CONSERVATION COMMISSION MEETING MINUTES
MONDAY, MARCH 7, 2016

A meeting of the Conservation Commission was held on Monday, March 7, 2016. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:06 PM (RDA) PUBLIC MEETING - 86 Gilboa Street/BOWIE, BARBARA
Ms. Brown opened the public meeting. Ms. Bowie joined the meeting and stated that she would like to put in a gravel driveway. The contractor will grade and fill it. It will be 12’ wide, 10’ off the property line. Currently, there is only a right-of-way that goes behind three houses. Her vehicle often gets blocked in. The wetlands are across the street. The Commission reviewed the plans.
Ms. Brown read a letter from John Furno, Highway Superintendent which stated that he spoke with Ms. Bowie and advised her that he would need an engineered plan showing the proposed new driveway with the grades. Mr. Furno and the Commission are concerned about the slopes.
The Commission advised Ms. Bowie that she needs to file a Notice of Intent.
Ms. Van Roo made a motion for a positive RDA, 86 Gilboa Street, Barbara Bowie. Ms. Sharkey seconded the motion. Vote: Unanimous.
The Commission will send Ms. Bowie an official notice of their determination.

7:16 PM (ANRAD-DEP #143-0898) PUBLIC HEARING CONTINUED – 229 Main Street/RILEY, ALLEN G
Ms. Brown recused herself. Ms. Sharkey took over as Chairperson. Eric Bazzett of Heritage Design Group joined the meeting. He stated that Eco Tech and BFC reviewed the wetland line at the site. BFC wanted to see some minor changes to the wetland flags at the back end of the project. Mr. Bazzett presented a revised plan dated February 5, 2016. Mr. Zisk had no concerns.
Ms. Van Roo made a motion to close the public hearing and issue an ORAD for (ANRAD-DEP #143-0898) 229 Main Street, Allen G. Riley. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Brown rejoined the meeting.

OPEN SESSION:
Ms. Brown stated that she walked the Pine Street Conservation property. She noticed that the land where the parking easement is has been sold, and there is no reference to the easement on the deed. She presented a Grant of an Easement for the Commission, owner and the Board of Selectmen to sign.

7:30 PM (NOI-DEP #143-0897) PUBLIC HEARING CONTINUED – 50 Cedar Street/DUPONTE, CHARLES
Paul Hutnak of Andrews Survey & Engineering joined the meeting. He has addressed the comments from the last meeting and presented a revised plan. He added an erosion control construction sequence, noted that the dead oak tree is to be cut to a height of 8’-10’, and he expanded the erosion control barrier to be on the other side of the cart path. They will use silt fence and straw wattle as erosion controls. There will be a removable, floating dock.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0897) 50 Cedar Street, Charles DuPonte. Ms. Sharkey seconded the motion. Vote: Unanimous.
At 7:37 PM, the Commission called a 20 minute recess.

7:45 PM (NOI-DEP #143-0902) PUBLIC HEARING CONTINUED – 306 Northwest Main Street/BERNARD, KENNETH

Ms. Sharkey made a motion to continue the public hearing (NOI-DEP #143-0902) 306 Northwest Main Street, Kenneth Bernard to April 19, 2016 at 7:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Minutes: February 1, 2016
Ms. Sharkey made a motion to approve the February 1, 2016 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Unanimous.

8:00 PM (NOI-DEP #143-0903) PUBLIC HEARING – 61 Oak Street/DURAND, JEROMY
Ms. Brown opened the public hearing. Eric Bazzett of Heritage Design Group joined the meeting. Mr. Durand was also present. Mr. Bazzett stated that the applicant is proposing a single family house and a septic system. Mr. Bazzett revised the plan to reflect the wetland line for which the Commission had issued an ORAD. The plan now shows a deck, a proposed shed, a slurry pit, a stockpile area, and he labeled the erosion control line as the limit of disturbance.
The applicant would like to take down two large trees because they may be a threat to the house. Ms. Van Roo requested the height of the trees and the distance from the house.
Ms. Sharkey requested that the treeline be added to the plan. The Commission asked that the limit of clearing be staked. Mr. Zisk stated that The Permit Extension Act automatically extends the delineation of the wetlands line.
A site walk was scheduled for March 11, 2016 at 5:00 PM.
Ms. Sharkey made motion to continue the public hearing for (NOI-DEP #143-0903) 61 Oak Street, Jeromy Durand to March 21, 2016 at 7:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

8:19 PM (NOI-DEP #143-0900) PUBLIC HEARING – 81 Main Street/GUIOU, JOYCE
Ms. Brown opened the public hearing. Raouf Mankaryous from Alpha Omega Engineering joined the meeting. Mr. Mankaryous stated that the applicant currently has a septic leaching field 44’ from the road and 27’ from the wetland. They are proposing to install a new system 78’ away from the resource. 40% of the system will be outside the wetland 100’ buffer. They will be maintaining almost all the minimum setbacks. They will place erosion controls around the whole area. No trees will be taken down. They will not be stockpiling materials. The whole system is 9.5’ by 36’. The Board of Health has approved the plan.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0900) 81 Main Street, Joyce Guiou. Mr. Greco seconded the motion. Vote: Unanimous.

Ms. Van Roo made a motion to adjourn the meeting at 8:25 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
