CONSERVATION COMMISSION MEETING MINUTES
MONDAY, OCTOBER 17, 2016

A meeting of the Conservation Commission was held on Monday, October 17, 2016. Ms. Brown called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman-arrived 7:06 PM), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:00 PM (NOI-DEP #143-0906) PUBLIC HEARING CONTINUED: 439 Northeast Main Street, 34 & 36 Davis Street/JMT SLEEPY HOLLOW, LLC & FITZPATRICK, JAMES.
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Van Roo made a motion to continue the public hearing, (NOI-DEP #143-0906) 439 Northeast Main Street, 34 & 36 Davis Street/JMT Sleepy Hollow, LLC & Fitzpatrick, James to November 7, 2016 at 7:00 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:13 PM (NOI-DEP #143-0916) PUBLIC HEARING: 251 Yew Street, Lot #2/ORBISON CORP.
Ms. Brown opened the public hearing. Mike Yerka of Civil Site Engineering joined the meeting. He stated that the applicant is proposing to build a four bedroom house with a septic system and an in-ground pool with a proposed fence. They are within the buffer zone of the BVW. The septic and most of the house are outside the 100’ buffer. The septic has been approved by the Board of Health. The work in the 50’ buffer would be for the deck, the pool and the well. The Commission asked that the erosion controls be 5’ off the proposed fence line. Mr. Yerka agreed.
Tony St. Pierre, 45 Fairbanks Court asked why builders are allowed to purchase wetlands when there are many houses for sale in Douglas. Ms. Brown stated that the applicants are following the law. Mr. Yerka explained the 100’ wetland buffer.
Mary St. Pierre, 45 Fairbanks Court asked if the wetlands and wells would be affected. Mr. Yerka stated that they are not going to encroach or fill the wetland. Mr. Yerka and Ms. Van Roo clarified that if the owners of the property raked debris into the wetland, they would be fined.
The Commission asked for a revised plan to show the new limit of disturbance.
Ms. Sharkey made a motion to continue the public hearing (NOI-DEP #143-0916) 251 Yew Street, Lot #2, Orbison Corp. to November 7, 2016 at 7:30 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:30 PM (NOI-DEP #143-0915) PUBLIC HEARING: Cobblestone Lane, #15A/ TESSIER, SCOTT.
Ms. Brown opened the public hearing. Michael Hassett of Guerriere and Halnon joined the meeting. Ms. Brown informed Mr. Hassett that they will need a copy of the ad. The applicant is proposing constructing a single family home within 100’ of wetlands. The wetlands are 43.8’ from the closest point of tree clearing. The erosion control line will be the limit of clearing. There is a proposed slurry pit with erosion control located next to the well. A foundation drain is now shown on the plan. There were no comments from DEP. The Board of Health has not yet approved the septic. It will be a condition of the Order of Conditions that a stockpile be outside the 100’ buffer zone.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0915) Cobblestone Lane, #15A, Scott Tessier with the condition that the stockpile be outside the 100’ buffer zone. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:45 PM (NOI-DEP #143-0914) PUBLIC HEARING CONTINUED: 115 Shore Road/MILLER, ROBERT.
Bob Miller joined the meeting. He is looking for a new Order of Conditions. No trees have been removed.
Diane Miller, 115 Shore Road stated that they planted the witch hazel bushes a couple years ago. The applicants were informed that they need to file the Certificate of Compliance for DEP #143-0841 before they can file the new Order of Conditions.
Ms. Van Roo made a motion to close public hearing and issue an Order of Conditions for (DEP NOI #143-0914) 115 Shore Road, Robert Miller. Ms. Sharkey seconded the motion. Vote: Unanimous.

8:00 PM (NOI-DEP #143-0913) PUBLIC HEARING: 12 Gilboa Court/LaFRANCE, JOSEPH.
Ms. Brown opened the public hearing. Mr. LaFrance joined the meeting. He will install a wire fence at the edge of what has already been cleared. The skunk cabbage is along the woodland edge. Erosion controls have been installed. He will not have stockpiles.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0913) 12 Gilboa Court, Joseph LaFrance. Ms. Sharkey seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Burrillville Conservation Commission: Proposed power plant. Ms. Van Roo did not see any direct impacts to Douglas nor anything in the Commission’s jurisdiction.
2. Request for a Certificate of Compliance: Robert Miller, 115 Shore Road (DEP #143-0841). Mr. Zisk stated that Mr. Miller originally came in for a septic system for his house. The permit lapsed, the work was not finished, so he re-filed. Since there cannot be two DEP numbers for the same project, a Certificate of Compliance needs to be issued for this DEP number.
Ms. Van Roo made a motion to issue a Certificate of Compliance for Robert Miller, 115 Shore Road (DEP #143-0841). Mr. Greco seconded the motion. Vote: Unanimous.
3. Request for a Certificate of Compliance: Gary Kidd, 8 Main Street (DEP #143-0447). The Commission reviewed a video taken by Mr. Zisk, the Order of Conditions, and the Notice of Intent.
Ms. Van Roo made a motion to issue a Certificate of Compliance for Gary Kidd, 8 Main Street (DEP #143-0447). Ms. Sharkey seconded the motion. Vote: Unanimous.
4. 2017 Meeting Schedule. Ms. Sharkey made a motion to accept the 2017 Conservation Commission Meeting Schedule as written. Mr. Greco seconded the motion. Vote: Unanimous.
5. Request for Project Review/Accessory Apartment Application: Brian & Brenda Wilcox, 125 Perry Street. This is an existing house with a proposed addition. The addition would be 30’ away from the resource area. It was the consensus that the applicant needs to file with the Commission.
6. Request for Project Review/Earth Removal Application: Pyne Sand & Stone Company & Estate of Harry Bedoian, Gilboa Street. It was the consensus that the applicant needs to file with the Commission.
7. Minutes: September 19 and October 3, 2016.
Approval of the above meeting minutes was deferred to the next meeting.

OPEN SESSION:
Extension Permit: Order of Conditions, Richard and Debra Morris, 79 Mumford Street. The crossing was done, but the replication was never completed. Mr. Zisk will get more information.
Certificate of Compliance: 355 Southwest Main Street, Michael Ballou. There was no discussion.
Gordon Andrade of 50 Cedar Street was in the audience regarding a change to plans making a detached garage an attached garage. Mr. Zisk has not heard from Paul Hutnak.

Ms. Van Roo made a motion to adjourn the meeting at 8:21 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.
