CONSERVATION COMMISSION MEETING MINUTES
MONDAY, JUNE 20, 2016

A meeting of the Conservation Commission was held on Monday, June 20, 2016. Ms. Brown called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:00 PM (NOI-DEP #143-0906) PUBLIC HEARING – 439 Northeast Main Street, 34 & 36 Davis Street / JMT SLEEPY HOLLOW, LLC & FITZPATRICK, JAMES
*Request for continuance
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Sharkey made a motion to continue the public hearing for 439 Northeast Main Street, 34 & 36 Davis Street, JMT Sleepy Hollow, LLC and James Fitzpatrick to July 18, 2016 at 7:15 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
Jeremy Flansburg, 63 Monroe Street asked if the Planning Board needed to make a decision before the Conservation Commission makes a decision. Ms. Brown stated that the Planning Board’s input is not required. Mr. Zisk replied that typically, if one board is satisfied before the other, the engineer should keep both hearings open until both boards are satisfied. The order of the decisions does not matter.

7:15 PM (NOI-DEP #143-0905) PUBLIC HEARING CONTINUED: 208 Yew Street, GUARANTEED BUILDERS & DEVELOPERS
Ms. Sharkey recused herself. Karen Keegan of Guaranteed Builders joined the meeting. Since the site walk, she has revised the plan. She has proposed a 42’ long, 24” corrugated pipe in lieu of the open box culvert with 4’-deep cement footings under the driveway area. The pipe would sit on crushed stone. She feels this would be less of an impact on the wetlands. Stone gabions (2’ x 4’) would be placed.
Ms. Van Roo stated that the culvert would have provided an appropriate substrate for the wildlife. She stated that the culvert would offer more short-term disturbance, but long-term advantages for wildlife over the pipe option. A discussion was held. Ms. Brown suggested asking for a recommendation on the crossing from an outside consultant and have them check flags, 17, 18, 19 and 21.
Ms. Keegan will correct the scale on the plan.
Ms. Van Roo made a motion to continue the public hearing (NOI-DEP #143-0905) Guaranteed Builders & Developers, 208 Yew Street to July 18, 2016 at 7:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Sharkey rejoined the meeting.

7:35 PM MassDOT WEBSTER STREET HIGHWAY SAFETY IMPROVEMENT PROJECT, Kimberly Peace, Hoyle, Tanner & Associates, Inc.
Ms. Brown opened the public hearing. Kimberly Peace and Todd Clark of Hoyle, Tanner & Associates and Tim Dexter of MassDOT Environmental joined the meeting. Mr. Dexter gave a history of the project. This section of Rte. 16 has a history of bad accidents. Highway improvement funding is available. Headwall replacement at 16 locations will have minimal wetland impact, however this part of the project may be removed. Mitigation will be pooled at one site.
Ms. Peace reviewed the plan for the four-mile stretch. The culverts are all stable, however the headwalls are crumbling. The replication area is 600 sq. ft. The Commission reviewed the plans. The Commission asked that the plantings be added to the plan, including species and numbers. Mr. Dexter stated that he can email a revised plan to Mr. Zisk tomorrow.
Ms. Van Roo made a motion to close the public hearing and issue the Order of Conditions for MassDOT Webster Street Highway Safety Improvement Project, Kimberly Peace, Hoyle, Tanner & Associates, Inc. with the condition that the final plan is submitted with the plant names and numbers, verified by Steve Zisk. Mr. Zisk will change the plan date to 6/21/16. Ms. Sharkey seconded the motion. Vote: Aye-3, Ms. Brown abstained.

7:57 PM (NOI-DEP #143-0908) PUBLIC HEARING CONTINUED: 76 Cedar Street, QUINTAL, HEATH & NICOLE
Mike Yerka of Civil Site Engineering joined the meeting and presented the revised plan. The client will replace one tree with a few maples. The Commission reviewed a video of the site.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0908) 76 Cedar Street, Heath and Nicole Quintal. Mr. Greco seconded the motion. Vote: Unanimous.

8:02 PM (NOI-DEP #143-0909) PUBLIC HEARING CONTINUED: 4 Summer Court, BLOEM, STEVE
Travis Brown of Andrews Survey and Engineering joined the meeting and presented the plan. They are proposing to keep the two trees by the water. They would still like to cut the tree in the corner that is leaning over the house. The stockpile area will be outside the buffer zone.
They would also like to remove the pine with woodpecker holes near the force main that they claim is leaning over the house. Mr. Bloem stated that the tree is full of black ants. A discussion was held. The Commission asked that that tree not be removed. If it causes a problem relating to the installation of the main it may be removed, however Mr. Zisk would need to be contacted first.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0909) 4 Summer Court, Steve Bloem with the condition that the above said pine with woodpecker activity circled on the plan is left. Ms. Sharkey seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Received a letter dated 6/14/16 from Christopher Scott of 89 Manchaug Street offering to maintain the conservation land abutting him. Mr. Scott joined the meeting. Ms. Van Roo stated that the only time the Commission would allow the field to be cut is in October and the blade height needs to be 7” or higher. Mr. Zisk stated that the Town usually pays for fuel, however Mr. Scott would need to submit a bill. Mr. Scott will call the Commission in October.
2. Request for a Certificate of Compliance: Joyce Guiou, 81 Main Street. The Commission reviewed a video of the site.
Ms. Sharkey made a motion to issue a Certificate of Compliance for Joyce Guiou, 81 Main Street. Mr. Greco seconded the motion. Vote: Unanimous.
3. Minutes: March 21, April 4, May 3, May 16, and June 6, 2016.
Approval of the above Conservation Commission Meeting minutes was deferred to the next meeting.

8:20 PM ADJOURNMENT:
Ms. Sharkey made a motion to adjourn the meeting at 8:20 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
