ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, JULY 1, 2015

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, July 1, 2015. Mr. Heney called the meeting to order at 7:15 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), Pamela Holmes (Vice Chairman), John Bombara, Leonard Demers, Sean Holland, Michael Fitzpatrick (Alternate) and Maria Lajoie (Administrative Secretary)
ABSENT:

7:15 PM ZBA CASE #2015-04 PUBLIC HEARING CONTINUED: ISLAMIC SOCIETY OF GREATER WORCESTER, 170 West Street
Mr. Heney stated that the applicant has asked for a continuance to the August meeting.
Ms. Holmes made a motion to continue the public hearing, Islamic Society of Greater Worcester, 170 West Street to August 5, 2015 at 7:00 PM. Mr. Demers seconded the motion. Vote: Unanimous.

DISCUSSION:
1. MINUTES: June 3, 2015
Approval of the June 3, 2015 Zoning Board of Appeals meeting minutes was deferred to the next meeting pending review of the recording.
2. Request from the Board of Selectmen (BOS): Application for the open position on the Zoning Board (ZBA).
Ms. Holmes was concerned that the applicant may have conflict with the mission of the ZBA. The other members of the ZBA agreed.
Mr. Bombara made a motion to send a letter to the BOS not recommending the application for the open position on the ZBA. Ms. Holmes seconded the motion. Vote: Unanimous.
3. Reorganization:
Mr. Bombara made a motion to retain the Chairman and Vice Chairman of the ZBA as is for the next twelve months. Mr. Demers seconded the motion. Vote: Unanimous.

7:30 PM ZBA CASE #2015-06 PUBLIC HEARING: KATHY MITSIN, 13 Depot Street
Mr. Heney opened the public hearing. Hearing the case were Mr. Fitzpatrick, Mr. Demers, Ms. Holmes, Mr. Bombara, Mr. Holland and Mr. Heney. All were voting, except for Mr. Fitzpatrick. Ms. Mitsin joined the meeting. She would like to operate a hair cutting area in her home. She currently works at a salon in Westboro. She will continue to work there full-time for a few more years, but she would gradually like to move business to her home as she nears retirement. She only needs to take down one wall in her home. Patrons will be by appointment only, and she will be the only one cutting hair. Ms. Mitsin stated that she would be open 7:30 AM to 8:00 PM Tuesday through Friday and Saturdays 10:00 AM to 4:00 PM. There would never be more than two extra cars in the driveway at a time. All parking is off-street.
Mr. Bombara made a motion to close the public hearing, Kathy Mitsin, 13 Depot Street. Ms. Holmes seconded the motion. Vote: Unanimous.
Ms. Holmes made a motion to open the decision meeting, ZBA Case 2015-06 Kathy Mitsin, 13 Depot Street. Mr. Demers seconded the motion. Vote: Unanimous.
Mr. Holland had no objection to the special permit, with the hours of operation as proposed and off-street parking with adequate site lines.
Mr. Holland made a motion to permit the special permit, ZBA Case 2015-06 Kathy Mitsin, 13 Depot Street, to run the business as requested with the condition that the hours of operation be 7:30 AM – 8:00 PM Tuesday through Friday and 10:00 AM – 4:00 PM on Saturdays, the business will not run on Sundays and Mondays, that there will be no more than two cars parked for business purposes by customers on the yard, and any and all parking will be off-street and will be contained to 13 Depot Street. Any sign placed at the establishment would have to comply with the requirements of the existing sign bylaw. Mr. Bombara seconded the motion. Vote: Unanimous.

7:45 PM ZBA CASE #2015-07 PUBLIC HEARING: KENNETH CANDITO, 128 Northwest Main Street
Mr. Heney recused himself. Ms. Holmes opened the public hearing. Hearing and voting on the case were Mr. Fitzpatrick, Mr. Demers, Ms. Holmes, Mr. Bombara and Mr. Holland. Patrick Burke of HS&T Group of Worcester joined the meeting to present the site plan. Mr. Candito was present at the meeting. They are proposing to demolish the existing 66’ x 29’ house, remove the current stone foundation and erect a 64’ x 29’ dwelling. They will retain the non-conforming setback to allow room for the cars to exit from the driveway. There is a garage under. There is 60’ from the corner of the building to the property line. They will be 50’ from the abutting house. The plan has been before the Conservation Commission.
Mr. Demers recommended that all ZBA members visit the site. The existing house is one-story and the proposed house is two-story, which would be very different than the character and style of the existing homes nearby. Mr. Demers presented a video of the site.
Miriam Mongeau, 126 Northwest Main Street, stated that she has no objections to the plans.
Roy Caouette, 150 Northwest Main, requested that there be no changes made to the right-of-way. Mr. Candito stated that the right-of-way would not change.
Mr. Holland made a motion to continue the public hearing, Kenneth Candito, 128 Northwest Main Street to August 5, 2015 at 7:15 PM. Mr. Demers seconded the motion. Vote: Unanimous.
Mr. Heney rejoined the meeting and resumed as Chairman of the meeting.

8:14 PM ADJOURNMENT:
Mr. Demers made a motion to adjourn the meeting at 8:14 PM. Mr. Holland seconded the motion. Vote: Unanimous.
