CONSERVATION COMMISSION MEETING MINUTES
TUESDAY, MAY 3, 2016

A meeting of the Conservation Commission was held on Tuesday, May 3, 2016. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT: Michael Greco

7:05 PM (NOI-DEP #143-0907) PUBLIC HEARING – 42 Main Street, CARPENTER, ED
Ms. Brown opened the public hearing. Mr. Carpenter joined the meeting. He presented the plan. He is looking to build an addition to his home. The 100’ buffer is right on the corner of the existing structure. They are looking to extend 20’, 18’ wide. There is an existing paved driveway. A discussion was held.
Mr. Carpenter was asked to stake straw wattles along the right side, running up the east side of the driveway and wrapping around the north side of the proposed work. There is to be no stockpiling within the 100’ buffer. The erosion controls are to remain until the end of the project. Mr. Zisk will inspect before work begins.
The addition will have a full basement. All excavated materials will be taken off site.
Ms. Sharkey made a motion to continue the public hearing for 42 Main Street, Ed Carpenter to May 16, 2016 at 7:35 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:21 PM (RDA) PUBLIC MEETING – Various Town Roads, DOUGLAS
HIGHWAY DEPARTMENT
Ms. Brown opened the public meeting. William Cundiff, Town Engineer joined the meeting. He presented a map and described the work and locations proposed by the Highway Department. The paving work on Franklin Street will stop at the brook. There is no underground drainage or culvert work proposed. The Dudley Brook culvert replacement will be done at low flow and done in one day. The crack sealing can begin tomorrow. The remainder of the work will be done in the summer when it is dry.
Mr. Cundiff stated that historically, Mr. Zisk has walked the area with the Highway Superintendent to identify the critical areas and protect the areas with erosion controls.
Ms. Sharkey made a motion to issue a negative RDA for Douglas Highway Department. The culvert replacement on Southwest Main at Dudley Brook will have the same conditions as the culvert replacement done on South Street, and erosion controls in the sensitive areas. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:31 PM (NOI-DEP #143-0906) PUBLIC HEARING – 439 Northeast Main Street, 34 & 36 Davis Street / JMT SLEEPY HOLLOW, LLC & FITZPATRICK, JAMES
*Request for continuance
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Sharkey made a motion to continue the public hearing for 439 Northeast Main Street, 34 & 36 Davis Street, JMT Sleepy Hollow, LLC and James Fitzpatrick to May 16 at 7:30 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:32 PM (NOI-DEP #143-0902) PUBLIC HEARING CONTINUED – 306 Northwest Main Street / BERNARD, KENNETH
Eric Bazzett of Heritage Design Group joined the meeting. He presented copies of a revised plan. The existing distance to the bank is 38’. The closest point to the bank is 33’. Mr. Bazzett stated that they have Board of Health approval, and they go before the ZBA tomorrow night.
Ms. Sharkey made a motion to continue the public hearing for (NOI-DEP #143-0902) 306 Northwest Main Street, Kenneth Bernard to May 16, 2016 at 8:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Request for a Certificate of Compliance: KTKM Realty Trust, 23 Cobblestone Lane, Lot #17 (DEP #143-0856) (for Milford National Bank: Not associated with 19 Cobblestone Lane, Lot #39.2). Mr. Zisk stated that at the Registry of Deeds, Lot #17 has an Order of Conditions attached to it that is associated with Lot #19. Dan Heney joined the meeting. He said that the bank attorney has stated that all they need is a signed letter from the Conservation Commission stating that the Order of Conditions that was recorded in Book 51490, Page 311 does not affect Lot #17.
Ms. Van Roo made a motion that the Conservation Commission sign the letter indicating that Lot #17 is separate from the rest of the subdivision. Ms. Sharkey seconded the motion. Vote: Unanimous.
2. Sign: Keevan/Chartier, 41 Pine Street: Grant of Easement (Parking Easement). Ms. Brown stated that the Board of Selectmen and the owners of the lot have signed the easement.
3. Request for a Certificate of Compliance / Schedule Site Walk: Joshua Berube, 29 Colonial Road (DEP #143-0870). Ms. Brown presented photos of the site, which she took on Monday. It has been paved. On both sides, there is straw on top of loose dirt. The site is not established. The residents have moved into the house. It was the consensus of the Commission to have Ms. Lajoie send a letter stating that the lawn is not established.
4. Request for (3-Year) Extension for Order of Conditions: Eveningside Realty Trust, Conservation Drive, Lot #11R (DEP #143-0703). Mr. Zisk stated that they are allowed three years of extension and the Permit Extension act gave four years. This is the tenth year. A letter has been written to Henry asking for clarification on how they can grant another extension. Mr. Zisk recommended discussing this again at the next meeting.
5. Request for an Extension for Order of Conditions: Jackson Song, 209 South Street (DEP #143-0735) (Evergreen Estates). Mr. Zisk stated that this is the same scenario as #4 above. An extension was granted last September. The subdivision should be completed by September, 2016.
Ms. Sharkey made a motion to grant the Extension for the Order of Conditions for Jackson Song, 209 South Street (DEP #143-0735). Ms. Van Roo seconded the motion. Vote: Unanimous.
6. Request for a Certificate of Compliance: David L’Heureux, 144 Southeast Main Street. Mr. Zisk presented photos of the site. The site is well established.
Ms. Sharkey made a motion to issue the Certificate of Compliance for David L’Heureux, 144 Southeast Main Street. Ms. Van Roo seconded the motion. Vote: Unanimous.
7. Minutes: March 21, 2016 and April 4, 2016
Approval of the March 21, 2016 and April 4, 2016 Conservation Commission meeting minutes was deferred to the next meeting.

7:50 PM (NOI-DEP #143-0905) PUBLIC HEARING – 208 Yew Street /
GUARANTEED BUILDERS & DEVELOPERS
Ms. Sharkey recused herself. There was not a quorum available and the hearing was not opened.
It was decided to reschedule the public hearing for May 16, 2016 at 8:15 PM.

7:53 PM ADJOURNMENT:
Ms. Van Roo made a motion to adjourn the meeting at 7:53 PM. Ms. Brown seconded the motion. Vote: Unanimous.
