MONDAY, MARCH 21, 2016

A meeting of the Conservation Commission was held on Monday, March 21, 2016. Ms. Brown called the meeting to order at 7:10 PM.

PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Stephen Zisk (Conservation Agent)
ABSENT: Brandi Van Roo (Excused)

7:10 PM (NOI-DEP #143-0903) PUBLIC HEARING – 61 Oak Street/DURAND, JEROMY
Eric Bazzett of Heritage Design Group and Mr. Durand joined the meeting. Mr. Bazzett stated that he amended the plan based on what was learned at the site walk last week. There was no evidence of wetlands other than what Eco Tech had flagged. The limit of disturbance line was revised to go straight over 90˚ to the wall, holding 25’ to the old wetland line to follow the old tree line. The limit of disturbance will be the limit of clearing.
They want to take down one rotted pine tree. There would be a temporary disturbance. They will be going beyond the erosion control for just that one tree. Mr. Durand plans to limb the tree, drop it and use a boom lift to take it out. Mr. Durand plans to clear only to the mature tree line.
Mr. Bazzett explained that the 50’ setback is for structures. Ms. Brown and Ms. Van Roo walked the site and were in agreement that there must be high ground water where the stream comes out of a well. Mr. Zisk recommended that they contact the person (Judy) that did the first delineation. Mr. Bazzett stated that they are staying at least 25’ from both wetland lines. Mr. Durand was agreeable to installing a fence to stop creep. A discussion was held regarding which wetland line to use.
Mr. Durand was asked to contact the Highway Dept. to find out what the culvert is for.
Mr. Zisk recommended that Mr. Durand stake the four turning points on the limit of disturbance. Mr. Bazzett and Mr. Durand were informed that the erosion controls need to be installed and approved by Mr. Zisk before any work can be done.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for NOI-DEP #143-0903, 61 Oak Street, Jeromy Durand. Mr. Greco seconded the motion. Vote: Unanimous.

7:28 PM (NOI-DEP #143-0904) PUBLIC HEARING – 14 Franklin Street, ORBISON CORP.
Ms. Brown opened the public meeting. Mike Yerka of Civil Site Engineering joined the meeting. He stated that the existing property has been divided into two lots. The house will be in the back of the retreat lot. The proposed driveway is the only thing that is in part of the buffer zone. They are proposing to pave the driveway. Municipal sewer, water and electric will be in the driveway right-of-way. The first 500’ are very flat. The Commission reviewed Mr. Zisk’s video of the site.
The existing shed is 4’-5’ from the proposed driveway. Mr. Yerka spoke about how they propose to grade the slope toward the wetlands and add vegetative swales with check dams.
Dan Heney of Orbison Corp. stated that the homeowners would like to pave 24’-26’ from the garage door and then leave the rest of the driveway gravel, except for the first 25’ in from Franklin Street. Ms. Sharkey suggested paving 60’ from the garage and 60’ in from the road.
Filtrexx socks will be used as erosion control. Mr. Zisk recommended a double row of erosion control.
The trees to be removed are outside the 50’ buffer. The old foundation will be taken out.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0904), 14 Franklin Street, Orbison Corp., with the condition that the driveway will be gravel, with the exception of paved areas no more than 12’ wide and 60’ from the roadway and 60’ from the garage. Mr. Greco seconded the motion. Vote: Unanimous.

1. Chapter 61A property/Right of First Refusal: Paula Brouillette, 247 Yew Street. Conservation land does not directly abut this property.
Ms. Sharkey made a motion to not recommend purchase of the property on 247 Yew Street to the Board of Selectmen. Mr. Greco seconded the motion. Vote: Unanimous.
2. Request for a Certificate of Compliance: KTKM Realty Trust, Cobblestone Lane, Lot #18 (DEP #143-0505). There was no form in the packet. This item will be placed on the next agenda.
3. Request for a Two-Year Extension for Order of Conditions: John Blatchford, 125 Walnut Street, Lot #2 (DEP #143-0773).
Ms. Sharkey made a motion to issue a Two-Year Extension to the Order of Conditions for John Blatchford, 125 Walnut Street, Lot #2 (DEP #143-0773). Mr. Greco seconded the motion. Vote: Unanimous.
4. Sign Voucher: BSC Group.
5. Minutes: March 7, 2016
Approval of the the March 7, 2016 Conservation Commission meeting minutes was deferred to the next meeting.

Mr. Zisk stated that the new soccer chairman would like to clear back to the stone walls at the VFW soccer fields. They plan to hand cut the saplings. Ms. Sharkey asked that the trees to be cut and the limit of disturbance be marked. A site walk may be necessary. Mr. Zisk will ask them to come to the April 4, 2016 meeting.
Mr. Zisk stated that the well they had put in to water the soccer fields has failed.

Ms. Sharkey made a motion to adjourn the meeting at 8:05 PM. Mr. Greco seconded the motion. Vote: Unanimous.
