CONSERVATION COMMISSION MEETING MINUTES
MONDAY, NOVEMBER 7, 2016

A meeting of the Conservation Commission was held on Monday, November 7, 2016. Ms. Brown called the meeting to order at 7:00 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:00 PM (NOI-DEP #143-0906) PUBLIC HEARING CONTINUED: 439 Northeast Main Street, 34 & 36 Davis Street/JMT SLEEPY HOLLOW, LLC & FITZPATRICK, JAMES.
Ms. Brown stated that the applicant has asked for a continuance.
Ms. Sharkey made a motion to continue the public hearing, (NOI-DEP #143-0906) 439 Northeast Main Street, 34 & 36 Davis Street/JMT Sleepy Hollow, LLC & Fitzpatrick, James to December 5, 2016 at 7:00 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
Jeremy Flansburg, 63 Monroe Street stated that at the last Planning Board meeting there were some drastic revisions. The applicant is no longer crossing the brook with a directional drill. Ms. Brown stated that the Commission cannot discuss the plan because the applicant has asked for a continuance.

7:20 PM (NOI-DEP #143-0917) PUBLIC HEARING: 86-88 Gilboa Street / BOWIE, BARBARA.
Paul Hutnak of Andrews Survey and Engineering joined the meeting. He stated that this hearing has not been advertised. He asked if a site walk could be done before the next meeting. The Commission does not feel that they need to visit the site. Mr. Zisk wants to be sure that the catch basin is protected.
It was decided to schedule the public hearing for December 5, 2016 at 7:15 PM.

7:33 PM (NOI-DEP #143-0916) PUBLIC HEARING: 251 Yew Street, Lot #2/ORBISON CORP.
Mike Yerka of Civil Site Engineering joined the meeting. He stated that the erosion control has been moved closer to the fence.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0916) 251 Yew Street, Lot #2, Orbison Corp. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:35 PM (RDA) PUBLIC MEETING: 78 Cottage Colony/STANHOPE, WILLIAM & CAROL.
Ms. Brown opened the public meeting. Dion Fitzpatrick joined the meeting as an interpreter for Mr. and Mrs. Stanhope. Mr. Zisk gave a history of the property. The applicant would like to install a 12’ x 24’ boat ramp where there is an existing space in the retaining wall. A video of the site was reviewed. The limit of excavation needs to be staked. A discussion was held.
The following conditions were discussed: any earth removed must be taken off site immediately, not stored on the yard, straw bales are to be staked at the high-water line on the water side of the rotted stump that is going to be removed, the ramp is to be constructed with 3-inch minus gravel, work is to be done during low water times and Mr. Zisk must be called after the straw bales are installed before work commences.
Ms. Sharkey made a motion to issue a negative determination for the RDA for 78 Cottage Colony, William and Carol Stanhope with the conditions previously stated. Ms. Van Roo seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Request for Extension Permit for Order of Conditions: Fairway View Drive, Lot #9 (DEP #143-690). The order has expired and they need to refile.
2. 50 Cedar Street: Request for Plan Change (DEP #143-0897). Paul Hutnak of Andrews Survey and Engineering and Gordon Andrade joined the meeting. Mr. Hutnak gave the background of the property, which was permitted for Charles DuPont. The applicant is requesting a plan change to the approved plan to add a three-car garage on the far side of the house with a gravel driveway leading to it. The garage is slightly in the buffer zone, but the majority of the garage and driveway are outside the buffer zone. A retaining wall had been brought to the house to allow for a walk-out basement. The slope will be graded 2:1 instead of building a wall. There is a small increase in the amount of land that is being disturbed inside the buffer zone.
A previously proposed gravel driveway will now be asphalt. It will sheet flow the same way it did before and will still have a stone filter strip.
A discussion was held regarding the number of trees that are now being removed and the benefits of having a slope vs. a retaining wall.
Ms. Sharkey made a motion to grant the plan change for 50 Cedar Street (DEP #143-0897). Ms. Van Roo seconded the motion. Vote: Aye-3, No-1.
3. Request for Extension Permit for Order of Conditions: Richard & Debra Morris, 79 Mumford Street (DEP #143-0687). Mr. Zisk gave the background on the request. The property has been sold. Mr. Morris joined the meeting. He stated that he now has a reliable person to do the work, but it cannot be done until spring. Ms. Brown stated that the area will need time to establish itself and it may be several years until a Certificate of Compliance can be issued.
Ms. Sharkey made a motion to issue to extend the permit for the Order of Conditions for Richard and Debra Morris, 79 Mumford Street (DEP #143-0687) for one year. Mr. Greco seconded the motion. Vote: Unanimous.
4. Request for Certificate of Compliance: Michael & Pamela Ballou, 355 Southwest Main Street (DEP #143-0683). The Commission reviewed photos and a video.
Ms. Sharkey made a motion to issue a Certificate of Compliance for Michael and Pamela Ballou, 355 Southwest Main Street (DEP #143-0683). Ms. Van Roo seconded the motion. Vote: Unanimous.
5. Request for Project Review: Main Street Auto & Towing, 120 Gilboa Street. The Commission did not have any paperwork for this review.
6. Minutes: September 19, October 3 and October 17, 2016.
Ms. Van Roo made a motion to approve the September 19, 2016 Conservation Commission meeting minutes as presented. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Sharkey made a motion to approve the October 3, 2016 Conservation Commission meeting minutes as presented. Ms. Van Roo seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to approve the October 17, 2016 Conservation Commission meeting minutes as amended. Ms. Sharkey seconded the motion. Vote: Unanimous.

OPEN SESSION:
Mr. Zisk has not heard anything regarding the Accessory Apartment Application for Brian and Brenda Wilcox, 125 Perry Street. The Commission said at the 10/17/16 meeting that the applicant had to file.

8:21 PM ADJOURNMENT:
Ms. Sharkey made a motion to adjourn the meeting at 8:21 PM. Ms. Van Roo seconded the motion. Vote: Unanimous.
