CONSERVATION COMMISSION MEETING MINUTES
MONDAY, APRIL 6, 2015

A meeting of the Conservation Commission was held on Monday, April 6, 2015. Ms. Brown called the meeting to order at 7:09 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:09 PM (NOI-DEP #143-0887) PUBLIC HEARING CONTINUED: Yew Street, Lot #4 / FIERRO, DANIEL
Ms. Brown stated that the applicant has asked for a continuance. Mr. Zisk stated that the applicant also asked for a site walk. The site walk was scheduled for April 13, 2015 at 4:30 PM.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0887, Yew Street, Lot #4, Daniel Fierro to April 21, 2015 at 7:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:15 PM (NOI-DEP #143-0) PUBLIC HEARING: 69 Oak Street / DUBE, DIANA
Ms. Brown opened the public hearing. George Hendricks, 69 Oak Street, joined the meeting to present the plan. He showed where he will set up erosion barriers. He will plant natural seed 10 feet from the wattles, and the remainder of the area will be lawn. The access will not be used as a driveway. The wall will be restored and the opening will be narrowed to 16 feet wide. A discussion was held as to what the applicant would be doing with the stone that was brought in and whether or not there was a swale in the area. The Commission spoke to Mr. Hendricks about how to reconstruct the area.
Ms. Shirley Mosczynski, 60 Oak Street, stated that her concern is that the runoff crosses over the road and into a swale on her property. If the septic system breaks out, she is concerned that the runoff will go onto her property. Ms. Brown stated that the applicant is going to reseed 10 feet.
Ms. Sharkey made a motion to continue the public hearing, 69 Oak Street, Diana Dube to April 21, 2015 at 7:15 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:30 PM (NOI-DEP #143-0888) PUBLIC HEARING: 269 Southeast Main Street / LEONARDO, JOSEPH & ROSEMARY
Ms. Brown opened the public hearing. Margaret Bacon of Civil Site Engineering joined the meeting to present the plan for a proposed four-bedroom house with septic system. Joe Leonardo was also present. There is an existing gravel driveway.
They are asking for Green Brook to be determined as intermittent instead of perennial. Mr. Leonardo has pictures of the dry brook over the past four years. Ms. Brown asked Mr. Zisk to see if the Commission had made a determination about Green Brook in the past. Mr. Zisk presented the criteria for an intermittent stream. Ms. Bacon has pictures and stream statistics. Ms. Bacon stated that all the work is outside the riverfront area, however the parcel may be further subdivided in the future.
The Commission asked for the area to be staked out. Ms. Bacon will also be sure that the area is flagged.
A site walk was scheduled for Monday, April 13 at 5:00 PM.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0888, 269 Southeast Main Street, Joseph & Rosemary Leonardo to April 21, 2015 at 7:30 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

OPEN SESSION:
Mr. Zisk stated that Civil Site Engineering did a survey and Mylar for the proposed conservation land at 41 Pine Street. Mr. Zisk corresponded by email with the landowner. They are just waiting for the landowner’s lawyer to approve the deed. The landowner will base the finalization of the transfer of the land according to when he can get the tax credit. A discussion was held. Mike Yerka of Civil Site Engineering gave the plans to Mr. Zisk.

7:50 PM (RDA) PUBLIC MEETING CONTINUED: 93 Linden Street / JOLIN, JASON
Jason Jolin, 93 Linden Street, joined the meeting. Ms. Sharkey visited the site today. She stated that the area is very wet, there are some exposed roots and there are trees that have rotted from the bottom up and have fallen over. There is an existing jungle gym that would have to be moved if they were to go with the alternate plan that is out of the Commission’s jurisdiction. A discussion was held.
Mr. Jolin agreed to move the shed out from the tree line onto existing lawn. No trees can be cut down. He can plant native shrubs on existing lawn. The Commission asked Mr. Jolin to install erosion controls around the chicken coop ASAP. Ms. Sharkey did not see any erosion when she visited the site today. Mr. Zisk will visit the property on Saturday, April 11, 2015 to be sure the erosions controls are installed. The Commission asked for a strip of wattles to be laid on the tree line behind the shed.
Ms. Van Roo made a motion for a negative RDA, 93 Linden Street, Jason Jolin, with the condition that straw wattles be placed at the limit of disturbance behind the shed while it is being constructed, and straw wattles be maintained permanently behind the chicken coop. Ms. Sharkey seconded the motion. Vote: Unanimous.

8:03 PM (NOI-DEP #143-0886) PUBLIC HEARING CONTINUED: 74 Main Street / NEW ENGLAND REALTY VENTURES, LLC
Ms. Brown stated that the applicant has asked for a continuance to the next meeting.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0886, 74 Main Street, New England Realty Ventures, LLC to April 21, 2015 at 7:45 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Site Walk: Daniel Fierro, Yew Street, Lot #4: The site walk was scheduled for Monday, April 13, 2015 at 4:30 PM.
2. Site Walk: Request for Certificate of Compliance: Francis Beaupre, 93 Cliff Street (DEP #143-0666): This item was postponed until the snow melts.
3. Site Walk: Request for Certificate of Compliance: Francis Beaupre, 93 Cliff Street (DEP #143-0712): This item was postponed until the snow melts.
4. Status: 3 Cook Street: Ms. Brown received a notice from the Town Engineer that someone had called in anonymously to say someone was doing work near the Mumford River. She drove by and around the site and she could not see any evidence of work being done. A discussion was held. Mr. Zisk will visit the site and take pictures.
5. Status: Hayward Landing oil spill: Mr. Zisk stated that a truck picking up a dumpster was leaking fluid. The spill was cleaned up with Speedy-Dry. Mr. Zisk asked that some wattles be put down. He did not see any issues.
Mr. Zisk never heard anything further regarding the spill off of South Street.
6. Minutes: March 16, 2015. Approval of the March 16, 2015 Conservation Commission meeting minutes was deferred to the next meeting.

8:12 PM ADJOURNMENT:
Ms. Van Roo made a motion to adjourn the meeting at 8:12 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
