CONSERVATION COMMISSION MEETING MINUTES
MONDAY, OCTOBER 7, 2013

The meeting was called to order at 7:00pm.

ATTENDANCE
Present: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo (Member), Jeremy Manning (Member) and Stephen Zisk (Conservation Agent). Absent: Michael Greco (Member) and Maria Lajoie (Administrative Secretary).

7:00 PM (NOI: DEP #143-0863) PUBLIC HEARING CONTINUED – 149 Maple Street / WEBSTER VENTURES, INC.
Present was Michael Yerka and Margaret Bacon of Civil Site Engineering. A site walk was done. As discussed, a revised plan was submitted dated 9/23/13 adding plantings along the edge of the slope embanking and shrubs by the house in the buffer zone area. A Motion was made by Ms. Van Roo to close the Public Hearing and issue an Order of Conditions, seconded by Ms. Sharkey. Vote: Unanimous.

7:15 PM (RDA) PUBLIC MEETING – 177 Wallis Road / Van Dyke, Harriet
Present was the Applicant Harriet Van Dyke and her friend Carol Gogolinski. Ms. Van Dyke is requesting permission to remove a tree that hangs over the water’s edge. Ms. Gogolinski said that if the tree were to fall over it could damage the wall and also said that the top of the tree broke off along with limbs over time and the bark is peeling off as well. Mr. Zisk showed pictures and Ms. Brown said that the tree limbs may fall on kids or adults that are swimming in that area. The stump will not be removed. Ms. Van Roo said that her only concern was that invertebrates and fish need shade and if there is shade nearby she has no issue. Ms. Gogolinski said that there are enough shade trees along the water’s edge. Ms. Gogolinski said that Ms. Van Dyke also wants to add an extension measuring 10-feet to 12-feet long and 4-feet wide to her existing removable aluminum dock and that the length and width is the same as other docks on the water. The Commission did not have an issue with this request. A Motion was made by Ms. Van Roo to close the Public Meeting and issue a Negative Determination of Applicability, seconded by Ms. Sharkey. Vote: Unanimous.

DISCUSSION:
1. Complaint: Jason Olivieri, 5 Pinnacle Way. Present were neighbors Cameron & Margia Benjamin of 2 Pinnacle Way. Mr. Olivieri stated that his neighbor at 2 Pinnacle Way did earth removal in prior years that went into the conservation area. Mr. Zisk said that this area is a conservation restriction that was given to the town and Mr. Zisk showed pictures of the area where work was done approximately 4 to 5-feet over the line. The Benjamin’s said this was done 6

years ago and their yard slopes and said they went by the markers that were in place. The Benjamin’s also said that Mr. Olivieri hired an engineering company to survey his property. Mr. Zisk said that the vegetation has grown back in the easement now. Ms. Van Roo sees no impact to the wetlands and told the Benjamin’s to let the plant life continue to grow. The Commission agreed and asked Mr. Zisk to send a letter to Mr. Olivieri stating that there shall be no further impact to the restriction area and the area that had been altered shall be left alone.
2. Negative Determination of Applicability: Highway Department, South Street, Davis Street, Northeast Main Street, West Street, Riedell Road & Martin Road. The Commission signed this Determination.
3. Robar, 89 & 91 Chestnut Street: Eliminate Performance Bonds for Wetland Replication and Shared Driveway Culverts. The Commission received a letter from Michael Yerka of Civil Site Engineering dated 9/24/13 requesting that the above performance bonds be eliminated for Timothy Robar, owner of the property. Mr. Yerka said that the owner has not paved the driveway yet but the shrubs and maple trees were planted last year and are growing. The Commission did a site walk on 9/21/13 and found that both have been constructed and functioning as designed. Ms. Van Roo said usually the Commission will check wetland crossings and replications every two years. Mr. Yerka said unless it is 75% completed with everything growing and has satisfied the conditions. A Motion was made by Ms. Van Roo to release the bonds for the wetland crossing and replication area, seconded by Mr. Manning. Vote: Unanimous.
4. Lisa Cellucci, 122 Walnut Street. Mr. Yerka said that Mrs. Cellucci is requesting a Certificate of Compliance. Plantings were done in late 2010. Mr. Zisk showed pictures of the property. Ms. Van Roo asked Mr. Yerka to provide the Commission with a planting report and add more plantings on the upside of the property. Mr. Zisk said that the work is 75% complete.
5. Request for a Certificate of Compliance: Stephen Sheldon, 139 Perry Street. (DEP #143-0816). The Commission did a final site walk on 9/21/13 and had no issues with the driveway. A Motion was made by Ms. Sharkey to issue a Certificate of Compliance, seconded by Ms. Van Roo. Vote: Unanimous.

2. Meeting Minutes: 8/5/13. A Motion was made by Ms. Sharkey to approve the Meeting Minutes of August 5, 2013, as written, seconded by Ms. Van Roo. Vote: Unanimous.
3. Vouchers. Mowing of Manchaug Street conservation land & MACC Annual Dues.
4. Meeting Minutes: 9/16/13. A Motion was made by Ms. Sharkey to approve the Meeting Minutes of September 16, 2013, as written, seconded by Ms. Van Roo. Vote: Unanimous.

ADJOURNMENT
At 7:46pm, a Motion was made by Ms. Van Roo to adjourn the meeting, seconded by Ms. Sharkey. Vote: Unanimous.
