CONSERVATION COMMISSION MEETING MINUTES
MONDAY, AUGUST 3, 2015

A meeting of the Conservation Commission was held on Monday, August 3, 2015. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

REORGANIZATION
Ms. Van Roo made a motion to nominate Linda Brown as Chairperson of the Conservation Commission. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to nominate Tracy Sharkey as Vice Chairperson of the Conservation Commission. Mr. Greco seconded the motion. Vote: Unanimous.

7:06 PM (NOI-DEP #143-0890) PUBLIC HEARING CONTINUED – 128 Northwest Main Street / CANDITO, KENNETH
Ms. Brown stated that the applicant requested a continuance.
Ms. Sharkey made a motion to continue the public hearing, 128 Northwest Main Street, Kenneth Candito to August 17, 2015 at 7:05 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

DISCUSSION
1. George Kuipers, 22 Potter Road. Mr. Kuipers stated that the challenge on Potter Road is the low-ton bridge. To get concrete over it, they could pump it over or create a temporary bridge. A temporary bridge would raise the elevation over the bridge by approximately one foot. He asked the Commission what type of gravel he should use to ramp up and down. Potter Road is a Town road. He stated that the Town (William Cundiff, Town Engineer and Michael Guzinski, Town Administrator) has made him responsible for the bridge’s condition. A discussion was held.
Ms. Brown feels he needs to file a Request for Determination. Ms. Van Roo would like written clarification from Mr. Cundiff in order to understand the parameters. The members of the Commission were in agreement that an RDA should be filed and they would like an explanation from the Town as to why Mr. Kuipers is responsible for the bridge’s condition. Mr. Zisk outlined the RDA procedure with Mr. Kuipers. Mr. Zisk will email Mr. Cundiff for clarification.
2. Sign: MACC Voucher.
3. Sign: Certificate of Compliance Lance Salmonsen, 12 Bigelow Road (DEP #143-0877). Mr. Zisk stated that the Commission voted on this at the last meeting.
4. Sign: Certificate of Compliance: David Adam, 12 Shady Lane (DEP #143-0871). Ms. Van Roo made a motion to issue a Certificate of Compliance for David Adam, 12 Shady Lane (DEP #143-0871). Ms. Sharkey seconded the motion. Vote: Unanimous.
5. Sign: Certificates of Compliance: ExxonMobil Pipeline, Various Town Locations (12). Ms. Sharkey asked to see each site. Mr. Zisk has been to all but two. There is one site Mr. Zisk is not able to visit. He suggested having the owner take pictures. Also, the area near the Beagle Club is all fenced. Mr. Zisk will contact ExxonMobil and the Beagle Club about those two sites. It was decided to not issue any of the Certificates until all the sites have been visited.
6. Sign: Request for a Certificate of Compliance: KTKM Realty Trust, 12 Meetinghouse Lane, Lot #27 (DEP #143-0854). The Commission reviewed Mr. Zisk’s video of the site. He stated that there should be an as-built on file.
Ms. Sharkey made a motion to issue a Certificate of Compliance: KTKM Realty Trust, 12 Meetinghouse Lane, Lot #27 (DEP #143-0854). Mr. Greco seconded the motion. Vote: Unanimous.
7. Sign: Request for a Certificate of Compliance: Town of Douglas/School Project, 21 Davis Street (DEP #143-0833). Mr. Zisk has walked the site. There are some areas where the silt fence has not been taken down.
Mr. Zisk stated that Fred gave a detailed report about the replication area. In Fred’s opinion, the replication areas meet his design. The straw bales are still in place. Ms. Van Roo would like to look at the minutes to see what the decision was as to how to maintain the replication areas in the corners. The other corner has been mowed into. It was suggested that perhaps Fred should be asked for his opinion as to how to ensure the corners remain replicated. Mr. Zisk will look for the minutes that document the decision. The burlap does not need to be removed.
8. Minutes: 4/21, 5/5, 5/18, 6/1, 6/15, 7/20
Ms. Van Roo made a motion to approve the April 21, 2015 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to approve the May 5, 2015 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to approve the May 18, 2015 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to approve the June 1, 2015 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Sharkey made a motion to approve the June 15, 2015 Conservation Commission meeting minutes as presented. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Van Roo abstained.
Ms. Sharkey made a motion to approve the July 20, 2015 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Van Roo abstained.

OPEN SESSION
Art Allen, North Street, LLC, Green Straw: Ms. Brown stated that all the straw bales at 28 North Street were sprouting grass. It looks like a grain grass. Most grains are noninvasive. Mr. Allen emailed the members of the Commission confirming that. The bales are still serving their function and the replication area looks beautiful.
Ms. Van Roo asked if there has been a final version of the plan that includes the special conditions for 69 Oak Street, Diana Dube. Mr. Zisk stated that George Hendricks revised and submitted the plan that evening.
Ms. Van Roo asked if Exhibit A for North Village, LLC had been recorded. Mr. Zisk replied that it did not look like it had been recorded, but according to the lawyer, it did not need to be.
