CONSERVATION COMMISSION MEETING MINUTES
MONDAY, AUGUST 4, 2014

A meeting of the Conservation Commission was held on Monday, August 4, 2014. Ms. Brown called the meeting to order at 7:04 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman - arrived at 7:13 PM), Michael Greco, Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT: Jeremy Manning (unexcused)

1. 7:04 PM (NOI-DEP #143-0875) PUBLIC HEARING: Colonial Road, Lot #10/DAPRATO, ALFRED.
Ms. Brown opened the public hearing. Mr. Zisk recused himself. Seth Lajoie joined the meeting to present the applicant’s plans to build a single-family home. The entire site is within the 100’ wetlands buffer zone. Several tons of fill will need to be brought in. Ms. Van Roo would like to see some deer resistant, non-invasive plantings to keep the lawn from creeping towards the wetlands. Ms. Sharkey would like to see the location of the drainage pipe.
Mr. Lajoie would suggest not stockpiling on the site. He gave the Commission a copy of the plans. He has flagged the wetlands and will stake out the location of the house. A site walk was scheduled for August 11, 2014 at 5:15 PM.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0875, Colonial Road, Lot #10/Daprato, Alfred to Tuesday, September 2, 2014 at 7:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
Mr. Lajoie left the meeting. Mr. Zisk rejoined the meeting.

2. 7: 32 PM (NOI-DEP #143-0872) PUBLIC HEARING: 34 Peters Cove Road/WEBB, CARRIE.
Ms. Brown opened the public hearing. Mike Weaver of Guerriere and Halnon joined the meeting. He stated that in 2007, the previous owner received approval to raze the existing structure, construct a larger structure, and install a well and a septic system. The only thing that was done was the well. The property has been sold. The new owners want to keep the current building. The new owners are looking to put in a septic system outside the 50’ buffer zone. At the last meeting, Mr. Weaver requested the Certificate of Compliance on the original permit. Mr. Zisk’s original comments have been addressed. Mr. Weaver presented his clearing plan. Ms. Sharkey suggested installing erosion control beforehand and have Mr. Zisk inspect it.
A discussion was held regarding issuing a Certificate of Compliance on the old Order of Conditions (DEP #143-780). Mr. Zisk will consult Town Counsel.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0872, 34 Peters Cove Road/Webb, Carrie to September 2, 2014 at 7:15 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
Mr. Weaver left the meeting.

DISCUSSION:
1. Potter Street property: Bonding. Suzanne Gagnon joined the meeting. Her insurance agent has asked for a narrative on Town letterhead be added to the bond document. Ms. Brown read the narrative. A discussion was held. Ms. Van Roo suggested Ms. Gagnon ask the agent specifically what in the narrative in the Order of Conditions is not satisfactory. Ms. Gagnon will be on the agenda for the September 2, 2014 meeting. She left the meeting.
2. Stone Gates Estates: Mailbox Unit Location. The unit has been relocated and installed. There was no further discussion.
3. Russell Gray, 205 West Street: Update. Mr. Zisk stated that the machine is out and has been fixed.
4. Request for a Certificate of Compliance: Theresa (Glidden) Arpin, 362 Southwest Main Street: A discussion was held. It was decided to not allow hand-written As-Builts from this moment on.
Ms. Van Roo made a motion to issue a Certificate of Compliance for Theresa (Glidden) Arpin, 362 Southwest Main Street. Ms. Sharkey seconded the motion. Vote: Unanimous.
5. Request for a Certificate of Compliance: Carrie Webb (Outlaw Two, LLC), 34 Peters Cove Road, DEP #143-780. See Item #2 at the 7:32 Public Hearing. A discussion was held. Mr. Zisk will consult Town Counsel.

OPEN SESSION:
Town of Douglas, School Building Project: Davis Street, Placement of Storage Sheds. Mr. Zisk received an email today. Ms. Brown presented the two options for the placement of the sheds. The setback issue has not been solved. The Commission supported Option 2 – placement of both sheds along the long jump.
The Douglas School Project Landscape and Management Plan was discussed.

MINUTES: April 7, May 6, May 19, June 2, June 16, and July 14, 2014.
Ms. Van Roo made a motion to approve the minutes of the April 7, 2014 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to approve the minutes of the May 6, 2014 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Sharkey abstained.
Approval of the minutes of the May 19, 2014 Conservation Commission meeting minutes was deferred to the next meeting.
Ms. Sharkey made a motion to approve the minutes of the June 2, 2014 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Aye -3, Ms. Van Roo abstained.
Approval of the minutes of the June 16, 2014 Conservation Commission meeting minutes was deferred to the next meeting.
Ms. Sharkey made a motion to approve the minutes of the July 14, 2014 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Aye 3, Ms. Van Roo abstained.

REORGANIZATION
Ms. Sharkey nominated Linda Brown as Chairman of the Conservation Commission. Ms. Van Roo seconded the motion. Vote: Unanimous.
Ms. Brown nominated Tracy Sharkey as Vice Chairman of the Conservation Commission. Ms. Van Roo seconded the motion. Vote: Unanimous.

OPEN SESSION (Cont.):
Ms. Brown stated that Jeremy Manning has missed three meetings in a row.
The Attorney General recently approved a Town of Douglas bylaw, Article 2, Section 4 regarding the Non-Attendance of Members of Appointed Boards and Committees. It was the consensus of the Committee to review the bylaws and try to contact Mr. Manning before any action is taken.
Ms. Sharkey asked the members to think about people they know who may want to serve on the Conservation Commission. Ms. Brown has asked Ms. Lajoie to email Mr. Manning.
Regarding a complaint of an alleged right-of-way violation at 169 Davis Street discussed at the last meeting, Mr. Zisk visited the site. Exxon Mobile has an easement on this landowner’s property. The landowner was upset. Mr. Zisk’s recommendation is to go out with a representative of Exxon and Eric Runstrom on Monday and look to see if there are any violations. Ms. Sharkey suggested that the landowner be sent a letter requesting that he come to the September 2, 2014 meeting at 7:30 PM. Mr. Zisk will send the letter.

Ms. Sharkey made a motion to adjourn the meeting at 9:05 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
