CONSERVATION COMMISSION MEETING MINUTES
MONDAY, SEPTEMBER 15, 2014

A meeting of the Conservation Commission was held on Monday, September 15, 2014. Ms. Brown called the meeting to order at 7:08 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Brandi Van Roo (arrived at 7:12 PM), Stephen Zisk (Conservation Agent)
ABSENT: Jeremy Manning (unexcused)

1. 7: 08 PM (NOI-DEP #143-0877) PUBLIC HEARING: 12 Bigelow Road/L&B REALTY.
Ms. Brown opened the public hearing. Paul Hutnak of Andrews Survey and Engineering joined the meeting. He stated that the lot also fronts on Manchaug Pond. They are planning to replace the existing cesspool and put in a repair septic system 75’ to 80’ off the water. It is a pump system. He showed the 100’ well radii for the abutting wells. The plan has been approved by the Board of Health. He showed the erosion control barriers. He explained their use of the poly barrier.
Ms. Sharkey made a motion to close the public hearing and issue the Order of Conditions for NOI-DEP #143-0877, 12 Bigelow Road. Ms. Van Roo seconded the motion. Vote: Unanimous.

2. 7: 17 PM (NOI-DEP #143-0879) PUBLIC HEARING: 145 Southeast Main Street/MORRIS, SCOTT and MITCHELL, KIMBERLY.
Ms. Brown opened the public hearing. Normand Gamache of Guerriere and Halnon joined the meeting. Mr. Morris and Ms. Mitchell were present. Mr. Gamache stated that the site is 34.6 acres. He explained that they are proposing to extend an existing shared driveway 750’ to the construction site. They have designed a pull off because the driveway is only 10’ wide.
The proposed house is within the 100’ buffer because there are wetlands on both sides. Mr. Gamache highlighted all the buffer zones. The septic system is 53’ off the edge the wetlands. They do not yet have approval from the Board of Health. Mr. Gamache showed the 1900 sq. ft. replication area. Mr. Gamache has not yet had a chance to review all of Mr. Zisk’s comments.
Mr. Gamache filed with MESA on August 28, 2014 but has not yet heard back from them regarding the crossing. Mr. Zisk was concerned about whether or not the crossing is a brook. A wetlands scientist has not yet made that determination. If it is a stream, the pipes need to be big enough to accommodate wildlife.
Mr. Zisk asked that the information for the bonding for both the crossing and the replication be added to the plan. Mr. Zisk asked that flags be placed at the corners of the house. Mr. Gamache will add a note that the electrical wires will be underground.
Mr. Gamache stated that the driveway runoff will not be directly into the wetland. He showed where they are planning to place the erosion controls. Mr. Gamache thought there would be two areas for stockpiling. Location for the stockpiles was discussed.
A site walk was planned for Thursday, September 18, 2014 at 5:15 PM. The Commission asked that the following be staked: the centerline of the road from the street, the grade, the house corners, the replication area and the septic.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0879, 145 Southeast Main Street, Morris, Scott and Mitchell, Kimberly to October 6, 2014 at 7:30 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
Mr. Gamache will have someone look at the brook in question. Mr. Gamache asked that a condition to the order be added that states that a bonding estimate for the driveway crossing be presented to the Commission prior to the start of construction. Mr. Zisk explained that that is usually the case. Mr. Zisk explained the bonding procedure to the applicants. There would be two bonds, one for the crossing and one for the replication. Once the crossing is complete, that bond may be able to be reduced.
Mr. Gamache left the meeting.

3. 7: 55 PM (NOI-DEP #143-0878) PUBLIC HEARING: 16 Shady Lane/CNOSSEN, MICHAEL.
Ms. Brown opened the public hearing. Paul Hutnak of Andrew Survey and Engineering joined the meeting. He added the 50’ and 100’ buffer zones to the plan. They are proposing an addition to the house. They are proposing to move the existing septic system. They are planning to remove two large pine trees for safety reasons.
They will spread excavated material over the septic, and the rest will be taken off site.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for NOI-DEP# 143-0878, 16 Shady Lane, Cnossen, Michael with the condition that a revised plan be submitted with a stockpile area noted. Ms. Van Roo seconded the motion. Vote: Unanimous.
Mr. Hutnak left the meeting.

4. 8:04 PM (NOI-DEP #143-0875) PUBLIC HEARING CONTINUED: Colonial Road, Lot #10/DAPRATO, ALFRED.
Ms. Brown continued the public hearing. Seth Lajoie joined the meeting. There were a few questions that arose from the site walk. Flags were not numbered or dated. Plans for the split-rail fence were not clear. Ms. Brown had a question about how the wetlands were determined. The wetlands forms were found in the packet.
Plantings are needed in front of or under the split-rail fence to serve as a buffer for runoff . No stockpiling is allowed on site.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for NOI-DEP #143-0875, Colonial Road, Lot #10/Daprato with the condition that deer-resistant, non-invasive plantings be added in front of the split-rail fence on the south side of the property. Ms. Sharkey seconded the motion. Vote: Unanimous.
Mr. Lajoie left the meeting.

OPEN SESSION:
The State notified the Commission that the town soccer field is being watered by siphoning from a brook. Mr. Zisk could not see a pump from the road. He asked the responsible party to come to the next meeting. The Commission asked Mr. Zisk to take pictures and shut off the pump.
Shore Road: Mr. Zisk stated that the work is in the wetland. It is unclear who owns the property. Mr. Zisk will send Mr. Miller a Violation Notice and ask him to come to the next meeting.

DISCUSSION:
1. 436 Northeast Main Street Solar Project: Proposed Gates. The applicant did not feel that the fence could be raised because it would sag over time. The Commission was in agreement that turtles would not be able to find an open gate. Mr. Zisk will tell the applicant to come to the next meeting because they are in violation of their Order of Conditions.
2. Request for a Certificate of Compliance: Douglas Country Homes, LLC, 124 Walnut Street (DEP #143-0567). Ms. Sharkey asked Mr. Zisk to send a copy of the plan to the new owners along with the Certificate of Compliance.
Ms. Sharkey made a motion to issue the Certificate of Compliance for Douglas Country Homes, LLC, 124 Walnut Street (DEP #143-0567). Ms. Van Roo seconded the motion. Vote: Unanimous.
3. Application for a new Conservation Commission Member. The Commission had no objections to the applicant and recommended his appointment.
4. Minutes: August 4, 2014. Corrections were made. Approval of the August 4, 2014 Conservation Commission meeting minutes was deferred to the next meeting.

SIGN:
1. The Manchaug Street field was mowed by Ranslow’s Maintenance on August 9, 2014 at a cost of $385. Ms. Van Roo stated that this mowing was done too early. There is a state BMP that specifies a date. Mr. Zisk will check the policy, let them know that the conservation land on Makowski Drive is ready to mow and, going forward, not to mow until they are asked to do so.
2. The Commission signed Ms. Lajoie’s $12 invoice for batteries.
3. Certificate of Compliance: Douglas Country Homes, LLC, 124 Walnut Street (DEP #143-0567).
4. Two-year Extension Permits, Webster Road.
5. Order of Conditions, 34 Peters Cove Road.
6. Special Conditions, 44 & 47 Eagle Drive, Exxon Mobile Pipeline Company.

Ms. Van Roo made a motion to adjourn the meeting at 8:41 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
