CONSERVATION COMMISSION MEETING MINUTES
MONDAY, JUNE 6, 2016

A meeting of the Conservation Commission was held on Monday, June 6, 2016. Ms. Brown called the meeting to order at 7:01 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Stephen Zisk (Conservation Agent)
ABSENT: Brandi Van Roo (Excused)

DISCUSSION:
1. Scott Morris: 145 Southeast Main Street, Reclamation Area (DEP #143-0879). Scott and Kimberly Morris joined the meeting and presented some photos. Ms. Morris stated that they had to make a wetlands crossing when they first bought their property. They built a bridge and culvert to go over the stagnant, intermittent stream. As the trench was being dug, it immediately started filling with water. It was suggested they dig a trench to the runoff area. That did not affect the water level. It drained about a foot, but never completely dried out. The trench started to fill with tadpoles. They believe they are wood frogs and they return to the same place they were born to lay their eggs. Their wetland scientist recommended creating a pond and not to plant anything in the area. A discussion was held.
Ms. Sharkey made a motion to accept the formation of a pond as an alternative to replication as a minor change to the Order of Conditions for Scott Morris, 145 Southeast Main Street (DEP #143-0879). Mr. Greco seconded the motion. Vote: Unanimous.
2. Chapter 61A: Susan Mosczynski, off Oak Street (2.08 acres) Map 132, Parcel 1 (Lot 2R) Right of First Refusal: This parcel does not abut any Conservation land.
Ms. Sharkey made a motion to recommend to the Board of Selectmen to not exercise the Right of First Refusal for Susan Mosczynski, off Oak Street (2.08 acres) Map 132, Parcel 1 (Lot 2R). Mr. Greco seconded the motion. Vote: Unanimous.
3. Request for a Certificate of Compliance: Joshua Berube, 29 Colonial Road (DEP #143-0870). Ms. Brown took some photos of the area today.
Ms. Sharkey made a motion to issue a Certificate of Compliance for Joshua Berube, 29 Colonial Road (DEP #143-0870). Mr. Greco seconded the motion. Vote: Unanimous.
4. Request for a Certificate of Compliance: David L’Heureux, 144 Southeast Main Street (DEP #143-0641). Mr. Zisk stated that this was approved at the last meeting.
Ms. Sharkey made a motion to issue a Certificate of Compliance for David L’Heureux, 144 Southeast Main Street (DEP #143-0641). Mr. Greco seconded the motion. Vote: Unanimous.
5. Request for a Certificate of Compliance: David Perry, 734 Northwest Main Street (DEP #143-0543). Mr. Zisk presented photos. The file shows that the replication area has become overgrown. A discussion was held.
Ms. Sharkey made a motion to issue a Certificate of Compliance for David Perry, 734 Northwest Main Street (DEP #143-0543). Mr. Greco seconded the motion. Vote: Unanimous.
6. Request for a Certificate of Compliance: Andrea Flynn and Thomas Hughes, 723 Northwest Main Street (DEP #143-0440). Mr. Zisk presented photos. A discussion was held.
Ms. Sharkey made a motion to issue a Certificate of Compliance for Andrea Flynn and Thomas Hughes, 723 Northwest Main Street (DEP #143-0440). Mr. Greco seconded the motion. Vote: Unanimous.
7. Request for an Extension of Order of Conditions: Edward Whipple, 88 West Street (DCC-04).
Ms. Sharkey made a motion to grant the extension to the Order of Conditions for Edward Whipple, 88 West Street (DCC-04). Mr. Greco seconded the motion. Vote: Unanimous.
8. Planning Board Application: Richard Lamoureux, 144 North Street (Accessory Apartment Special Permit). There are no wetlands. The Commission had no objection.
9. Planning Board Application: Dolores Cyr and Jean Nugent, 74 Pond Street (Accessory Apartment Special Permit). There are no wetlands. The Commission had no objection.
10. Minutes: March 21, April 4, May 3, and May 16, 2016.
Approval of the above Conservation Commission Meeting minutes was deferred to the next meeting.

