CONSERVATION COMMISSION MEETING
MONDAY, AUGUST 19, 2013
7:00 PM
(Community Meeting Room)
The meeting was called to order at 7:12pm.

ATTENDANCE
Present: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo (Member), Michael Greco (Member) and Stephen Zisk (Conservation Agent).
Absent: Maria Lajoie (Administrative Secretary).

7:00 PM (RDA) PUBLIC MEETING – 357 Northwest Main Street / HAGEN, PAUL & RIGANATI, JEAN
Present were the Applicants Paul Hagen & Jean Riganati. The proposed work consists of the re-construction of an existing house, installation of a new septic system and associated site work. Mr. Zisk showed pictures of the property. Ms. Brown said that the proposed work is 89-feet from the pond. Ms. Van Roo asked that a condition be added stating “Prior to the commencement of any activity, the Applicant must install erosion controls as shown on the plan dated August 13, 2013.” A Motion was made by Ms. Van Roo to close the Public Hearing and issue a Negative Determination of Applicability with the above special condition, seconded by Ms. Sharkey. Vote: Unanimous.

7:15 PM (NOI: DEP #143-0862) PUBLIC HEARING – 9 Cook Street / JOSEY, ROBERT
Present on behalf of the Applicant was Tim Callahan of Hawk Consulting, Inc. The proposed work consists of the re-construction / extension of an existing garage within 200-feet of the Mumford River. Mr. Josey said he would not be pouring a foundation just a slab and also said that it is flat in the back yard. The Commission had no issues. A Motion was made by Ms. Van Roo to Close the Public Hearing and issue an Order of Conditions, seconded by Ms. Sharkey. Vote: Unanimous.

7:30 PM (NOI: DEP #143-0860) PUBLIC HEARING – 117 Ledgestone Road / KNAPIK, THERESE
Present on behalf of the Applicant was Norman Hill of Land Planning. The proposed work consists of the repair of a septic system. Mr. Hill said that it failed inspection and the Applicant wants to sell the property. Mr. Hill said that the yard is flat and will place silt fence and straw wattles prior to the commencement of work. A Motion was made by Ms. Van Roo to Close the Public Hearing and issue an Order of Conditions, seconded by Ms. Sharkey. Vote: Unanimous.

DISCUSSION
1. The Commission received a letter from Guaranteed Builders dated 8/6/13 regarding the new owners at 13 Laurel Hill Road informing them that they will be responsible to ask the Commission for a Certificate of Compliance when the work is completed. No action is necessary.
2. New Camera. Zisk informed the Commission that he needs a new camera that will take good pictures and videos. After discussion, a Motion was made by Ms. Sharkey to allow Mr. Zisk to purchase a new camera and an extra battery not to exceed $400, seconded by Ms. Van Roo. Vote: Unanimous.
3. Replication Areas. Ms. Van Roo said she and Mr. Zisk did a site walk at a replication area and feel that the Commission should make a condition for replication areas and wetland crossings that they be checked twice (2) a year by the owner/engineer with the Conservation Agent and to submit reports to the Commission. The Commission agreed that this should be a part of all standard conditions for replication and wetland crossing areas. Also, replication must be started prior to construction and bonds must be submitted. This statement is to be noted on the plan.

7:45 PM (AMENDED NOI: DEP #143-0854) PUBLIC HEARING CONTINUED – 12 Meetinghouse Lane, Lot #27 / KTKM REALTY TRUST
Present was Michael Rafferty of KTKM Realty Trust and Normand Gamache of Guerriere & Halnon. The proposed work consists of grading for the driveway and side yard of the proposed house, a portion of which falls within 100-feet of a bordering vegetated wetland. A site walk was done. Mr. Gamache said that the wetland scientist will be going to the site this Wednesday. Ms. Brown said that this looks like a flat lot and then dips down on the right side. Mr. Gamache will contact Mr. Zisk when the wetland scientist has completed her report. A Motion was made by Ms. Sharkey to continue the Public Hearing on Tuesday, September 3, 2013 at 7:00pm, seconded by Mr. Greco. Vote: Unanimous.

