CONSERVATION COMMISSION MEETING MINUTES
TUESDAY, SEPTEMBER 2, 2014

A meeting of the Conservation Commission was held on Tuesday, September 2, 2014. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT: Jeremy Manning (unexcused)

1. 7:05 PM (NOI-DEP #143-0875) PUBLIC HEARING CONTINUED: Colonial Road, Lot #10/DAPRATO, ALFRED.
Mr. Zisk recused himself. Ms. Brown continued the public hearing. Seth Lajoie joined the meeting. He stated that he did not have the lot staked out when the site walk was attempted. The lot is now staked out. It was decided to do the site walk next Tuesday, September 9, 2014 at 5:15 PM.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0875, Colonial Road, Lot #10/Daprato, Alfred to Monday, September 15, 2014 at 7:45 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
Mr. Lajoie left the meeting.

OPEN SESSION:
Mr. Zisk rejoined the meeting. Amy Nadeau, 56 Cedar Street, joined the meeting. She stated that she owns a strip of land the entire strip of Shore Road. A gentleman on the lake is excavating to put in a septic and expand his house. He has crossed over onto the strip. He had asked if he could widen the road. Ms. Nadeau told him “No thank you.” Ms. Nadeau stated that he is “doing it anyway.” This weekend he excavated her property. He cut trees, removed boulders, sprayed Round-Up, etc.
Mr. Zisk stated that he spoke with Mr. Miller when he started working and told him to stay within the Order of Conditions. He is putting in a septic. Mr. Zisk checks on it once a week. He was there Saturday, 11:30 AM and everything looked fine. Ms. Nadeau said the excavation occurred on Sunday. Mr. Zisk went out there on Monday and took some pictures. Mr. Zisk told Mr. Miller to put some hay bales around the culvert. Mr. Zisk feels this issue may be within the Conservation Commission’s jurisdiction for the wetlands. The other issues may be within the Highway Dept.’s jurisdiction.
Ms. Nadeau presented photographs. Ms. Sharkey suggested sending a letter to Mr. Miller. Ms. Brown does not feel this is within the Conservation Commission’s jurisdiction. It is not clear whether or not an infraction has occurred within 100 feet of a wetland.
It was decided to continue the discussion after the scheduled public hearings.

2. 7: 22 PM (NOI-DEP #143-0872) PUBLIC HEARING CONTINUED: 34 Peters Cove Road/WEBB, CARRIE.
Ms. Brown continued the public hearing. Mike Weaver of Guerriere and Halnon joined the meeting. Mr. Zisk presented information from Town Counsel. Ms. Van Roo felt that the comments are vague. A discussion was held. Mr. Zisk felt that the items that are complete can be checked on the Order of Conditions and the Order can be closed out. Ms. Brown stated that they could check off #1 and #2 with the explanation that only the well has been completed and a separate DEP number has been filed for the rest of the work. All other work is now invalid. Ms. Sharkey asked Mr. Zisk to double check the procedure.
Ms. Van Roo made a motion to issue a partial Certificate of Compliance and a complete Certificate of Compliance for NOI-DEP #143-0872, 34 Peters Cove Road/Webb, Carrie. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to close the public hearing, NOI-DEP #143-0872, 34 Peters Cove Road/Webb, Carrie and issue Orders of Conditions. Ms. Sharkey seconded the motion. Vote: Unanimous.
Mr. Weaver left the meeting.

3. 7:37 PM (NOI-DEP #143-0876) PUBLIC HEARING: 44 & 47 Eagle Drive/EXXON MOBILE PIPELINE COMPANY
Ms. Brown opened the public hearing. Eric Runstrom from Roux Associates, Inc. joined the meeting on behalf of the applicant. Exxon Mobile has identified anomalies at two locations in a condominium lot. They need to trench at those locations for maintenance of an underground pipeline. One location is in the buffer. The plan is for a one-day dig to excavate a small area, approximately 15’ x 10’ x 5’ at each location to inspect and potentially wrap the pipes with a polymer. The work should be completed by the end of November. There is no standing water in the area. Erosion controls were discussed.
Ms. Sharkey made a motion to close the public hearing NOI-DEP #143-0876, 44 & 47 Eagle Drive/Exxon Mobile Pipeline Company and issue the Order of Conditions with a condition that the proposed work, per DEP comment, should occur during dry conditions and surface vegetation soil should be stockpiled separately for restoration of the area. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Request for an Extension Permit for Orders of Conditions: Webster Road (Lots 1 & 2). Normand Gamache of Guerriere and Halnon joined the meeting. He stated that an Order of Conditions was issued on November 6, 2006. It was extended to November 6, 2010. It is due to expire this November. They are ready to start the work and they are asking for the two one-year extensions that they are eligible for.
Ms. Sharkey made a motion to grant the request for Extension Permit for Orders of Conditions, Webster Road Lots 1 & 2, for two years. Ms. Van Roo seconded the motion. Vote: Unanimous.
Mr. Gamache presented a drawing of the lots. He stated that Dale would like to put a garage under on Lot 1. A turnaround would need to be created. A post and rail fence would be installed around the bump-out for a visible boundary. They are volunteering a rain garden on the side of the house. Ms. Sharkey would like to see the details of the garden. Ms. Van Roo suggested vegetation on the slope and under the fence to help with salt and oil from the driveway. Mr. Gamache will revise the plan
Mr. Zisk and Mr. Gamache spoke about a site walk before the public hearing for Southeast Main Street. Mr. Zisk mentioned his concern about some pipes in the bottom culvert obstructing the wetland corridor for animals.
2. Continuation of Open Session item above: Amy Nadeau rejoined the meeting. She has not measured the 50’ road because she stated that she was never told it was 50’. Ms. Sharkey stated that the road is laid out 50’ wide with a 10’ strip on the side. Ms. Nadeau does not know if her property has been surveyed. Mr. Zisk suggested she be sure where her property lines are.
Mr. Zisk will gather more information for the next meeting. He stated that the Conservation Commission will only look at the work the neighbor has done in relation to the wetlands. Safety issues are not under the jurisdiction of this board. This issue will be placed on the September 15, 2014 meeting agenda.
Ms. Nadeau left the meeting.
3. Violation Notice: Jean Chamberlain, 169 Davis Street. No green cards have been received. There was no discussion. This item will be placed on the next agenda.
4. Potter Street Property: Bonding. Mr. Zisk stated that the bond has been sent in. Scott Jordan was out there to look at the replication process. The work may be finished by the next meeting.
5. Request for Certificate of Compliance: Douglas Country Homes, LLC, 124 Walnut Street (DEP #143-0567). Mr. Zisk needs to do a site walk. It will be done on Tuesday, September 9, 2014. Mr. Zisk will email a map to the board.

OPEN SESSION (Cont.):
Bosma Solar fence issue: Ms. Brown stated that the fence was placed right on the ground. The issue is being disputed. The Conservation Commission had requested that the fence be six inches off the ground. At first, the plan had stated “…a maximum of two inches…”, it was changed to “…a minimum of four inches…” They said they would have it fixed. That was three weeks ago. Mr. Zisk will go out and look at it. The Conservation Commission instructed Mr. Zisk to tell them they have a month to fix it.

Ms. Van Roo made a motion to adjourn the meeting at 8:14 PM. Mr. Greco seconded the motion. Vote: Unanimous.
