ZONING BOARD OF APPEALS MEETING MINUTES
WEDNESDAY, NOVEMBER 4, 2015

A meeting of the Zoning Board of Appeals (ZBA) was held on Wednesday, November 4, 2015. Ms. Holmes called the meeting to order at 7:01 PM in the Community Meeting Room.

ATTENDANCE:
PRESENT: Pamela Holmes (Vice Chairman), John Bombara, Leonard Demers, Michael Fitzpatrick (Alternate), Louis Tusino (Alternate)
ABSENT: Daniel Heney (Chairman-Recused), Sean Holland (Excused), Maria Lajoie (Administrative Secretary-Excused)

7:01 PM ZBA CASE #2015-09 PUBLIC HEARING: LEE JUNDANIAN, Maple Street, Assessors Map 194, Parcel 13.
Ms. Holmes opened the public hearing. Hearing the case was Ms. Holmes, Mr. Bombara, Mr. Demers, Mr. Fitzpatrick and Mr. Tusino. Atty. Henry Lane joined the meeting on behalf of Mr. Jundanian. He explained that the applicant wants to build a single-family home on this lot, however the lot is comprised of two zones – Industrial and Rural Agricultural. Atty. Lane explained if the variance is granted, the lot would be 100% residential and there could never be an industrial use on the property. The lot has reduced frontage and requires a variance due to the dual zones. The ZBA acknowledged that the Planning Board had no issue with this request.
There was a discussion regarding whether or not abutting lots were similarly affected. A discussion was held regarding the existence of a ROW by Gas Pipeline where the proposed driveway is located. A map of the locus was reviewed showing the zoning borders.
Ms. Holmes asked Atty. Lane to provide justification for a variance. He said that without the variance, the lot would be a useless piece of land. He stated that the lot shape provided the reason for a variance. Mr. Tusino stated that the owner should not be permitted to have any use of the property other than residential. Mr. Tusino proposed that a barn could be put on the property. Atty. Lane agreed and stated that the house would be built entirely on the RA zoned land
Mr. Bombara made a motion to close the public hearing, ZBA Case #2015-09, Lee Jundanian, Maple Street, Assessors Map 194, Parcel 13. Mr. Demers seconded the motion. Vote: Unanimous.
Mr. Demers made a motion to grant a variance for ZBA Case #2015-09, Lee Jundanian, Maple Street, Assessors Map 194, Parcel 13 with the condition that it be restricted to residential only. Mr. Bombara seconded the motion. Vote: Unanimous.
Atty. Lane left the meeting.

DISCUSSION:
1. Letter of Complaint: Thomas & Ellen Hand, 15 Walnut Street. Ms. Holmes read a letter from Animal Inspector, Cory Howard. He has visited the property and all animals are in good health with adequate food and shelter. He advised Mr. Jackson that his chickens need to remain in his yard.
2. Sign: Voucher, North Village.
3. MINUTES: October 7, 2015
Mr. Demers made a motion to approve the October 7, 2015 Zoning Board of Appeals meeting minutes as presented. Mr. Bombara seconded the motion. Vote: Aye-4, Mr. Tusino abstained.

7:30 PM ADJOURNMENT:
Mr. Demers made a motion to adjourn the meeting at 7:30 PM. Mr. Bombara seconded the motion. Vote: Unanimous.