DISCUSSION
1. Certificate of Compliance: Brad Maltz, Linden Street, Lot #44. A site walk was done for the wetland crossing. Ms. Van Roo said that the replication area is overgrown and not connected to the wetland crossing and there is surface water. Ms. Van Roo suggested that a shovel be used to remove approximately a 2-foot span of sections of berm on each side. Ms. Sharkey agreed and said to remove the soil but flag the sections of berm. Mr. Maltz said he will connect the stream to the wetland.

8:00 PM (AMENDED NOI: DEP #143-0855) PUBLIC HEARING CONTINUED – 8 Meetinghouse Lane, Lot #28 / KTKM REALTY TRUST
Present was Michael Rafferty of KTKM Realty Trust and Normand Gamache of Guerriere & Halnon. The proposed work consists of grading for back yard of the proposed house, a portion of which falls within 100-feet of a bordering vegetated wetland. A site walk was done and the Commission is fine with the new line. Mr. Gamache said that all work is outside the 50-foot buffer zone. Ms. Van Roo asked that plantings, rocks or fencing be placed along the edge of the limit of disturbance line. Ms. Sharkey agreed that this is reasonable for the new owner. Mr. Gamache said the Applicant is not in favor of placing boulders but plantings are fine. Ms. Van Roo said as long as plantings used will prevent creeping will be fine. Mr. Rafferty expressed his concern that owners have a right to do what they want on their own property. Ms. Brown said that this condition is per the State’s Wetland Protection Act and asked Mr. Rafferty if he agrees to plant something or not. Mr. Gamache asked if they could recess in order to speak to his client and a Motion was made by Ms. Van Roo to table this Public Hearing until later, seconded by Ms. Sharkey. Vote: Unanimous.

8:15 PM (NOI: DEP #143-0859) PUBLIC HEARING CONTINUED – 92 Webster Street / MICHAUD, SCOTT
Present was Scott Michaud, Applicant and his representative Tim Callahan of Hawk Consulting, Inc. The proposed work consists of the construction of a driveway within 100-feet of a bordering vegetated wetland. A site walk was done and a revised plan was submitted dated 8/12/13. The Commission had no issues. A Motion was made by Ms. Van Roo to close the Public Hearing and issue an Order of Conditions, seconded by Ms. Sharkey. Vote: Unanimous.

DISCUSSION
1. Certificate of Compliance: Brad Maltz, Linden Street, Lot #3R. Mr. Maltz said he has a closing tomorrow. Ms. Van Roo said the shed is behind the line of disturbance and 50 to 60-feet has been cleared. Mr. Maltz said the house is 28-feet by 32-feet. The Commission asked that an as-built plan be submitted because the house is smaller than what was approved.
2. Certificate of Compliance: Brad Maltz, Linden Street, Lot #1R. This lot has a log cabin and a shed and behind the lawn pea stone was placed and goes into the buffer zone area. Ms. Van Roo asked that an as-built plan be submitted.

8:25 PM (AMENDED NOI: DEP #143-0855) PUBLIC HEARING CONTINUED – 8 Meetinghouse Lane, Lot #28 / KTKM REALTY TRUST
This is a continuation of the 8:00pm Hearing. Present was Michael Rafferty of KTKM Realty Trust and Normand Gamache of Guerriere & Halnon. Mr. Gamache said that a boulder line is not acceptable but shrubs and trees similar to arborvitae are. Ms. Van Roo agrees trees or shrubs are acceptable along the limit of construction. Ms. Sharkey said to sequence this planting when they landscape within the buffer zone. A Motion was made by Ms. Van Roo to close the Public Hearing and issue an Amended Order of Conditions, seconded by Ms. Sharkey. Vote: Unanimous.

8:30 PM (NOI: DEP #143-0861) PUBLIC HEARING – 15 Cross Street / GUARANTEED BUILDERS & DEVELOPERS
Ms. Sharkey recused herself. There was discussion about recusing yourself and rule of necessity. Present on behalf of the Applicant was William Pybas of Guaranteed Builders & Developers. The proposed work consists of the installation of an above ground swimming pool and the construction of a two-car garage within the existing lawn with associated site work. The Commission will do a site walk. A Motion was made by Ms. Van Roo to continue the Public Hearing on 9/3/13 at 7:15pm, seconded by Mr. Greco. Vote: Unanimous.

At 8:45pm, a Motion was made by Ms. Van Roo to adjourn the meeting, seconded by Ms. Sharkey. Vote: Unanimous.
