ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, SEPTEMBER 2, 2015

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, September 2, 2015. Mr. Heney called the meeting to order at 7:03 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Daniel Heney (Chairman), Pamela Holmes (Vice Chairman), John Bombara, Leonard Demers, Michael Fitzpatrick (Alternate), Sean Holland, Louis Tusino (Alternate) and Maria Lajoie (Administrative Secretary)
ABSENT:

DISCUSSION:
1. Request for Proposals /Selection of Material Testing Firm: North Village 40B Project. Mr. Cundiff stated that this board was the permit granting authority for this project. A decision was issued some time ago. Included in the decision is a provision to allow the Town to hire outside consultants to oversee construction of the roadways and infrastructure of the project. The Planning Board will be hiring soil testing companies to go out into the field to do some analysis to be sure approved specifications are met. The ZBA needs to make the decision on who will be used. Mr. Cundiff solicited prices from three soil testing firms that are certified in Massachusetts. He gave a brief overview of his approach. He received two responses. A discussion was held.
Ms. Holmes made a motion to select JTC as the soil testing company for this project. Mr. Bombara seconded the motion. Vote: Unanimous.
Mr. Cundiff will be submitting some invoices and staff time to be drawn out of the provisional account. He will have them replenish the account if it falls within 25% of the initial balance.
Mr. Cundiff left the meeting.

7:15 PM ZBA CASE #2015-08 PUBLIC HEARING: ANTHONY CICCONE, 283 Southwest Main Street
Mr. Heney opened the public hearing. Mr. Ciccone’s special permit was approved on November 5, 2014. The special permit was approved for more square footage (2128 sq. ft.) than was advertised (1672 sq. ft.). Anthony Ciccone and Cathy Green joined the meeting. Mr. Ciccone presented plans for over 2400 sq. ft. with a finished basement. The plan was not available at the November 5, 2014 meeting. Mr. Ciccone plans to have a bathroom, sink and outlets for a stove and refrigerator in the cellar. Doing so, designates the cellar as conditioned living space, which exceeds the square footage allowed by the special permit. A discussion was held. It was decided that the cellar will not be livable space at this time. Mr. Ciccone will amend the special permit at a later date if he decides to finish the basement.
Ms. Holmes made a motion to close the public hearing, ZBA Case #2015-08, Anthony Ciccone, 283 Southwest Main Street. Mr. Bombara seconded the motion. Vote: Unanimous.
Ms. Holmes made a motion to open a decision meeting for ZBA Case #2015-08, Anthony Ciccone, 283 Southwest Main Street. Mr. Bombara seconded the motion. Vote: Unanimous.
Ms. Holmes made a motion to approve the amended permit for ZBA Case #2015-08, Anthony Ciccone, 283 Southwest Main Street with a square footage of 2128 sq. ft. complying to plans done by JR Associates in Sutton, MA, submitted on August 13, 2015, with the stipulation that the basement level of that plan remain unfinished. The setback shall apply to the plan prepared by Guerriere and Halnon drawn September 24, 2014, revised August 26, 2015. Mr. Demers seconded the motion. Vote: Unanimous.

DISCUSSION (Cont.):
2. Planning Board Request for Review: John Hill, 106 Walnut Street (Accessory Apartment Special Permit). Mr. Demers reviewed and presented the Special Permit. The applicant would like to add a 484 sq. ft. accessory apartment to their home. The ZBA had no objection to the application.
3. MINUTES: 8/5
Mr. Holland made a motion to approve the August 5, 2015 Zoning Board of Appeals meeting minutes as amended. Mr. Bombara seconded the motion. Vote: Unanimous.

Mr. Bombara made a motion to adjourn the meeting at 8:07 PM. Ms. Holmes seconded the motion. Vote: Unanimous.
