ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, DECEMBER 3, 2014

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, December 3, 2014. Mr. Heney called the meeting to order at 7:00 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), Pamela Holmes (Vice Chairman), John Bombara, Leonard Demers, Michael Fitzpatrick (Alternate), Sean Holland, and Maria Lajoie (Administrative Secretary)
ABSENT:

(Taping did not begin until after the meeting had already begun.)

7:00 PM ZBA CASE # 2014-11, PUBLIC HEARING CONTINUED: GILBOA PROPERTIES, LLC, 120 Gilboa Street.
Mr. Heney opened the public hearing. Voting on the case will be Mr. Bombara, Mr. Demers, Mr. Heney, Ms. Holmes, and Mr. Holland. Mr. Fitzpatrick will be participating in all the discussions. Dan Dunleavy joined the meeting. Adelle Reynolds, Building Commissioner joined the meeting and spoke about waiving the obligations under Section 5. The applicant is not proposing any landscaping. They are scheduled for site plan review next week. Ms. Holmes is concerned that the area near the second driveway is dark. Floodlights have been placed on the building. A discussion was held. Mr. Dunleavy suggested placing reflectors on the corner fence posts.
Mr. Bombara made a motion to close the public hearing, ZBA Case #2014-11, Gilboa Properties, LLC, 120 Gilboa Street. Ms. Holmes seconded the motion. Vote: Unanimous.
Mr. Bombara made a motion to open a decision meeting for ZBA Case #2014-11, Gilboa Properties, LLC, 120 Gilboa Street. Mr. Demers seconded the motion. Vote: Unanimous.
A discussion was held regarding the variance for Section 5 and exactly what was being asked for. Ms. Reynolds described the Site Plan Review process.
Mr. Demers made a motion to grant the Special Permit for ZBA Case #2014-11, Gilboa Properties, LLC, 120 Gilboa Street for the proposed new rental space as designated on Site Drawing 614-43-0. Ms. Holmes seconded the motion. Vote: Unanimous.
A discussion regarding the specifics of the variance for Section 5 was continued. Ms. Reynolds explained that any new use would trigger Site Plan Review and all regulations under Section 5 would be reviewed.
Mr. Holland made a motion to grant the variance requested in the application submitted by Gilboa Properties, LLC as amended at the Zoning Board of Appeals meeting of December 3, 2014, with the findings that, the present property is in a reasonable condition, that given the new business, there is no new landscaping, there is no environmental threat, there is no loading issue and no social harm to limiting the amount of public parking from 65 to 18 on the property of 120 Gilboa Street. Therefore, the permitted obligations allowed and the variance should issue. Ms. Holmes seconded the motion. Vote: Unanimous.

7:54 PM ZBA CASE #2014-12, PUBLIC HEARING: MICHAEL CNOSSEN, 16 Shady Lane.
Mr. Heney opened the public hearing. Voting on the case will be Mr. Bombara, Mr. Demers, Mr. Heney, Ms. Holmes, and Mr. Holland. Mr. Fitzpatrick will be participating in all the discussions. Mr. Cnossen joined the meeting. Mr. Cnossen feels that the existing structure is only approximately 1900 sq. feet, not 3800 sq. feet as stated in the advertisement. Ms. Reynolds confirmed that 3800 is incorrect. The application is not reflective of the drawing.
Ms. Reynolds explained that Mr. Cnossen is increasing the size of a non-conforming structure on a pre-existing, non-conforming lot. He is adding a porch, garage, mudroom and renovating the existing structure.
Ms. Holmes made a motion to close the public hearing, ZBA Case #2014-12, Michael Cnossen, 16 Shady Lane. Mr. Demers seconded the motion. Vote: Unanimous.
Mr. Bombara made a motion to open a decision meeting for ZBA Case #2014-12, Michael Cnossen, 16 Shady Lane. Mr. Demers seconded the motion. Vote: Unanimous.
Ms. Holmes made a motion to grant the Special Permit for ZBA Case #2014-12, Michael Cnossen, 16 Shady Lane, referencing the plan by Andrews Survey and Engineering dated September 23, 2014 and the construction drawings by John Buccuma? dated April 21, 2014 for construction of a garage and modifications as requested in the application. A foundation As-Built must be submitted prior to any framing. Mr. Demers seconded the motion. Vote: Unanimous.

DISCUSSION/SIGN:
1. 2015 Meeting Schedule. Ms. Holmes made a motion to accept the FY 2015 ZBA Meeting Schedule as presented. Mr. Demers seconded the motion. Vote: Unanimous.
2. American Pro Wind. Mr. Heney stated that he spoke with Ms. Reynolds who said that the letter should have been addressed to her. Ms. Reynolds said that the applicant did not do what they were required to do. She is going through all the files to be sure she has the proper dates. At this time, there is no action required by the ZBA.

MINUTES: November 5, 2014
Mr. Bombara made a motion to approve the November 5, 2014 Zoning Board of Appeals meeting minutes as presented. Mr. Demers seconded the motion. Vote: Unanimous.

OPEN SESSION:
Regarding North Street (40B), Ms. Reynolds said that Mr. Cundiff has not talked with the contractor yet.
Mr. Heney presented three requests for project review from the Planning Board. The ZBA added the following comment to the review for Gilboa Properties, “The ZBA approved the special permit and variance request at their December 3, 2014 meeting.”
The ZBA had no comments on the scenic road project or the Cardinal Drive Residential Compound project.

8:29 PM ADJOURNMENT:
Mr. Bombara made a motion to adjourn the meeting at 8:29 PM. Ms. Holmes seconded the motion. Vote: Unanimous.
