October 5, 2015 Conservation Commission meeting

A meeting of the Conservation Commission was held on Monday, October 5, 2015. Ms. Brown called the meeting to order at 7:05 PM.

PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Michael Greco, Brandi Van Roo, Stephen Zisk (Conservation Agent)

1. Anthony Ciccone & Cathy Green, 283 Southwest Main Street: Perimeter Drain & Well: Mr. Ciccone and Ms. Green joined the meeting. They have added a perimeter drain to the plan and now show the location of the artesian well. Ms. Sharkey feels that this is a minor plan change, as long as the drain is not used for anything else. Mr. Ciccone will tell the excavator to be sure the pipe comes out. He stated that he could place stone at the pipe discharge to stop erosion into the water. He was advised to submit a new plan with a revised date for the record.
Ms. Sharkey made a motion to accept the plan for 283 Southwest Main Street dated 9/17/15 as a minor plan change. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:15 PM (NOI–DEP #143-0895) PUBLIC HEARING - 115 Ledgestone Road, STOCKWELL, DEBRA
Mr. Zisk said that the legal ad said “15” instead of “115”. The gentleman from Albert Engineering that joined the meeting stated that the notice that was sent to the abutters said “115”. The gentleman will re-advertise. He said that he did not receive Mr. Zisk's comments.
A discussion was held regarding allowing Certificates of Mailing instead of certified mailings. Mr. Zisk suggested the engineer do green cards (certified mail) in order to satisfy the requirement. Mr. Zisk retrieved the bylaw and the Conservation Commission's regulations and policies and nowhere did it state that abutters have to be notified by certified mail.
By consensus, it was agreed that the Conservation Commission can accept Certificates of Mailing in lieu of green cards. Ms. Van Roo asked that this information be passed along to the office.
This item will be placed on the agenda for the October 19, 2015 meeting at 7:30 PM.

7:30 PM (NOI-DEP #143-0893) PUBLIC HEARING CONTINUED – 24 Locust Street, VAN REED, CLIFF
Mike Yerka of Civil Site Engineering joined the meeting. He stated that they will plant shrubs and trees as a border to block lawn creep: 2.5” maples and high-bush blueberries and winterberry, mixed.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for NOI–DEP #143-0893, Cliff Van Reed, 24 Locust Street. Mr. Greco seconded the motion. Vote: Unanimous.

2. Minutes: September 21, 2015
Approval of the September 21, 2015 Conservation Commission meeting minutes was deferred to the next meeting.
3. Request for a Certificate of Compliance: Patricia & Aaron Socrat, 49 Lindbergh Avenue (DEP #143-0884). Mr. Zisk showed a video of the site.
Ms. Van Roo made a motion to issue a Certificate of Compliance for Patricia and Aaron Socrat, 49 Lindbergh Avenue (DEP #143-0884). Ms. Sharkey seconded the motion. Vote: Unanimous.

Regarding the School Building Project, Mr. Zisk will send them another email asking them to remove the silt fence.

7:45 PM (NOI-DEP #143-0---) PUBLIC HEARING – Southeast Main Street, Lot #8 (across from Crescent Lane), RODZEN, CHRIS
Ms. Brown opened the public hearing. Normand Gamache of Guerriere and Halnon and Mr. Rodzen joined the meeting. Mr. Gamache presented the plan. It is a 22 acre lot with frontage on Southeast Main Street. There are significant wetlands. He stated that a shared driveway is proposed. The wetlands were mapped by Eco-Tech. There is approximately175' of residential driveway within the 100' buffer zone.
Mr. Zisk stated that at wetlands flag #A14, it looks like everything drains towards the access road and south of that is a low, flat area. Mr. Zisk stated that an area has already been cleared in the area of the proposed house. The path that has been cleared to get to that area is within the 25' buffer zone. Mr Gamache stated that his client did not clear that area; it had already been cleared for soil testing in 2013. The septic system and house were on an approved Board of Health plot plan. His client would like to have the house in a different location. Mr. Zisk would like Scott to go back out there. They have asked for a transected flag A14.
Ms. Van Roo was concerned about channeling between the paved drive and the erosion control line. Mr. Gamache described how the driveway is pitched, and he feels the runoff will sheet flow down to the rip rap.
There is not yet an agreement between the two owners for the construction of the driveway. There is a new owner for the other property. Mr. Zisk suggested there be one design so that the applicant does not have to come back to the Conservation Commission.
Kimberly Morris, 145 Southeast Main Street, Mr. and Mrs. Moussette, 25 Vine Street, and Ms. Price, 19 Vine Street were shown where their properties abut the applicant's property.
A site walk was planned for October 13, 2015 at 4:45 PM. The Commission asked specifically to see the center line of the driveway, the location of the culvert, and the 100' buffer flagged.
Ms. Van Roo made a motion to continue the public hearing, Chris Rodzen, Southeast Main Street, Lot #8 to October 19, 2015 at 7:35 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

Ms. Sharkey made a motion to adjourn the meeting at 8:54 PM. Mr. Greco seconded the motion. Vote: Unanimous.
