CONSERVATION COMMISSION MEETING MINUTES
MONDAY, MAY 18, 2015

A meeting of the Conservation Commission was held on Monday, May 18, 2015. Ms. Brown called the meeting to order at 7:01 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman-arrived 7:03 PM), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:01 PM (NOI-DEP #143-0886) PUBLIC HEARING CONTINUED – 74 Main Street / NEW ENGLAND REALTY VENTURES, LLC
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing for 74 Main Street, New England Realty Ventures, LLC to June 15, 2015 at 7:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:02 PM (RDA) PUBLIC MEETING CONTINUED – 115 Martin Road / DOUGLAS HIGHWAY DEPARTMENT
William Cundiff, Town Engineer joined the meeting. He described the site. The plan shows the approximate location of the asphalt regrind pile and access road. He added contours to show that the access road is being pitched to the north side. The plan shows a drainage swale installed to a new proposed catch basin with an underground pipe and an outlet. Wattles and erosion controls will be placed on the downstream side of the road to wrap around the regrind asphalt. John Furno, Highway Superintendent, plans to spread the regrind over the parking area.
The road will consist of a gravel base, 2.5” of binder and 1.5” of a top course of pavement. The drainage channel will be lined with rip rap.
Ms. Van Roo made a motion to issue a negative RDA for 115 Martin Road, with the condition that the erosion controls extend all the way to Martin Road. Ms. Sharkey seconded the motion. Vote: Unanimous.

DISCUSSION
1. Evergreen Estates: Kip Dinazonian of PD Construction and Jackson Song joined the meeting. Mr. Cundiff stated that the project was approved in 2006. Town Counsel’s opinion is that the permit is still valid. All the conditions that were required have been satisfied. The schedule showed construction to begin last week, which it has not. Mr. Zisk stated that a vast majority of the project lies outside the jurisdiction of the Commission. The Order of Conditions is still valid. They have an extension to 2017.
Mr. Erizone would like to use a berm of wood chips as erosion control. He submitted pictures. The Commission asked about the specifics of the berm. Ms. Brown stated that the erosion controls must be in place prior to any construction. Mr. Dinazonian has hired the Conservation Agent from Upton to oversee it and report to the Commission. Mr. Cundiff stated that a settling pond will be built first and erosion will be protected from leaving the site. A discussion was held. It was decided that straw bales will be installed before wood chips. Mr. Dinazonian will notify Mr. Zisk when the straw bales are installed. They are scheduled to start cutting the road next Monday.

7:28 PM (NOI) PUBLIC HEARING – 128 Northwest Main Street / CANDITO, KENNETH
Ms. Brown opened the public hearing. Patrick Burke of HS&T Group of Worcester joined the meeting to present the plan. Mr. Candito was also present. Access to the site is off of Northwest Main Street. The current single family home will be demolished and replaced with another single family home. They are reducing the amount of impervious area by 30’ to 40’ in the 50’ buffer zone. They plan on connecting to the existing artesian well. They will be replacing the septic system, which has been approved by the Board of Health (BOH). The concrete patio and walkway is existing. They are proposing new pavement. There will be a garage under.
They received comments from the Dept. of Environmental Protection today, who requested they infiltrate the run off with a leaching chamber or galley. Some trees have been marked to be removed. They are proposing to plant eleven new trees – white pine and hemlock. Mr. Zisk asked for those designated trees to be marked with ribbon. The plantings are outside of the Commission’s jurisdiction.
The Commission reviewed Mr. Zisk’s video of the site. Ms. Sharkey asked for debris to be stockpiled outside the 100’ by the patio. Ms. Sharkey suggested installing gutters to a rain garden for infiltration for roof runoff. She also asked for the stockpile and well line to be added to the plan.
Ray Mongeau, 26 Northwest Main asked where the construction vehicles will be parked. Mr. Burke stated that they cannot park on the right-of-way; they will park on the site. Mr. Mongeau also asked about the noise, however that issue is outside the jurisdiction of the Commission. Mr. Burke stated that the hours of operation are controlled by the building permit.
Mike Hutnak, 132 Northwest Main Street, asked about the septic system. Mr. Candito said that they will be removing the old system and putting in new one. Mr. Burke said that a tight tank is there now, and they will be putting in a Title 5 system. Mr. Hutnak asked about a leaching field close to the water. Ms. Brown stated that that issue is under the BOH’s jurisdiction.
A site walk was planned for May 19, 2015 at 5:30 PM.
Ms. Van Roo made a motion to continue the public hearing, 128 Northwest Main Street, Candito, Kenneth to June 1, 2015 at 7:30 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:53 PM (NOI) PUBLIC HEARING – 3 Cook Street / HALLIHAN, JAMES III
Ms. Brown opened the public hearing. Arthur Allen of EcoTech and Mr. Hallihan joined the meeting. Mr. Allen stated that the project is a follow-up from the Emergency Certification to remove the sand blasting spoils that were contaminated with lead from sand blasting paint inside the mill complex building. Since the last meeting, the licensed site professional who oversaw the clean-up has submitted his final report and documented that all the material has been removed under the manifest under the limited removal action that was undertaken. Seven spoil areas have been tested and are below S1 reporting standards for lead. Going forward, Mr. Hallihan will do the restoration and place clean topsoil, seed with grass and mulch the two spoil areas. Ms. Van Roo suggested using native seed mix.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for 3 Cook Street, Hallihan, James III with the condition that instead of lawn, the area is planted with native seed mix. Ms. Sharkey seconded the motion. Vote: Unanimous.

