construct a single family house, installation of all utilities and associated grading, which occur within 100-feet of a bordering vegetated wetland. Mr. Gamache said the driveway will be paved with semi-permeable material and the Commission said that this will be a condition in the Order of Conditions. Straw wattles will be placed prior to work. Ms. Sharkey asked if erosion controls will be placed around the well and Mr. Zisk said the well is outside the buffer zone. Ms. Brown asked if the Commission wanted to do a site walk and the members felt this NOI was straight forward and a site walk was not necessary. A Motion was made by Ms. Van Roo to close the Public Hearing and issue an Order of Conditions, seconded by Ms. Sharkey. Vote: Unanimous.
7:45 PM (AMENDED NOI) #143-0854 PUBLIC HEARING – 12 Meetinghouse Lane, Lot #27 / KTKM REALTY TRUST
Present was Applicant Kevin Rafferty, his son Michael Rafferty and their representative Norman Gamache of Guerriere & Halnon. The Applicant has filed an Amended NOI to request permission to grade the driveway and side yard of the proposed house on lot, a portion of which falls within 100-feet of a bordering vegetated wetland. This amendment will give the potential homeowner more open area on the property. The house and well are outside the buffer zone. Michael Rafferty feels that an owner has the right to do what they want on their own property. Mr. Zisk said that the Commission looks at the intent to see if it will have an adverse impact to the wetlands. Mr. Gamache said the Applicant did not think the original plan was marketable. The Commission scheduled a site walk for Wednesday, July 10, 2013 at 6:30pm. A Motion was made by Ms. Sharkey to continue the Public Hearing on Monday, August 5, 2013 at 7:45pm, seconded by Ms. Van Roo. Vote: Unanimous.

8:00 PM (AMENDED NOI) #143-0855 PUBLIC HEARING – 8 Meetinghouse Lane, Lot #28 / KTKM REALTY TRUST
Present was Applicant Kevin Rafferty, his son Michael Rafferty and their representative Norman Gamache of Guerriere & Halnon. The Applicant has filed an Amended NOI to request permission to grade the back yard of the proposed house, a portion of which falls within 100-feet of a bordering vegetated wetland. Mr. Gamache said that the limit of disturbance will be between 50 and 100 feet in the buffer zone and the total disturbance is 9,000 square feet. The Commission scheduled a site walk for Wednesday, July 10, 2013 at 6:45pm and asked that the site clearing and wetlands be flagged on Lot #27 and Lot #28 prior to the site walks. A Motion was made by Ms. Sharkey to continue the Public Hearing on Monday, August 5, 2013 at 8:00pm, seconded by Ms. Van Roo. Vote: Unanimous.

DISCUSSION:
1. Ellis, 118 Chestnut Street. Michael Yerka and Margaret Bacon present to ask the Commission’s opinion regarding the two-lot shared driveway parcels that were created in 2003 consisting of 7 ½ acres. The Commission denied an extension on the Order of Conditions in 2007. Mr. Ellis wants to combine the properties from two lots into one lot with one driveway with no wetland crossing. Mr. Zisk said this project benefits by eliminating disturbance in the wetland. Mr. Yerka said he would go before the Planning Board with an ANR Plan to eliminate one lot. The plan will also state that the back portion is unbuildable. The Commission was in favor of Mr. Ellis filing this new plan.
2. William Nydam, 58 Ledgestone Road (DEP #143-0814). Robert Murphy of Murphy & Associates is requesting a Certificate of Compliance on the owners’ behalf. Zisk took pictures of the property and the Commission had no issues. A Motion was made by Ms. Sharkey to issue a Certificate of Compliance for 58 Ledgestone Road, seconded by Ms. Van Roo. Vote: Unanimous.
3. Minutes of 5/7/2013. After review, a Motion was made by Mr. Greco to approve the Meeting Minutes of May 7, 2013, as amended, seconded by Ms. Sharkey. Vote: Yes-3, Abstained-1. Vote passed.
4. Minutes of 6/3/2013. After review, a Motion was made by Ms. Van Roo to approve the Meeting Minutes of June 3, 2013, as amended, seconded by Ms. Sharkey. Vote: Unanimous.
5. Signed vouchers (2).
6. Conservation Commission Vacancies. Ms. Brown told the members that she spoke to Michael Guzinski, Town Administrator, about lowering the members from 7 to 5. Mr. Guzinski said he would check with Town Counsel. Zisk said he would hate to see the Commission make any rash decisions and the Commission agreed to give it more time. Ms. Van Roo said we need to get the word out because advertising on cable and post in the Municipal Center is not enough. Ms. Brown will keep the members informed when she hears back from Mr. Guzinski.

At 8:50pm, a Motion was made by Ms. Sharkey to adjourn the meeting, seconded by Ms. Van Roo. Vote: Unanimous.
