CONSERVATION COMMISSION MEETING MINUTES
MONDAY, MAY 19, 2014

The meeting was called to order at 7:00pm.

ATTENDANCE
Present: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco (Member), Jeremy Manning (Member), Stephen Zisk (Conservation Agent) and Maria Lajoie (Administrative Secretary).
Absent: Brandi Van Roo (Member).

7:00 PM (NOI-DEP #143-0870) PUBLIC HEARING – 29 Colonial Road / BERUBE, JOSHUA
Seth Lajoie of Seth L. Lajoie Associates contacted Ms. Lajoie to say he would be late and asked that the Hearing be continued until later this evening. A Motion was made by Ms. Sharkey to continue the Public Hearing at 7:30pm, seconded by Mr. Greco. Vote: Unanimous.

DISCUSSION:
1. An Invoice was signed.
2. Request for a Certificate of Compliance: Timothy Riffle, 187 Maple Street. A site walk will be done before the next meeting.
3. Request for a Certificate of Compliance: Raymond Lafave, 43 Southeast Main Street. A site walk will be done before the next meeting.

7:15 PM (NOI-DEP #143-0871) PUBLIC HEARING – 12 Shady Lane / ADAM, DAVID
Present on behalf of the Applicant was Margaret Bacon of Civil Site Engineering. Ms. Bacon said that a DEP Number has not been issued yet and she has not received any information from the Natural Heritage & Endangered Species Program. The project consists of a proposed septic system repair within the 100-foot buffer zone of Whitin Reservoir for a 3-bedroom single family home. Two existing systems are being eliminated and the proposed system is 40-feet to the closest grade line. The system is 55-feet from the Whitin Reservoir. Ms. Bacon said that two trees may have to be removed and she will tag them for the Commission. A site walk is scheduled for 5/28/14 @ 5:15pm. A Motion was made by Ms. Sharkey to continue the Public Hearing on Monday, June 2, 2014 @ 7:00pm, seconded by Mr. Manning. Vote: Unanimous.

7:30 PM (RDA) PUBLIC MEETING – Douglas State Forest-Wallum Lake Road / DEPARTMENT OF CONSERVATION & RECREATION
Present was Cary VandenAkker on behalf of DCR. Mr. VandenAkker is requesting permission to perform roadway improvement and associated utility work related to the installation of an Automated Pay Station (2’ x 2’ x 5’) at the Douglas State Forest.
Mr. VandenAkker said they are adding a third lane by taking 10 trees down for the electrical wires. 300-feet of pavement will be removed and silt fence will be placed. The road tilts to the right and grades can’t be changed. Ms. Sharkey asked what percentage uses the fast lane and Mr. VandenAkker said it was a high percentage. Ms. Sharkey asked if there were any car jams and Mr. VandenAkker said this is new territory for him so he doesn’t know. Ms. Sharkey asked how they keep a count of the people and VandenAkker said he’s not sure how the pay station works. Ms. Brown and Mr. Zisk want to see straw wattles placed and not silt fence and Ms. Brown also said that Mr. Zisk is to be notified prior to the commencement of any work. A Motion was made by Ms. Sharkey to close the Public Meeting and issue a Negative Determination of Applicability with the above two conditions, seconded by Mr. Greco. Vote: Unanimous.

7:34 PM (NOI-DEP #143-0870) PUBLIC HEARING – 29 Colonial Road / BERUBE, JOSHUA
Mr. Zisk recused himself from this Hearing. Present was Seth Lajoie of Seth L. Lajoie Associates. The proposed project is the construction of an attached garage to the single family dwelling with associated excavation, final grading and landscaping. The man made pond is within 100-feet from the buffer zone and 50-feet from the wetland. Mr. Lajoie said that straw wattles will be used and the Commission agreed that the excavation must be within the straw wattles. A site walk was scheduled on 5/28/14 @ 5:45pm. A Motion was made by Ms. Sharkey to continue the Public Hearing on June 2, 2014, @ 7:15pm, seconded by Mr. Greco. Vote: Unanimous.

DISCUSSION:
1. Signed: Negative Determination of Applicability: DCR, Douglas State Forest
2. 41 Pine Street. Mr. Zisk said that Civil Site Engineering gave a quote to submit a plan for the Pine Street conservation land. The Commission would like to see 1 to 2 markers and a rebar at each corner of the property. Mr. Zisk said he is waiting to hear from Mr. Yerka.
3. 79 Mumford Street. The Commission scheduled a site walk for 5/28/14 @ 6:15pm.
4. Harold Davis, 80 Orange Street. Mr. Zisk said he would go look at the property this week-end. Ms. Lajoie will call Mr. Davis and let him know.

ADJOURNMENT
At 8:02pm, a Motion was made by Ms. Sharkey to adjourn the meeting, seconded by Mr. Manning. Vote: Unanimous.