7:15 PM (NOI-DEP #143-0907) PUBLIC HEARING CONTINUED: 42 Main Street, CARPENTER, ED
Mr. Zisk stated that Mr. Carpenter installed silt fence and buried it and wondered if this was acceptable to the Commission as erosion control. Mr. Carpenter joined the meeting. He stated that he was unable to get straw wattles. He put in silt fence and staked hay bales on top. Ms. Brown stated that he cannot have hay bales. Mr. Carpenter corrected to say he staked straw bales. He stated that his plot plan was accurate.
Ms. Brown stated that the silt fence looks like it is falling down. The edge of the proposed construction is 80’ feet from the edge of the wetland. All the excavated material will be placed in a truck and taken off site. It was the decision of the Commission that Mr. Carpenter needs to stake straw wattles or stake straw bales in front of the silt fence. Mr. Zisk needs to be called before construction begins.
Ms. Sharkey made a motion to issue an Order of Conditions for 42 Main Street, Ed Carpenter (DEP #143-0907). Mr. Greco seconded the motion. Vote: Unanimous.

7:46 PM (NOI-DEP #143-0905) PUBLIC HEARING CONTINUED: 208 Yew Street, GUARANTEED BUILDERS & DEVELOPERS
Ms. Brown opened the public meeting. Ms. Sharkey recused herself, leaving only two voting members.
Mr. Greco made a motion to continue the public hearing (NOI-DEP #143-0905) Guaranteed Builders & Developers, 208 Yew Street to June 20, 2016 at 7:15 PM. Ms. Brown seconded the motion. Vote: Unanimous.
Ms. Sharkey rejoined the meeting.

7:47 PM (NOI-DEP #143-) PUBLIC HEARING: 76 Cedar Street, QUINTAL, HEATH & NICOLE
Ms. Brown opened the public hearing. Mike Yerka of Civil Site Engineering joined the meeting. Mr. Yerka stated that the applicants are looking to raze the three bedroom cottage on the site and construct a three bedroom house with a larger footprint and a well. They are within the 100’ wetland buffer. The septic is existing and is rated for three bedrooms. The Commission reviewed the photos of the site. The Commission asked that trees to be removed be put on the plan. A stockpile area should be noted on the plan as well.
Mark Mungeam, 20 Depot Street asked about the footprint of the new building. He viewed the plans.
Joe Quintal, 80 Cedar Street stated that the property has been in the family for 100 years. He has no objections to the plan.
Ms. Sharkey made a motion to continue the public hearing, 76 Cedar Street, Heath and Nicole Quintal to June 20, 2016 at 7:45 PM. Mr. Greco seconded the motion. Vote: Unanimous.

8:00 PM (NOI-DEP #143-) PUBLIC HEARING: 4 Summer Court, BLOEM, STEVE
Ms. Brown opened the public hearing. Travis Brown of Andrews Survey and Engineering joined the meeting to present the plan. This is an existing two bedroom home on Manchaug Pond. The septic tank has failed. They are proposing to put in a new system within the 100’ buffer. The plan has been approved by the Board of Health. Some trees will need to be cut, including three large pines by the water. There are 12 trees within the buffer zone to be cut. The stockpile will be outside the buffer, and it needs to be noted on the plan. The Commission asked that all 12 trees to be cut be flagged.
A site walk was scheduled for June 9, 2016 at 5:15 PM.
Ms. Sharkey made a motion to continue the public hearing, 4 Summer Court, Steve Bloem to June 20, 2016 at 7:50 PM. Mr. Greco seconded the motion. Vote: Unanimous.

OPEN SESSION:
Mr. Zisk was informed by the School Dept. that they want to perform maintenance on the detention ponds at the high school. The Commission had no objection.
Mr. Zisk will inspect the soccer fields.

8:11 PM ADJOURNMENT:
Ms. Sharkey made a motion to adjourn the meeting at 8:11 PM. Mr. Greco seconded the motion. Vote: Unanimous.
