CONSERVATION COMMISSION MEETING MINUTES
MONDAY, FEBRUARY 1, 2016

A meeting of the Conservation Commission was held on Monday, February 1, 2016. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:00 PM (NOI–DEP #143-0895) PUBLIC HEARING CONTINUED - 115 Ledgestone Road/STOCKWELL, DEBRA
Mr. and Mrs. Stockwell joined the meeting. The Zoning Board of Appeals (ZBA) made a decision. Mr. Stockwell brought a set of plans dated January 4, 2016.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for 115 Ledgestone Road, Debra Stockwell (DEP #143-0895), according to the plan dated 1/4/2016. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Van Roo abstained.
Mr. Stockwell stated that all the bales were in place.

DISCUSSION:
1. Request for a Certificate of Compliance: Thomas Tetreault, 203 Maple Street (DEP #143-0273). Mr. Zisk showed pictures of the wetland crossing off of Maple Street. No replication was proposed.
Ms. Van Roo made a motion to issue a Certificate of Compliance for Thomas Tetreault, 203 Maple Street (DEP #143-0273). Ms. Sharkey seconded the motion. Vote: Unanimous.
2. Annual Report. It was the consensus of the Commission to accept the Annual Report as presented.
3. Request for a Certificate of Compliance: Joshua Berube, 29 Colonial Road (DEP #143-0870). Ms. Van Roo has visited the site. The lawn is not established, channelization has occurred, and grass has been planted all the way out to the woodpile past the limit of disturbance. The driveway has not been paved. Ms. Van Roo suggested the Commission visit the site again in the spring. It was decided to place this item on the agenda for the first meeting in April and to schedule a site walk at that time.

7:15 PM (NOI-DEP #143-0897) PUBLIC HEARING CONTINUED – 50 Cedar Street /DUPONTE, CHARLES
Paul Hutnak of Heritage Design Group joined the meeting and presented revised plans. He reviewed Mr. Zisk’s letter and mentioned what has been changed since the site walk. He added a second sheet to the plan set showing the whole frontage of the property that was surveyed, the wetland system and endangered species line. There was no adverse impact found regarding endangered species. He honored the flood line of 663.
The erosion control line follows the outside edge of the cart path and comes up to the street where the driveway is. Mr. Hutnak stated that the barrier will be the project limit of work, and he added a second row of erosion control at the other edge of the cart path, around the proposed plantings, where the path widens. He proposed using the existing cart path as a temporary staging area during construction in order to access the site from below.
Two swings need to be removed, including their cement piers. Mr. Hutnak proposed walking a rubber-tracked mini-excavator to the site. Ms. Van Roo would like erosion controls placed on the other side of the cart path. A discussion was held.
The area of the “old beach” will not be disturbed. The oaks will remain and the hemlocks will be removed. Mr. Hutnak would like to remove a tree with dry rot that is in danger of falling. Ms. Van Roo argued that the tree not be removed because it can be used as an animal habitat and it would not fall on a structure, therefore it is not technically a safety hazard.
Mr. Hutnak submitted Field Data Forms. He described the design of the foundation drain that will daylight at the edge of the retaining wall. He will loam and seed the graded and disturbed areas. A stockpile area is not shown on the plans, but he can add it on the cart path. The plan changes are moving the erosion control barrier, cutting the dead oak to 8’-10’ instead of removing it, and taking the swings out prior to finishing the erosion control.
Ms. Sharkey made a motion to continue the public hearing, (NOI DEP #143-0897) 50 Cedar Street, Charles DuPonte to March 7, 2016 at 7:30 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:38 PM (ANRAD-DEP #143-0898) PUBLIC HEARING CONTINUED – 229 Main Street /RILEY, ALLEN G.
The applicant has asked for a continuance.
Ms. Sharkey made a motion to continue the public hearing (ANRAD-DEP #143-0898) 229 Main Street, Allen G. Riley to March 7, 2016 at 7:15 PM. Ms. Brown seconded the motion. Vote: Unanimous.

