ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, JUNE 3, 2015

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, June 3, 2015. Mr. Heney called the meeting to order at 7:02 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), Pamela Holmes (Vice Chairman), Leonard Demers, Sean Holland, Michael Fitzpatrick (Alternate) and Maria Lajoie (Administrative Secretary)
ABSENT: John Bombara (Excused)

7:02 PM PUBLIC HEARING CONTINUED: ISLAMIC SOCIETY OF GREATER WORCESTER, 170 West Street
Shirley Cooney, Chair and Debby Heinz of the Cemetery Commission were present. Ms. Heinz read a statement from the Commission prepared in response to inquiries from the public and various town boards and committees. She stated that the Douglas Cemetery Commission has no authority over existing or proposed private cemeteries. She described the traditions and procedures for Muslim burial and green burial.
Mr. Heney read correspondence from the Board of Health requesting a continuance of the public hearing in order to review additional materials they have received.
Imad Zrein, P.E. of DeVellis Zrein, Inc. joined the meeting to present the revised proposal. He stated that they have added a gate at the entrance to the cemetery with a lock, a reserved grass area 60’ wide to hold 100 vehicles, 30’ untouched buffer around the perimeter, a temporary turnaround of 65’ radius in each phase, a proposed layout of graves, and the driveway has been moved 40’ way from the abutting property. Mr. Zrein confirmed the traditions and procedures of a Muslim buried as presented by the Cemetery Commission, however they are not proposing a green cemetery. They will be contracting with a funeral home. They average perhaps five to ten burials per year.
Mr. Demers asked if trees were going to be installed to screen the cemetery from the abutting property. Mr. Zrein said that they could provide a screen of arborvitaes.
Ms. Holmes read the proposed publicized route to the cemetery. Cross Street is very primitive and narrow, and she would not recommend Cross Street be used for travel. Mr. Zrein presented a letter from the mayor of Enfield.
Discussions were held regarding wetlands and maintenance of the property. Atty. Jay Talerman stated that the ZBA can condition in their decision that the property be well maintained, but the ZBA cannot condition anything relating to burials. Ms. Cooney spoke about the history of maintaining cemeteries in Town. Dr. Khalid Sadozai, President of the Islamic Society of Greater Worcester, stated that the cemetery in Enfield has been there for over 35 years and that property has not been abandoned and is well maintained.
Steve Bloom, 164 West Street, asked about the two small dilapidated barns on the property near the road. Mr. Zrein stated that they could remove the barns.
Mr. Zrein stated that they are under a deadline and asked that a decision be made. Mr. Heney would like the Board of Health’s (BOH) input to be included in the decision. Mr. Zrein sent plans and an application to the BOH, but he did not get the impression he would be meeting with them. He understood that they did meet and talk about the cemetery. Atty. Talerman stated that he does not feel there is much that the BOH can do to influence the zoning process, however they may have input.
Ms. Holmes made a motion to continue the public hearing, Islamic Society of Greater Worcester, 170 West Street to July 1, 2015 at 7:00 PM. Mr. Demers seconded the motion. Vote: Unanimous.

OPEN SESSION:
Atty. Talerman stated that there is an appeal of the Dunkin Donuts drive through decision. Atty. Talerman will be moving to dismiss because there is a requirement to file with the town clerk within the same 20 days that they file with the court. The applicant filed with the court and never filed with the town clerk. A discussion was held.
Reorganization of the Board was deferred to the next meeting.

Mr. Demers made a motion to approve the March 4, 2015 Zoning Board of Appeals meeting minutes as presented. Ms. Holmes seconded the motion. Vote: Unanimous.
Ms. Holmes made a motion to approve the May 6, 2015 Zoning Board of Appeals meeting minutes as presented. Mr. Demers seconded the motion. Vote: Unanimous.

Mr. Demers made a motion to adjourn the meeting at 7:52 PM. Mr. Holland seconded the motion. Vote: Unanimous.
