PLANNING BOARD MEETING MINUTES
WEDNESDAY, NOVEMBER 12, 2014

A meeting of the Planning Board was held on Wednesday, November 12, 2014. Mr. Marks called the meeting to order at 7:00 PM and announced that the meeting is being recorded and will be available on cable and on the website.

ATTENDANCE:
PRESENT: Ernest Marks (Chairman), Ken Ballou, Mike Greco, Robert Werme, Jr., Michael Zwicker, William Cundiff (Town Engineer),
ABSENT: Eben Chesebrough (Vice Chairman - Excused), Tracy Sharkey (Excused)

7:00 PM ANR PLAN: ELAINE C. KEEVAN (2014-13), 41 PINE STREET
Mike Yerka of Civil Site Engineering joined the meeting and presented the ANR plan. A discussion was held.
Mr. Greco made a motion to endorse the ANR plan, Elaine C. Keevan (2014-13), 41 Pine Street. Mr. Zwicker seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Request for Accessory Apartment Extension: Derek & Cheryl Stienstra, 12 Cook Street. There was no discussion. Mr. Werme made a motion to approve the Accessory Apartment Extension Request for Derek and Cheryl Stienstra, 12 Cook Street. Mr. Ballou seconded the motion. Vote: Unanimous.
2. 2015 Meeting Schedule: The schedule listed two meetings each month. It was decided to wait until a full board was present to vote on the schedule.

MEETING MINUTES: September 23, 2014, October 28, 2014
Approval of the September 23, 2014 Planning Board meeting minutes was deferred to the next meeting.
Mr. Zwicker made a motion to approve the October 28, 2014 Planning Board meeting minutes as presented. Mr. Greco seconded the motion. Vote: Unanimous.

7:15 PM ANR PLAN: LOUIS C. TUSINO, CARDINAL DRIVE
Mr. Cundiff stated that the recent modification to the definitive plan only removed the condition that the property no longer be held as one piece of property . The ANR Plan came in on November 3, 2014 with two submittals.
One submittal was for a Special Permit for a residential compound. Mr. Cundiff explained some of the criteria. The property boundaries are changing, but the only way to change the frontage on the lots is through a Special Permit, as well as an 81W or a full subdivision plan. This Special Permit is scheduled for the next meeting.
Mr. Cundiff read Atty. Jay Talerman’s email regarding this matter. He shared Atty. Talerman’s email with the applicant and explained the process to him on November 6, 2014. Mr. Cundiff asked the applicant for a withdrawal. Since the Board did not get a withdrawal, a vote is needed on the plan submitted. Mr. Cundiff also spoke with the applicant today.
Mr. Zwicker made a motion not to endorse the ANR Plan, Louis C. Tusino, Cardinal Drive as presented due to lack of frontage shown on the plan. Mr. Werme seconded the motion. Vote: Unanimous.

DISCUSSION (CONT.):
3. George B. Kuipers: Violation Notice (69 Oak Street). Mr. Cundiff stated that he received a phone call on October 27, 2014 regarding a stone wall that was being removed. He and John Furno spoke to Mr. Kuipers on site on separate occasions. Mr. Kuipers said that he forgot that Oak Street was a scenic road. Mr. Cundiff gave Mr. Kuipers a copy of the Scenic Road Application Form and told him that he could not do any more work within the Town’s right-of-way, and he would need to get a permit from the Planning Board before he could do any more work. Mr. Cundiff gave Mr. Kuipers a permit application.
On October 30, 2014, Mr. Cundiff received another call that Mr. Kuipers was placing a stone apron for a driveway in the right-of-way in the area where he removed the stone wall. At that time, Mr. Cundiff spoke with Town Counsel and he drew up and sent, by Certified Mail, a Violation Notice. Today, the owner submitted an Application for a Scenic Road Permit. A discussion was held.
George Hendricks, 69 Oak Street stated that he met with the Conservation Commission and they did a site walk and talked about the appropriate course of action. All work ceased and an erosion barrier was put up. If the permit for the opening is approved, they will put material in and re-seed with natural grass. Mr. Cundiff clarified that the Conservation Commission has jurisdiction beyond the Town right-of-way.
Mr. Werme made a motion to levy a $50 fine for a first offense violation of the Scenic Road Bylaw to George B. Kuipers, 26 Smith Hill Way, Douglas, MA. Mr. Zwicker seconded the motion. Vote: Unanimous.
Mr. Hendricks left the meeting.

7:42 PM ADJOURNMENT:
Mr. Zwicker made a motion to adjourn the meeting at 7:42 PM. Mr. Werme seconded the motion. Vote: Unanimous.
