CONSERVATION COMMISSION MEETING MINUTES
MONDAY, MAY 16, 2016

A meeting of the Conservation Commission was held on Monday, May 16, 2016. Ms. Brown called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman-arrived 7:15 PM), Brandi Van Roo
ABSENT: Stephen Zisk (Conservation Agent)

7:00 PM MassDOT WEBSTER STREET HIGHWAY SAFETY IMPROVEMENT PROJECT, Kimberly Peace, Hoyle, Tanner & Associates, Inc.
Ms. Peace joined the meeting. She is the Environmental Coordinator for Hoyle, Tanner & Associates. Steve Haas, Senior Transportation Engineer also joined the meeting. Mr. Haas explained the resurfacing project and related work for Webster Street and Rte. 16. There will also be signage and guardrail upgrades. The goal is to make safety improvements. There will be no property takings or easements. They plan to replace the closed drainage structures. The culvert’s upstream headwalls are in poor condition and will be replaced as part of the project. Culvert replacement is not proposed.
Trees that overhang the road will be limbed 10’ off the pavement on both sides. Sick trees will be removed.
Ms. Peace stated that there are 19 locations of temporary or permanent wetland impacts and all are within the right-of-way. There are two riverfront areas. They plan to replace the headwalls. Each of the downstream areas will have stone rip rap area to stabilize. MassDOT is preparing a replication plan to replicate 500 sq. ft. and it will be submitted as part of the Notice of Intent. There will be a public hearing after they submit the NOI to go over these impacts. On June 8, 2016 there will be a public informational meeting. Bidding is anticipated by September, 2016. Work would not likely begin until summer 2017.
All of the Douglas forest is considered priority habitat. The Mass. Endangered Species Program has agreed to give them a No Take letter. Ms. Peace stated that MassDOT is exempt from local bylaws and abutter notification.
Ms. Van Roo asked about the possibility of critter crossings. Ms. Peace spoke about the legal complications involved with critter crossings.

7:30 PM (NOI-DEP #143-0906) PUBLIC HEARING – 439 Northeast Main Street, 34 & 36 Davis Street / JMT SLEEPY HOLLOW, LLC & FITZPATRICK, JAMES

Ms. Brown stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing for 439 Northeast Main Street, 34 & 36 Davis Street, JMT Sleepy Hollow, LLC and James Fitzpatrick to June 20, 2016 at 7:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:45 PM (NOI-DEP #143-0907) PUBLIC HEARING – 42 Main Street, CARPENTER, ED
Ms. Brown opened the public hearing. Ms. Sharkey stated that William Cundiff, Town Engineer, forwarded an email memo today from Mr. Carpenter which included pictures. The email said that Mr. Carpenter installed erosion controls: silt fence and straw wattles. Ms. Brown and Ms. Van Roo did not see the email. Mr. Carpenter is out of Town.
Ms. Sharkey made a motion to continue the public hearing for 42 Main Street, Ed Carpenter to June 6, 2016 at 7:15 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

8:00 PM (NOI-DEP #143-0902) PUBLIC HEARING CONTINUED – 306 Northwest Main Street / BERNARD, KENNETH
Eric Bazzett of Heritage Design Group joined the meeting. He stated that the ZBA has approved the plan. Mr. Bernard was also present.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0902) 306 Northwest Main Street, Kenneth Bernard. Ms. Sharkey seconded the motion. Vote: Unanimous.
Ms. Sharkey left the meeting.

8:15 PM (NOI-DEP #143-0905) PUBLIC HEARING – 208 Yew Street /
GUARANTEED BUILDERS & DEVELOPERS
Ms. Brown opened the public hearing. Karen Keegan of Guaranteed Builders joined the meeting. They are proposing a single house on a 30-acre lot in the back. There will be a 12’ gravel driveway. To gain access, they need to cross over some wetlands, run the driveway along the stone wall and turn it in towards where the house will be. They are proposing two 12” corrugated pipes 32’ long with rip rap collars on both ends to be placed at the existing elevation. The stockpile area will be in the front. Siltation fence and straw wattles will run all the way along the edge along the buffer area on both sides.
Ms. Van Roo asked to see the detail on the shape of the culvert. Ms. Keegan has not calculated the amount of fill that will be used in the wetlands. The replication area is 1.5 times the size of the disturbance. The percentage of lot disturbance is 5%. The septic system has been approved by the Board of Health.
The Commission would like a barrier to make sure there is no sheet flow from the driveway.
A site walk was scheduled for May 20, 2016 at 5:30 PM.
Ms. Van Roo made a motion to continue the public hearing, (NOI-DEP #143-0905) Guaranteed Builders & Developers, 208 Yew Street to June 6, 2016 at 7:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Joshua Berube, 29 Colonial Road-Request for a Certificate of Compliance (DEP #143-0870). Ms. Brown took more photos on Friday. A man and his daughter joined the meeting. Ms. Brown stated that she has gone out to the site on three occasions and two areas have been disturbed and the vegetation is not established. The man stated that he put down 3” of screened loam and hydro mousse after the driveway was paved. The property has been sold and they no longer have any control over what is done on the property. The Commission asked the pair to come back to them once the vegetation is established.
2. Request for a Certificate of Compliance: David L’Heureux, 144 Southeast Main Street. This Certificate was issued at the May 3, 2016 meeting.
3. Request for a Certificate of Compliance: David Perry, 734 Northwest Main Street (DEP #143-0543). There was no discussion.
4. Request for 2-Year Extension for Order of Conditions: John Blatchford, 125 Walnut Street, Lot 2 (DEP #143-0786). Ms. Sharkey made a motion to grant a two-year extension for the Order of Conditions for John Blatchford, 125 Walnut Street, Lot 2 (DEP #143-0786). Mr. Greco seconded the motion. Vote: Unanimous.
5. Minutes: March 21, 2016 and April 4, 2016
Approval of the March 21, 2016 and April 4, 2016 Conservation Commission meeting minutes was deferred to the next meeting.

8:26 PM ADJOURNMENT:
Ms. Van Roo made a motion to adjourn the meeting at 8:26 PM. Mr. Greco seconded the motion. Vote: Unanimous.