DISCUSSION (Cont.)
4. Gift of Land: Southeast Main Street. One section was removed from the original deed regarding who could use it. Town Counsel had no issue with the change. The land will be under the control of the Conservation Commission.
Ms. Sharkey made a motion accept the gift of land on Southeast Main Street. Ms. Van Roo seconded the motion. Vote: Unanimous.
5. Minutes: 10/5/15, 12/7/15, 1/4/16
Ms. Sharkey made a motion to approve the October 5, 2015 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Sharkey made a motion to approve the December 7, 2015 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to approve the January 4, 2016 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:45 PM (NOI-DEP #143-0900) PUBLIC HEARING – 81 Main Street /GUIOU, JOYCE
No one was at the meeting to present.

8:00 PM (NOI-DEP #143-0902) PUBLIC HEARING – 306 Northwest Main Street / BERNARD, KENNETH
Ms. Brown opened the public hearing. Eric Bazzett of Heritage Design Group joined the meeting and presented a revised plan addressing Mr. Zisk’s comments. Kenneth Bernard was also present. They have not yet filed with the ZBA; they have filed with the Board of Health and do not yet have their approval.
Mr. Bernard met with a well driller today. They propose to remove the existing house and then drive over it, using it as a road to get to the well. There may be a retaining wall; nothing over 4’ tall. Mr. Bazzett added an extra row of erosion control barriers: straw bales with silt fence. The Commission reviewed Mr. Zisk’s photos of the site. It was suggested that the applicant add reconstruction of the dismantled wall to the application. Mr. Bazzett and Mr. Bernard agreed.
According to Mr. Zisk’s comments, Mr. Bazzett modified the construction sequence to include demolition, an infiltration unit, filtration drain, and the septic system. They are planning to take out seven trees, leaving only five. The trees to be kept will be flagged. No new trees will be planted. The garage area will be used as a stockpile area. When the garage is being built, there will not be a stockpile.
The Commission asked that the reconstruction of the stone wall be done when the water is low, using native stone and no machinery is to be brought to the water’s edge. Mortar may be used.
Ms. Sharkey made a motion to continue the public hearing (NOI-DEP #143-0902), 306 Northwest Main Street, Kenneth Bernard to March 7, 2016 at 7:45 PM. Mr. Greco seconded the motion. Vote: Unanimous.

8:15 PM (AB.NOI-DEP #143-0901) PUBLIC HEARING – 56 Cedar Street / NADEAU, CHRISTOPHER & AMY
Ms. Brown opened the public hearing. Mike Yerka of Civil Site Engineering joined the meeting. Amy Nadeau was also present. Mr. Yerka stated that there is a Certificate of Compliance for an outstanding Order of Conditions for the driveway from when the house was built. Ms. Nadeau filed a formal request. Mr. Zisk took some photos. A small part of the driveway cuts through one of the flood plains.
Ms. Sharkey made a motion to issue a Certificate of Compliance for 56 Cedar Street, Christopher and Amy Nadeau for the driveway resurfacing. Ms. Van Roo seconded the motion. Vote: Unanimous.
The applicant is asking for an after-the-fact permit for 3” of fill with minimal encroachment into the flood plain. The shed was built without a Building Permit. The 35’ x 24’ sq. foot garage is on a slab. The house is currently for sale. A discussion was held.
Ms. Sharkey made a motion to issue an Order of Conditions for (NOI-DEP #143-0901), 56 Cedar Street, Christopher and Amy Nadeau. Ms. Van Roo seconded the motion. Vote: Unanimous.
Ms. Sharkey made a motion to issue a Certificate of Compliance (DEP #143-0901), 56 Cedar Street, Christopher and Amy Nadeau, once the Order of Conditions has been recorded and the 10-day appeal period has lapsed. Ms. Van Roo seconded the motion. Vote: Unanimous.
Ms. Sharkey made a motion to issue a violation with a $100 fine for the garage in the resource area at 56 Cedar Street, Christopher and Amy Nadeau. Ms. Van Roo seconded the motion. Vote: Unanimous.
Mr. Zisk will ask Maria Lajoie to email the Commission when the first Certificate of Compliance is ready to be signed.