DISCUSSION (Cont.)
2. 16 Shady Lane: Michael Knossen of Whitinsville joined the meeting. He has an approved plan from last year from Conservation. They are about to begin construction/renovations. They would like to put in a 1000 gallon gas tank for gas heat and bury it on the side of the house. They are going to move the furnace. He asked about a retaining wall.
Ms. Sharkey suggested wrapping the erosion controls around to the back corner. Ms. Brown asked Mr. Knossen to contact Mr. Zisk once the erosion controls are installed. The excavated material will be stockpiled in the area noted on the plan. Erosion controls will be used around the stockpile. The Commission stated that Mr. Knossen does not need to amend his current plan.
3. VFW Soccer Field: A series of emails was discussed. Ms. Brown had asked Mr. Cundiff to make sure that the applicant is not under the impression that he can take water from the brook to water the fields. Mr. Cundiff informed the applicant. The applicant wanted to come to today’s meeting to talk about it. Ms. Brown emailed the applicant by mistake instead of Mr. Zisk. The applicant has now stated that they will not be taking water from the brook.
The proposed shed and well have been moved outside the jurisdiction of the Commission. Mr. Zisk discovered many trees marked for cutting as part of the installation of a utility pole. Mr. Zisk informed the applicant that he would have to come before the Commission before any trees were cut. The applicant will speak with the utility company. Mr. Cundiff will file an RDA for the utility work.
Ms. Brown and Mr. Zisk will visit the site tomorrow evening.
4. Requests for Certificates of Compliance: Kenneth Linder / Francis Beaupre, Cliff Street. Mr. Zisk stated that originally, there were two filings. The subdivision was rescinded and a recycling facility was put in. Mr. Zisk took some photos and videos. The only item left was silt fence. It was agreed that the silt fence should be removed. Mr. Zisk has informed the applicant.
Ms. Sharkey made a motion to issue the Certificate of Compliance for the industrial park for Kenneth Linder/Francis Beaupre, Cliff Street. Ms. Van Roo seconded the motion. Vote: Unanimous.

5. Request for Certificate of Compliance: Lisa Cellucci, 122 Walnut Street. This item was discussed at the last meeting.
6. Request for Extension Permit: Steven Swartz, 46 Chestnut Street. Mr. Zisk does not believe the applicant qualifies for an extension. He will look into the matter.
7. Certificate of Compliance: Anthony Ciccone, 283 Southwest Main. Mr. Zisk will speak with Maria Lajoie about this item.

OPEN SESSION
Ms. Brown asked Mr. Zisk to follow-up to see if North Street subdivision, Exhibit A, was properly recorded. Mr. Zisk will speak with Atty. Jay Talerman.
