CONSERVATION COMMISSION MEETING MINUTES
MONDAY, MARCH 2, 2015

A meeting of the Conservation Commission was held on Monday, March 2, 2015. Ms. Brown called the meeting to order at 7:04 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

1. 7:04 PM (NOI-DEP #143-0886) PUBLIC HEARING: 74 Main Street/NEW ENGLAND REALTY VENTURES, LLC
Paul McManus of Echo-Tech joined the meeting. He is a Professional Wetlands Scientist. Mark Smith and Russell Cyr were also present. The advertisement for the public hearing could not be found. The Committee called a recess at 7:20 PM.
At 7:39 PM, it was decided to reschedule the public hearing, NOI-DEP #143-0886, 74 Main Street, New England Realty Ventures LLC to March 16, 2015 at 7:15 PM.

7:23 PM (RDA) PUBLIC MEETING CONTINUED: 93 Linden Street/JOLIN, JASON
Ms. Brown stated that they received a request for a continuance from the applicant to March 16, 2015.
Ms. Van Roo made a motion to continue the public meeting, 93 Linden Street, Jolin, Jason to March 16, 2015 at 7:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. North Village (40B Project) located off North Street. Neil Rybicki of Northbrown, LLC joined the meeting. The Commission members reviewed the covenant. A checklist for the Building Commissioner was not included. Mr. Rybicki stated that it is a common project, all one parcel, not individual properties. Ms. Van Roo stated that this perspective was not brought to the Commission previously. What had been brought to the Commission was that the units were going to be sold off as phases were completed. There will be 124 units. A discussion was held.
The covenant needs to be a clean copy. Exhibit A needs to be recorded with the covenant. Mr. Rybicki will bring Exhibit A to the next meeting. Mr. Zisk suggested that seven signature lines be placed on the Partial Release. The wrong month is on the signature page. The Commission will sign the covenant at the next meeting.
Mr. Rybicki left the meeting.
2. FY16 Budget: Previously approved.
3. 2014 Annual Report: The Commission reviewed and approved the report.
4. Request for Certificate of Compliance: Matthew and Amy D’Anello, 19 Linden Street (DEP #143-0410). The applicants do not want to wait for the snow to melt. The attorneys want to close on March 30, 2015. This Certificate goes back to 2002. The Commission reviewed the map.
Ms. Sharkey made a motion to issue the Certificate of Compliance for 19 Linden Street. Ms. Van Roo seconded the motion. Vote: Unanimous.
5. MACC Annual Conference: Ms. Sharkey attended the conference on Saturday. She attended the following workshops: Vernal Pools, Fundamentals and Green Infrastructure. She will make the links available to the Commission.

OPEN SESSION:
Mr. Zisk was able to follow up on the natural flow regime of Whitin Reservoir. He stated that you can calculate the stream flow coming out of the low flow pipe, but you can’t calculate the stream flow itself unless you have a stream gauge somewhere down the stream. The Commission wanted to compare the stream flow to magnitude of natural flow regime for a stream of similar height and width. Mr. Zisk will look into getting a stream gauge.

8:11 PM (NOI-DEP #143-0887) PUBLIC HEARING: Yew Street, Lot #4 /FIERRO, DANIEL
Ms. Brown opened the public hearing. Seth Lajoie joined the meeting. The applicant is proposing a four bedroom dwelling with a septic system, well and a paved driveway. He is showing a 50’x60’ house box with a proposed deck and shed, which may or may not be built. They have two rows of straw wattles near the well and a stockpile area outside the 100’ buffer zone. He pointed out the buffer zones on the plan.
Ms. Sharkey would like the well outside the 50’. She would like the house to be 51’ from the road if they do not go with a 50’ wide house. Ms. Sharkey would like to see the house closer to the road and farther away from the wetland. Ms. Van Roo suggested plantings along the back border to delineate the back edge of the lawn and catch anything coming down the slope. Mr. Lajoie will take that into consideration. Ms. Sharkey handed Mr. Lajoie a list of comments.
Ms. Sharkey made a motion to continue the public hearing, (NOI-DEP #143-0887) public hearing: Yew Street, Lot #4 /Fierro, Daniel to April 6, 2015 at 7:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
Mr. Lajoie left the meeting.

8:13 PM (RDA) PUBLIC MEETING: 83 Island Road/VANDENAKKER, DEBORAH
Ms. Brown stated that the applicant is requesting a continuance to March 16, 2015.
Ms. Sharkey made a motion to continue the RDA public meeting, 83 Island Road, VandenAkker, Deborah to March 16, 2015 at 7:30 PM. Ms. Van Roo seconded the motion. Unanimous.

Meeting Minutes: January 5, 2015
Ms. Van Roo made a motion to approve the January 5, 2015 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.

8:34 PM ADJOURNMENT:
Ms. Van Roo made a motion to adjourn the meeting at 8:35 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
