CONSERVATION COMMISSION MEETING MINUTES
MONDAY, DECEMBER 1, 2014

A meeting of the Conservation Commission was held on Monday, December 1, 2014. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT: Dwight Bristowe (Resigned), Jeremy Manning (Unexcused)

1. 7:05 PM (NOI-DEP #143-0) PUBLIC HEARING: Depot Street, Lot #3/HAAGSMA, JAMES.
Byron Andrews of Andrews Survey & Engineering joined the meeting to present the revised plan, dated today. Ms. Brown opened the public hearing. Mr. Haagsma wants to construct a 24’ x 42’ home with a 12’ x 12’ deck. They are able to place the house within the zoning setbacks and outside the 50’ wetland boundary. Some of the work will be between the 25’ and 50’ wetland boundary. Some trees will be removed. They added an erosion control barrier to the legend.
They don’t anticipate any trees being removed in order to put in the foundation drain. It was unclear if they are removing or saving large trees. Mr. Andrews stated that trees smaller than 8” are not on the plan.
The applicant is planning two driveways. A large stockpile area was shown.
The width of the excavation for the trench will be about the width of an excavator bucket. It will be covered, loamed and seeded after installation. They do not intend to do any construction in the winter.
Ms. Van Roo made a motion to close the public hearing and issue the Order of Conditions for (NOI-DEP #143-0?) Depot Street, Lot #3, James Haagsma. Ms. Sharkey seconded the motion. Vote: Unanimous.

DISCUSSION:
1. North Village (40B Project), located off North Street. Edwin Taipale and Tim Barlow were present. Mr. Zisk stated that he got an email from Atty. Talerman today. Ms. Brown has an issue with “Occupancy Permit/Unit”. She would rather see “No Building Permit per unit.” She would like to see the crossing and replication completed to the Commission’s satisfaction before a Building Permit can be issued. Ms. Brown would need to do the sign-off as Mr. Zisk is recusing himself from the project.
Mr. Barlow stated that the project is a condominium project on a private road. The language is the same as is in the Comp Permit. The Building Inspector is not requiring a road to be constructed to the unit. They will construct a private roadway up to the units. There will be 124 duplex units, which means 62 buildings built in four phases over six years.
The Commission took time to read through the materials received today.
Art Allen of Eco Tech will be hired by the applicant to monitor the whole project. If the Commission is not satisfied, they may hire someone to provide a second opinion.
Ms. Van Roo would like to change “stabilization of the wetland replication area” to “successful establishment of the wetland replication area” under “C”. Ms. Sharkey is not happy with “partial release of the covenant”. A discussion was held with Mr. Barlow and Mr. Taipale regarding when the release would be issued for the wetland replication.
Mr. Barlow wants to request occupancy when the whole infrastructure for the double barrel road is 100% complete, except for the final overlay. That would all be done at the beginning of the project. The replication will be done by March 1, 2015. In parallel, they would start constructing the first units.
Ms. Sharkey wants it outlined in the covenant that the Commission is protected to ensure everything is done properly. Mr. Taipale explained that all the work on the crossing will be done by the time the first Occupancy Permit is issued. If there are any remaining issues, there are another 123 units that can be held.
Ms. Brown would like to have Adelle Reynolds’ input on the document. She would like to know if Ms. Reynolds can legally withhold an Occupancy Permit until the Conservation Commission signs off on it. Does Ms. Reynolds have a procedure in place for flagging the Conservation Commission when an Occupancy Permit is requested? Ms. Van Roo would like an email from Town Counsel stating that units cannot be sold without an Occupancy Permit at the time of sale.
Mr. Barlow stated that in another town where he is working, he has a form that needs to be signed by the Conservation Commission before he can get an Occupancy Permit.
The builder is planning to start clearing three acres outside of the wetland area starting January 15, 2015.
The Commission would like Atty. Talerman at the next meeting.
2. 436 Northeast Main Street Solar Project: Fence. Mr. Zisk stated that the applicant is cutting the bottom of the fence. He visited the site a few weeks ago right before Thanksgiving. The Commission asked that Mr. Zisk take some photographs.
3. Amadeus Finlay: Prospective Member of the Commission. Mr. Finlay approached the Town Clerk to ask how he could help the Town environmentally. Ms. Brown contacted him and asked him to come tonight’s meeting. He did not arrive.
4. Request for Certificate of Compliance: David & Jennifer Chase, 300 Yew Street. Mr. Zisk presented a video of the site. The house was sold. The lawyer for the new owner is asking for the Certificate of Compliance. There is no certified request from an engineer stating that the requirements of the Order have been met, substantially. They need to use the form from the DEP website. Mr. Zisk will get a copy of the septic As-Built for the next meeting. It looks as though they did not follow Limit of Lawn.
5. Request for Project Review/Special Permit & Modification of a Subdivision Plan (81W): Louis Tusino, Cardinal Drive. Ms. Sharkey recused herself. The request was not complete. Mr. Zisk does not believe this project has any conservation issues. The Conservation Commission did not see any issues with the project.
6. Request for Project Review/Scenic Road Permit: Diana Dube, 69 Oak Street. Ms. Sharkey rejoined the meeting. A site walk was done. Mr. Zisk stated that nothing has been filed. He contacted them and let them know that he has not received information from them. Mr. Zisk will check to see if the stockpiles have been stabilized. The entire property is within the 100’ wetlands buffer on both sides. Mr. Zisk will send the applicant a Violation Notice, ask them to file with the Conservation Commission and be present for the next meeting.
7. Request for Project Review/Site Plan Review: Gilboa Properties, 120 Gilboa Street. Mr. Zisk does not believe this project has any conservation issues. The Conservation Commission had no comment.

Ms. Van Roo made a motion to approve the October 20, 2014 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Sharkey made a motion to approve the November 3, 2014 Conservation Commission meeting minutes as amended. Ms. Van Roo seconded the motion. Vote: Unanimous.
Upon reviewing the minutes, the Commission asked Mr. Zisk to follow up on the following: has the fine been paid for 169 Davis Street and ask the Highway Dept. about where they deposit snow when they are plowing Lindbergh Avenue.

OPEN SESSION:
Ms. Brown received a resignation from Dwight Bristowe.
Regarding field mowing, all mowing of conservation fields must happen after September 15th. Mr. Zisk said that Charlie French’s field never got mowed because the tractor broke down.

SIGN:
