PLANNING BOARD MEETING MINUTES
TUESDAY, SEPTEMBER 23, 2014

A meeting of the Planning Board was held on Tuesday, September 23, 2014. Mr. Marks called the meeting to order at 7:08 PM and announced that the meeting is being recorded and will be available on cable and on the website.

ATTENDANCE:
PRESENT: Ernest Marks (Chairman), Eben Chesebrough (Vice Chairman), Ken Ballou, Mike Greco, William Cundiff (Town Engineer),
ABSENT: Tracy Sharkey, Robert Werme, Jr., Michael Zwicker – All three were Excused

1. 7:08 PM ANR PLAN: ELAINE C. KEEVAN (#2014-10), 41 Pine Street.
Mike Yerka of Civil Site Engineering joined the meeting to present the plan. He stated that they are cutting out ANR lots on Pine Street. They are creating the farmhouse lot and four lots, one of which is a reduced frontage lot. The remaining parcel is approximately 62 acres, with frontage on Southeast Main Street. It is intended for the 60- acre lot to be deeded to the Town. A discussion was held.
Mr. Chesebrough made a motion to endorse the ANR Plan, Elaine C. Keevan (#2014-10), 41 Pine Street which shows Lots 1, 2, 3 and 4 being regular lots and Lot 5 as a Reduced Frontage Lot or Lot Frontage Exemption. Mr. Greco seconded the motion. Vote: Unanimous.

OPEN SESSION:
Mr. Cundiff stated that the Old Grammar School Disposition Committee sent a request to the Board of Selectmen to have Gleason Court laid out as a public way at the Annual Town Meeting.

2. 7:20 PM ANR PLAN: JOEL A. SMITH (#2014-11), 91 Martin Road.
Mike Yerka of Civil Site Engineering remained to present the plan. He stated that he has addressed Mr. Cundiff’s comments.
Mr. Chesebrough made a motion to endorse the ANR Plan, Joel A. Smith (#2014-11) for Lots 3 and 4 located at 91 Martin Road. Mr. Greco seconded the motion. Vote: Unanimous.

3: 7:26 PM ANR PLAN: LAWRENCE G. BACON (#2014-12), 90 Cedar Street.
Mike Yerka of Civil Site Engineering remained to present the plan. He stated that a piece of approximately 7 acres was cut out. There are no limiting access features. Mr. Cundiff saw only one monument on Rte. 16. He asked what other monument is Mr. Yerka relying on to satisfy 250 CMR 6. Mr. Yerka showed the board where the other monument is. Mr. Greco found that the wrong name was entered on page 1, item 3. Mr. Cundiff will correct the error.
Mr. Chesebrough made a motion to endorse the ANR Plan, Lawrence G. Bacon (#2014-12) for two lots, called Lot 1 and Lot 2, at 90 Cedar Street. Mr. Greco seconded the motion. Vote: Unanimous.
Mr. Yerka left the meeting.

DISCUSSION/SIGN:
1. ZBA (Zoning Appeal) Application: Joseph Bylinski, 103 Shore Road. Mr. Cundiff summarized the history of the application. He stated that GBI built a house on a pre-existing, nonconforming lot. It was appealed by an abutter. It was approved by the ZBA and the Town. It was appealed after the ZBA’s approval, and it has been in court for years. The final court action was that the Building Inspector failed to issue a mandate to demolish the building. It is now in front of the ZBA as an appeal to overrule the Building Inspector’s decision to not have it razed.
The Planning Board had no comment on the application.
2. ZBA (Special Permit) Application: Barbara Plays, 27 J P Manning Way. Mr. Ballou stated that the applicant wants to tear down the existing building and put up a new one. A history of J P Manning Way was presented.
The Planning Board did not have any objection to the Special Permit.

MEETING MINUTES: August 12, 2014 & September 10, 2014.
Approval of the above meeting minutes was deferred to the next meeting.

7:49 PM ADJOURNMENT:
Mr. Chesebrough made a motion to adjourn the meeting at 7:49 PM. Mr. Ballou seconded the motion. Vote: Unanimous.
