CONSERVATION COMMISSION MEETING MINUTES
MONDAY, NOVEMBER 2, 2015

A meeting of the Conservation Commission was held on Monday, November 2, 2015. Ms. Brown called the meeting to order at 7:15 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Stephen Zisk (Conservation Agent)
ABSENT: Brandi Van Roo (Excused)

7:15 PM (NOI-DEP #143-0892) PUBLIC HEARING CONTINUED-16 Cottage Colony/GUARANTEED BUILDERS & DEVELOPERS, INC.
Ms. Sharkey recused herself. There were not enough members present to vote.
Mr. Greco made a motion to continue the public hearing, NOI-DEP #143-0892, 16 Cottage Colony, Guaranteed Builders & Developers, Inc. to December 7, 2015 at 7:15 PM. Ms. Brown seconded the motion. Vote: Unanimous.
Ms. Sharkey rejoined the meeting.

7:17 PM (RDA) PUBLIC MEETING-568 Northwest Main Street/CATUSI, PHILIP
Philip and Linda Catusi joined the meeting. Mr. Catusi presented the proposed plan and a description. The new deck will be exactly where the current deck is now, except that it will be enclosed. They will install new footings using an excavator. Mr. Zisk showed some pictures of the site. The Commission asked the applicants to place
straw wattles 25’ from the high water line.
Ms. Sharkey made a motion to issue a negative determination for 568 Northwest Main Street, Philip Catusi with the condition that straw wattles be installed and Mr. Zisk be called to inspect before earthwork begins. Mr. Greco seconded the motion. Vote: Unanimous.

7:30 PM (NOI-DEP #143-0895) PUBLIC HEARING-115 Ledgestone Road/ STOCKWELL, DEBRA
Ms. Brown opened the public hearing. Leonard Jalbert from Jalbert Engineering and James Daigneault from General Contractors joined the meeting. Debra Stockwell was also present. Mr. Albert presented the plan. The work area will be delineated by the siltation fence and wattles. He showed an area for stockpiling. He will leave the deck as is and excavate for the house. There will be a grass parking area for three cars. The site has a private sewer system. They are staying within the same commercial use. They will back dig to tap into the water line. The well was approved in 2008.
There will be no pipes discharging from the house. Ms. Zisk stated that if the Building Inspector requires a foundation drain, the applicant will have to come back to the Commission. The deck will stay in the same parameter in which it is currently, with no earthwork underneath it. They will be before the ZBA on December 2, 2015.
Ms. Sharkey made a motion to continue the public hearing, NOI-DEP #143-0895, 115 Ledgestone Road, Debra Stockwell to December 7, 2015 at 7:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:45 PM (NOI-DEP #1430894) PUBLIC HEARING CONTINUED-Southeast Main Street, Lot #8 (access from Crescent Lane)/RODZEN, CHRIS
Karina Quinn of Guerriere and Halnon, Inc. joined the meeting. The plan was updated on October 14, 2015 to show a stone rip rap swale. Eco Tech investigated the area south of the wetland and did additional pits. She submitted a copy of their report. They found no additional wetlands. Ms. Quinn received a response letter from the Div. of Fisheries and Wildlife saying that there were no impacts relating to their jurisdiction.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP#143-0894), Southeast Main Street, Lot #8, Chris Rodzen. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Violation Notice: 56 Bigelow Road. Ryan Specyalski joined the meeting. Mr. Zisk visited the site. During a microburst, some trees came down and pushed the wall out and 28’ of the wall fell into the water. Mr. Specyalski consulted the president of the association who told him how to rebuild the wall. Mr. Specyalski pulled out the stone that fell into the water. The Commission would like to see a plan of the property. An RDA was done in 2001 for a septic tank. The Commission told Mr. Specyalski to file a Notice of Intent.
Ms. Sharkey made a motion to issue a $100 fine for the violation, 56 Bigelow Road. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Brown told Mr. Specyalski that the fine had to be paid immediately and that he also had to file either an RDA or a Notice of Intent immediately. Ms. Sharkey told him they will need a description of how he is going to build the wall, the location, and the distances. Mr. Zisk told Mr. Specyalski to have Ms. Lajoie put him on the agenda for the December 7, 2015 meeting at 7:45 PM.
2. Violation Notice: 85 Franklin Street. John Boulter joined the meeting. He stated that he cut down some trees because he felt the trees were in danger of falling on his house. Most of the stumps are still there. He has a pile of debris waiting to be burned. He mentioned that he wants to erect a shed.
Ms. Sharkey made a motion to issue a $100 fine for the violation, 85 Franklin Street. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Brown stated that Mr. Boulter needs to file immediately. He needs to give the Commission a plan and dimensions. Mr. Zisk gave Mr. Boulter the forms and instructions to file an RDA.
3. Sign: Voucher.
4. Sign: Certificate of Compliance: Michael & Kristen Lewis, 16 Linden Street. Mr. Zisk said that Ms. Lajoie said that the Commission signed the Certificate of Compliance in 2011 but it was never recorded at the Registry of Deeds. She would like the Commission to sign it again so it can be recorded.
Ms. Sharkey made a motion to reissue the Certificate of Compliance for 16 Linden Street, Michael and Kristen Lewis. Mr. Greco seconded the motion. Vote: Unanimous.
5. Minutes: 9/21/15 and 10/5/15
Ms. Sharkey made a motion to approve the September 21, 2015 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Unanimous.
Approval of the October 5, 2015 Conservation Commission meeting minutes was deferred to the next meeting.

OPEN SESSION:
Certificate of Compliance for 118 Davis Street: Ms. Sharkey stated that the Certificate was never requested. No action was taken.
Mr. Zisk mentioned that he told the Bosmas to remove the hay bales.

Ms. Sharkey made a motion to adjourn the meeting at 8:35 PM. Mr. Greco seconded the motion. Vote: Unanimous.
