CONSERVATION COMMISSION MEETING MINUTES
MONDAY, JULY 18, 2016

A meeting of the Conservation Commission was held on Monday, July 18, 2016. Ms. Brown called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

DISCUSSION:
1. Reorganization: Ms. Sharkey made a motion to nominate Linda Brown as Chairman of the Conservation Commission. Ms. Van Roo seconded the motion. Vote: Unanimous.
Ms. Brown made a motion to nominate Tracy Sharkey as Vice Chairman of the Conservation Commission. Ms. Van Roo seconded the motion. Vote: Unanimous.
2. Violation Notice: Joseph Lafrance, 12 Gilboa Court. Mr. Zisk stated that some neighbors complained about materials in Mr. Lafrance’s backyard. It was a small pile of stones. There has been a second complaint. Mr. Lafrance joined the meeting and stated that the back side of the pool has been washing out, and he has spread some stone to help remedy the problem. There is a stream on the other side of the property. A discussion was held regarding following up on complaints/violations and whether or not the disturbance is within the buffer. Ms. Brown feels that the area of disturbance is within the buffer.
Ms. Van Roo was concerned that the pile of dirt could wash into the wetland. Mr. Lafrance plans to seed the area. He stated that he spread fill over the lawn, not excavated.
A site walk was scheduled for Thursday, July 21 at 5:30 PM.
Paula Richard, 2 Gilboa Court asked if the fill is clean. She saw six large trucks. She stated that the brook is very close to Mr. Lafrance’s property. Mr. Lafrance stated that those trucks did not dump at his house.
3. Request for Extension Permit for Order of Conditions: Robert Miller, 115 Shore Road (DEP #143-0841). Mr. Miller joined the meeting. The original design engineer would not respond to Mr. Miller’s phone calls. Jim O’Malley of the Board of Health told Mr. Miller that he could not change design engineers in the middle of the project. Mr. Miller received State approval to change engineers, however he had to have a new design done. In January, 2016 Mr. Malley signed off on the new plan, but the DEP number expired in November, 2015. The Commission reviewed the new plan. A discussion was held.
It was the consensus of the Commission that Mr. Miller needs to re-file.
4. Request for a Certificate of Compliance: Kenneth Candito, 128 Northwest Main Street (DEP #143-0890). Mr. Candito joined the meeting. The Commission reviewed photos of the site.
Ms. Sharkey made a motion to issue a Certificate of Compliance for Kenneth Candito, 128 Northwest Main Street (DEP #143-0890). Mr. Greco seconded the motion. Vote: Unanimous.
Mr. Candito complimented Mr. Zisk on his work during this project.
5. Request for a Certificate of Compliance: KTKM Realty Trust, 8 Meetinghouse Lane, Lot #28 (DEP #143-0855). The Commission reviewed photos of the site.
Ms. Sharkey made a motion to approve the Certificate of Compliance for KTKM Realty Trust, 8 Meetinghouse Lane, Lot #28 (DEP #143-0855). Mr. Greco seconded the motion. Vote: Unanimous.
6. Hatch Mott MacDonald: Tennessee Gas Pipeline, Rhode Island Lateral-Vegetation Maintenance Program. Hatch Mott MacDonald is claiming exemption. A discussion was held. Mr. Zisk will ask Town Counsel if they can claim exemption from Town bylaws.
7. Sign Voucher.
8. Minutes: March 21, April 4, May 3, May 16, June 6, and June 20, 2016.
Approval of the above Conservation Commission Meeting minutes was deferred to the next meeting.

7:41 PM (NOI-DEP #143-0906) PUBLIC HEARING – 439 Northeast Main Street, 34 & 36 Davis Street / JMT SLEEPY HOLLOW, LLC & FITZPATRICK, JAMES
*Request for continuance
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing for 439 Northeast Main Street, 34 & 36 Davis Street, JMT Sleepy Hollow, LLC and James Fitzpatrick to August 15, 2016 at 7:00 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
Jeremy Flansburg, 63 Monroe Street stated that the Planning Board has stated that the applicant cannot extend past September 15. He asked if the same policy applied to the Conservation Commission. Ms. Brown stated that it does not. Ms. Sharkey stated that the applicant granted the Planning Board an extension for their decision.

7:43 PM (NOI-DEP #143-0905) PUBLIC HEARING CONTINUED: 208 Yew Street, GUARANTEED BUILDERS & DEVELOPERS
Mr. Zisk stated that he will be reviewing the site tomorrow.
Ms. Van Roo made a motion to continue the public hearing (NOI-DEP #143-0905) Guaranteed Builders & Developers, 208 Yew Street to August 1, 2016 at 7:15 PM. Mr. Greco seconded the motion. Vote: Unanimous.

8:00 PM ADJOURNMENT:
Ms. Sharkey made a motion to adjourn the meeting at 8:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
