CONSERVATION COMMISSION MEETING MINUTES
MONDAY, JANUARY 4, 2016

A meeting of the Conservation Commission was held on Monday, January 4, 2016. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:07 PM (NOI-DEP #143-0899) PUBLIC HEARING – 106 Walnut Street / HILL, JOHN
Ms. Brown opened the public hearing. Mr. Hill and Steve Dix joined the meeting. Mr. Dix stated that the addition to the home will be an in-law apartment (480 sq. ft.). The foundation will be 432 sq. ft. Mr. Zisk believes the original erosion control line is where the treeline is. A discussion was held.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0899) 106 Walnut Street, John Hill. Ms. Sharkey seconded the motion.
Mr. Zisk informed Mr. Hill to notify him to examine the erosion controls (straw wattles) before work begins.

7:15 PM (NOI-DEP #143-0892) PUBLIC HEARING CONTINUED-16 Cottage Colony/GUARANTEED BUILDERS & DEVELOPERS, INC.
Ms. Sharkey recused herself. Karen Keegan of Guaranteed Builders, Inc. joined the meeting. The applicant is looking to demolish the existing duplex residence and erect a single-family home with a proposed wood deck off the back. The proposed deck is 2.5 feet closer to water than the existing deck. The distance to the water from the new proposed deck is 40’. There are no stairs off the proposed deck. Five columns will be placed. There is an RDA approval for a well. Straw bales are indicated on the plan around the slurry pit, the stockpile area, the well and the entire lot. There will be no tree removal.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for NOI-DEP #143-0892, 16 Cottage Colony, Guaranteed Builders & Developers, Inc. Mr. Greco seconded the motion. Vote: Unanimous.

7:23 PM (RDA) PUBLIC MEETING – 283 Southwest Main Street / TOWN OF DOUGLAS
Ms. Brown opened the public meeting. Ms. Sharkey rejoined the meeting. William Cundiff, Town Engineer joined the meeting on behalf of the Building Inspector via the Safety Committee regarding poor sight distance while egressing the driveway at 283 Southwest Main. There is a tree that blocks the view to the east. The Safety Committee decided to ask Mr. Cundiff to file an RDA to see if the tree can be cut down. The Tree Warden had no issue with the tree being removed. The stump will be kept in place. The tree is 44’ from the closest wetland. The homeowner will remove sections of the fence adjacent to the tree to improve sight distance.
Ms. Van Roo made a motion to issue a negative RDA for 283 Southwest Main Street, Town of Douglas. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:30 PM (ANRAD-DEP #143-0898) PUBLIC HEARING CONTINUED – 229 Main Street / RILEY, ALLEN G.
Ms. Brown recused herself. Ms. Sharkey took over as Chairperson. The applicant has asked for a continuance.
Ms. Sharkey made a motion to continue the public hearing (ANRAD-DEP#143-0898) 229 Main Street, Allen G. Riley to February 1, 2016 at 7:30 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
Ms. Brown rejoined the meeting.

DISCUSSION:
1. FY17 Conservation Commission Budget: The budget is level funded. Ms. Van Roo made a motion to accept theFY17 Conservation Commission budget as presented. Ms. Sharkey seconded the motion. Vote: Unanimous.
2. Order of Conditions: Brian Specyalski, 56 Bigelow Road. Mr. Zisk will ask Maria Lajoie if the fine has been paid. The wall has been completed, but Mr. Zisk did not have pictures. The Order of Conditions will not be released until the fine has been paid.
3. Request for a Certificate of Compliance: Joyce Guiou, 81 Main Street (DEP #143-0869). Mr. Zisk stated that the shed has not been moved. A discussion was held.
Ms. Sharkey made a motion to issue a Certificate of Compliance for Joyce Guiou, 81 Main Street (DEP #143-0869). Ms. Van Roo seconded the motion. Vote: Unanimous.
4. Request for a Certificate of Compliance: Joshua Berube, 29 Colonial Road (DEP #143-0870). A discussion was held. It was decided that the members of the Commission would visit the site on their own time. Mr. Zisk will ask Ms. Lajoie to notify the property owners.

Approval of the October 5 and December 7, 2015 Conservation Commission meeting minutes was deferred to the next meeting.
The November 2, 2015 Conservation Commission meeting minutes were approved at the December 7, 2015 meeting.

7:45 PM (NOI-DEP #143-0897) PUBLIC HEARING CONTINUED – 50 Cedar Street / DUPONTE, CHARLES
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing, NOI-DEP #143-0897, 50 Cedar Street, Charles DuPonte to February 1, 2016 at 7:15 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

Ms. Van Roo made a motion to adjourn the meeting at 7:47 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
