CONSERVATION COMMISSION MEETING MINUTES
TUESDAY, MAY 6, 2014

The meeting was called to order at 7:12pm.

ATTENDANCE
Present: Linda Brown (Chairman), Brandi Van Roo (Member), Jeremy Manning (Member), Stephen Zisk (Conservation Agent) and Maria Lajoie (Administrative Secretary).
Absent: Tracy Sharkey (Vice Chairman) and Michael Greco (Member).

7:00 PM (AMENDED NOI: #143-0844) PUBLIC HEARING CONTINUED – 455 Northwest Main Street / EXXONMOBIL PIPELINE COMPANY
Mr. Runstrom is running late and asked if the Commission could postpone the Hearing until later. A Motion was made by Ms. Van Roo to continue the Public Hearing at 7:30pm, seconded by Mr. Manning. Vote: Unanimous.

Discussion:
1. Schedule Site Walks: Requests for Certificates of Compliance: Raymond Lafave, 43 Southeast Main Street and Timothy Riffle, 187 Maple Street. The Commission will do site walks on 5/7/14 beginning at 5:15pm.
2. Request for Extension Permit: Jackson Song, 209 South Street. A Motion was made by Mr. Manning to issue an Extension Permit ending 5/21/2016, seconded by Ms. Van Roo. Vote: Unanimous.
3. 41 Pine Street: Status. Mr. Zisk said that Civil Site Engineering will be drawing up a plan showing bounds and will pin the corners at the end and front of the property. The quote to do the plan is $3,300 but need a quote for staking property. A Motion was made by Ms. Van Roo to approve the estimate of $3300, seconded by Mr. Manning. Vote: Unanimous. The Commission is waiting for the owner to go through the Chapter 61A process and Mr. Zisk will speak to Mr. Fred Pollard.
4. Robert Josey, 36 Ridge Trail: Status. Mr. Zisk and Ms. Sharkey measured the property again and found that the site is outside the Commission’s jurisdiction.
5. Minutes: 4/7. Will be placed on the next agenda.

7:40 PM (AMENDED NOI: #143-0844) PUBLIC HEARING CONTINUED – 455 Northwest Main Street / EXXONMOBIL PIPELINE COMPANY
Mr. Eric Runstrom of Roux Associates present on behalf of ExxonMobil. Mr. Zisk said that due to access issues he has not been able to do a site walk and needs an ExxonMobil representative to go with him. Mr. Runstrom said that there are two men that live in town (Jerry Colonero and Jim Pineo) and he will make them available. Ms. Van Roo suggested that a condition be added in the Order of Conditions stating that a representative be made available when a Commission Member or their Agent needs to access the property. A Motion was made by Ms. Van Roo to close the Public Hearing and issue an Order of Conditions with the condition that Mr. Zisk receives a timely escort within 48 hours in advance along the ExxonMobil Pipeline, seconded by Mr. Manning. Vote: Unanimous.
On another matter, Mr. Runstrom said that Roux Associates is in the process of permitting a representative for Mr. Zisk because ExxonMobil needs to get back in the resource areas at their site on Davis Street. Mr. Runstrom said that he will be filing east of the Tennessee Gas Line. There is a temporary stream crossing and he is looking for what the Commission wants ExxonMobil to provide. Mr. Zisk said that ExxonMobil would be working in the wetland and will be disturbing and replacing and this work will be 500-feet and under the Local Bylaw.

At 7:55pm, a Motion was made by Ms. Van Roo to adjourn the meeting, seconded by Mr. Manning. Vote: Unanimous.
