CONSERVATION COMMISSION MEETING MINUTES
TUESDAY, APRIL 21, 2015

A meeting of the Conservation Commission was held on Tuesday, April 21, 2015. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT: Michael Greco (Excused)

7:05 PM (NOI-DEP #143-0887) PUBLIC HEARING CONTINUED: Yew Street, Lot #4 / FIERRO, DANIEL
Ms. Van Roo made a motion to continue the public hearing, Yew Street, Lot #4, Fierro, Daniel to 7:35 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

OPEN SESSION
Whitin Reservoir Estates: Mr. Zisk stated that this is a proposed Flexible Development approved by the Planning Board. Lori Funari joined the meeting to present the plan. She explained what is needed to qualify as a Flexible Development. She is trying to get the lots released next Tuesday. She said that Mr. Cundiff, the Town Engineer, told her she needed to transfer ownership of five acres to Conservation. Town Counsel said the deed is fine, but they would like to know what Conservation would use the open space for. Mr. Zisk has asked for clarification from Atty. Jay Talerman.
Also, there is a mortgage holder on the property and Ms. Funari needs to get a release from him. Ms. Funari is requesting that the Commission sign the plan. It was the consensus of the Commission to not sign the documents until they receive more information.
Ms. Van Roo asked to see a timeline of the process. Ms. Funari will provide that. Ms. Brown would like to visit the site. The site would need boundary definitions. Nothing is currently staked.
Ms. Funari explained that the Swensons had an agreement with Mr. Dooley that they wanted Parcel A when the subdivision was finished. Mr. Zisk will look at the deed. The Commission will need to discuss what uses they want to approve and what impacts do they want to prevent.

7:27 PM (NOI-DEP #143-0889) PUBLIC HEARING CONTINUED: 69 Oak Street / DUBE, DIANA
George Hendricks, 69 Oak Street, joined the meeting. A discussion was held regarding the special conditions, which were not on the plan. Ms. Van Roo would like there to be a final version of the plan that includes the special conditions. The applicant needs to install a double row of erosion barrier wattles, one on the wetland boundary and the other 10’ from that one, to be removed after the first fall. The restored wall opening needs to be narrowed to 16’ using existing stone, the applicant needs to install a 12” drainage pipe, seed with native wetlands seed mix, and revise the date.
Shirley Mosczynski, 60 Oak Street asked if there is a waiting period before the applicant can start to do work after the plan is approved the by Commission. Mr. Zisk explained that the applicant cannot do any work until 10 days after the Order of Conditions is recorded at the Registry of Deeds. The applicant has three years from the date the Order of Conditions is signed to do the work.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions with the amended plan dated April 21, 2015 for DEP #143-0889, 69 Oak Street, Diana Dube. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:45 PM (NOI-DEP #143-0888) PUBLIC HEARING CONTINUED: 269 Southeast Main Street / LEONARDO, JOSEPH & ROSEMARY
Margaret Bacon of Civil Site Engineering and Joseph Leonardo, applicant, joined the meeting. Ms. Bacon moved the construction limit line right up behind the erosion control. The existing driveway is being used. The Commission would like erosion controls placed along the entire driveway. Mr. Zisk suggested that Ms. Bacon place erosion controls along the entire south side of the limit of disturbance.
Ms. Bacon gave the history on how the area was cleared. Mr. Leonardo explained that forest cutting created the treeline within the 100’ buffer zone.
Mr. Zisk was not able to find any information about the stream. Ms. Brown suggested pulling the file for a nearby house that was recently built to see what the determination was for the stream at that time. Ms. Bacon submitted several photos of the dry stream. To be an intermittent stream, it needs to be dry four consecutive days.
Ms. Van Roo is concerned about the impact to the wetlands from erosion from the steep slope after construction is finished. Ms. Sharkey suggested keeping the treeline. Ms. Bacon stated that the Board of Health for the Town requires that the final grading be stable before a Certificate of Compliance can be issued for the septic.
Ms. Bacon will clearly show the point of intermittent stream determination on the revised plan.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0888, 269 Southeast Main Street, Leonardo, Joseph & Rosemary to May 5, 2015 at 8:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

8:05 PM (NOI-DEP #143-0887) PUBLIC HEARING CONTINUED: Yew Street, Lot #4 / FIERRO, DANIEL
No one was present to present for the hearing.
Ms. Van Roo made a motion to continue the public hearing NOI-DEP #143-0887, Yew Street, Lot #4, Fierro, Daniel to May 5, 2015 at 8:10 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

8:06 PM (NOI-DEP #143-0886) PUBLIC HEARING CONTINUED: 74 Main Street / NEW ENGLAND REALTY VENTURES, LLC
Ms. Van Roo made a motion to continue the public hearing, NOI-DEP #143-0886, 74 Main Street, New England Realty Ventures, LLC to May 18, 2015 at 7:00 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

DISCUSSION
1. Request for Certificate of Compliance: 122 Walnut Street (DEP #143-0623). Mr. Zisk stated that he visited the site today, and the replication area is not ready. Ms. Sharkey stated that the request needs to be in the form of a Certificate of Compliance with DEP’s paperwork. Mr. Zisk will inform the applicant that the Certificate will not be signed until the replication work is finished, and the request must use DEP’s paperwork.
2. Sign / Determination of Applicability: Jason Jolin, 93 Linden Street. Mr. Zisk inspected the property last Sunday. The applicant placed straw bales behind the chicken coop and along the line of disturbance. Mr. Zisk will inspect the property after the shed is installed.
3. Notice of Intent to Sell pursuant to MGL Chapter 61, Section 8: 41 Pine Street. Mr. Zisk stated that the farmhouse is being taken out of Chapter 61 and 40 acres are being donated. In order to sell some of the lots, the Town has the right of first refusal to purchase the land.
Ms. Sharkey made a motion to recommend to the Board of Selectmen to not exercise the Town’s right of first refusal on 41 Pine. Ms. Van Roo seconded the motion. Vote: Unanimous.
4. 3 Cook Street: Update. Mr. Zisk spoke to the engineer right before today’s meeting. Work has been done at the site, and dumping has occurred. There is a small pile of sand on a paved area near a dumpster. It is covered with a tarp.
Excavation is being done with no erosion controls. Samples will be taken this Friday to determine what the contaminate in the soil is. Straw wattles need to be placed immediately. Ms. Van Roo requested to see copies of any DEP instructions they have received. Mr. Zisk will issue a Violation Notice for dumping material, call the DEP tomorrow to see if they are overseeing this project, request that the property owner come to the next meeting, and contact the Board of Health.

OPEN SESSION (Cont.)
Mr. Zisk was informed that the soccer club is looking to put in wells to irrigate the soccer fields.
Ms. Van Roo reminded the Commission to ask presenters to clearly state their name and affiliations for the minutes.
Ms. Brown requested a follow-up for the North Village Covenant and Partial Release of Covenant to find out if it was recorded at the Registry of Deeds. She has driven by the area, and it looks like they have filled in the crossing with a sandy, gravelly material. Ms. Brown thought they were supposed to use logs to cross. She asked that Ms. Van Roo and Ms. Sharkey visit the site. They agreed.
The plan was reviewed and it stated that the existing bed is to remain in a natural state. Mr. Zisk will ask the applicant to come to the next meeting to provide an update on the crossing, and he will ask them for the book and page number of the recording.

Approval of the April 6, 2015 Conservation Commission meeting minutes was deferred to the next meeting.
