CONSERVATION COMMISSION MEETING MINUTES
MONDAY, MARCH 6, 2017

A meeting of the Conservation Commission was held on Monday, March 6, 2017. Ms. Brown called the meeting to order at 7:05 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Brandi Van Roo, Stephen Zisk (Conservation Agent)
ABSENT:

7:05 PM (NOI-DEP #143-0906) PUBLIC HEARING CONTINUED: 439 Northeast Main Street, 34 & 36 Davis Street / JMT SLEEPY HOLLOW, LLC & FITZPATRICK, JAMES.
The Commission members have received the information the applicant sent by email.
Ms. Van Roo made a motion to continue the public hearing (NOI-DEP #143-0906) 439 Northeast Main Street, 34 & 36 Davis Street/JMT Sleepy Hollow, LLC & Fitzpatrick, James to March 20, 2017 at 7:00 PM. Ms. Sharkey seconded the motion. Vote: Unanimous.

7:21 PM (NOI-DEP #143-0920) PUBLIC HEARING CONTINUED: 229, 187 & 175 Main Street / RILEY, ALLEN G. & HARE, ROBERT C & MARIBELLE.
Eric Bazzett of Heritage Design Group joined the meeting. Mr. Riley was also present. The plan now shows a designated access to the replication area from the roadway area, a construction sequence, and two stockpile areas.
The replication area will be done at the same time or prior to the wetland crossing. Both crossings will be done at the same time. Erosion control barriers will be installed before tree cutting begins. Bonds need to be posted before any construction begins within the buffer zone.
The proposed shared driveway is to be paved. The limit of the jurisdictional activity will be along the edge of the erosion control barriers.
Ms. Sharkey made a motion to continue the public hearing (NOI-DEP #143-0920) 229, 187 & 175 Main Street, Allen G. Riley and Maribelle and Robert C. Hare to March 20, 2017 at 7:15 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:35 PM (NOI-DEP #143-0922) PUBLIC HEARING CONTINUED: VAZ, ROY, 25 Fairway View Drive.
Paul Hutnak of Andrews Survey and Engineering joined the meeting. He stated that a stockpile area and an extra row of erosion controls have been added to the plan, and a Certificate of Compliance has been requested for the previous Notice of Intent. All activity is outside the 50’. A discussion was held.
Ms. Van Roo made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0922) Roy Vaz, 25 Fairway View Drive, Lot #9. Mr. Greco seconded the motion. Vote: Unanimous.

7:45 PM (NOI-DEP #143-0923) PUBLIC HEARING: 174 South Street, MBACON REALTY, LLC.
Ms. Brown opened the public hearing. Mike Yerka of Civil Site Engineering joined the meeting. He stated that everything is outside the 100’ buffer zone of the pond. There is an isolated wetland due to an existing shallow well that overflows, and the work is between the 50’ and the 100’ buffer of that. The driveway will be regrind.
The Commission asked that the erosion control barriers be extended to the 50’ and to the edge of South Street.
Ms. Sharkey made a motion to close the public hearing and issue an Order of Conditions for (NOI-DEP #143-0923) 174 South Street, MBacon Realty, LLC for the plan dated 3/6/17. Ms. Van Roo seconded the motion. Vote: Unanimous.

7:57 PM (NOI-DEP #143-0924) PUBLIC HEARING: Gilboa Court, GOGOLINSKI, CAROL, A. & COGLEY, WILLIAM S.
Ms. Brown opened the public hearing. Paul Hutnak of Andrews Survey and Engineering joined the meeting. He stated that the property is 15 acres, and they are proposing a 6 lot subdivision. One of those 6 lots has an existing house on it. They are proposing to extend Gilboa Court with a cul-de-sac. They are using a swale system on the side of the roadway. Mr. Hutnak described the system.
There is a bordering vegetative wetland, which is flagged. They are not proposing any work within 50’ of the wetland. There is a separate erosion control plan. The project will be encompassed with silt fence and straw wattle at the limits of disturbance. The areas upgrade of that will be loamed and seeded. A discussion was held.
The Commission asked for a physical barrier to stop snow from being plowed into the wetlands. The proposed width of the road is 22’. Ms. Sharkey asked for the plan to show the current paved width of Gilboa Court.
Ms. Brown asked for a stake at the closest point and at the top of the bend. A site walk was scheduled for March 8, 2017 at 5:00 PM.
Ms. Van Roo made a motion to continue the public hearing for (NOI-DEP #143-0924) Gilboa Court, Carol Gogolinski and William S. Cogley to March 20, 2017 at 7:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. 2016 Annual Town Report. Ms. Sharkey asked for confirmation of whether or not the Commission has the authority to appoint Associate Members.
Ms. Van Roo made a motion to accept the 2016 Annual Town Report as amended, pending confirmation of whether or not the Commission has the authority to appoint Associate Members. Mr. Greco seconded the motion. Vote: Unanimous.
2. Request for a Certificate of Compliance: Roy Vaz, 25 Fairway View Drive, Lot #9, (DEP #143-0690).
Ms. Van Roo made a motion to issue a Certificate of Compliance for DEP #143-0690. Mr. Greco seconded the motion. Vote: Unanimous.
3. Request for a Certificate of Compliance: Bruce Martin, 130 Walnut Street (DEP #143-0532). Mr. Zisk stated that the retaining wall has been cut short because of trees that were in the way. There is no as-built plan or an engineer’s plan. The changes are not shown on the plan. It is not known if a permit was pulled for the deck. The area looks well established. The Commission asked to see an as-built plan showing the deck and the lesser amount of excavation at the back of the property.
Cliff Van Reed, 36 Monroe Street stated that the closing for this property is Thursday.
4. Request for a Certificate of Compliance: Christopher & Concepcion Goodwin, 11 Manzi Way, Shady Knoll Estates, Lot #27 (DEP #143-0420). This will be done in the spring.
5. Minutes: December 5, 2016, January 9, 2017 and February 6, 2017.
Ms. Sharkey made a motion to approve the January 9, 2017 Conservation Commission meeting minutes as amended. Ms. Van Roo seconded the motion. Vote: Unanimous.
Ms. Van Roo made a motion to approve the February 6, 2017 Conservation Commission meeting minutes as amended. Mr. Greco seconded the motion. Vote: Aye-3, Ms. Sharkey abstained.
Approval of the December 5, 2016 meeting minutes was deferred to the next meeting. The Commission asked that the recording of the December 5, 2016 meeting be reviewed in order to fill in the missing information.

OPEN SESSION:
Paul Hutnak of Andrews Survey and Engineering asked if the Commission saw anything problematic with building a house on a piece of land on Depot Street if they stayed outside the 50’ buffer zone. A discussion was held.
Mr. Zisk stated that the Town Administrator asked the Commission to review their fees. A discussion was held. Ms. Van Roo made a motion to accept the Conservation Commission Fee Schedule as presented. Ms. Sharkey seconded the motion. Vote: Unanimous.
Mr. Zisk was asked to contact the applicants for NOI-DEP #143-0906, 439 Northeast Main Street, 34 & 36 Davis Street, JMT Sleepy Hollow, LLC Fitzpatrick, James to ask if the 100’ riverfront and wetland buffers have been flagged for his review.

8:55 PM ADJOURNMENT:
Ms. Van Roo made a motion to adjourn the meeting at 8:55 PM. Mr. Greco seconded the motion. Vote: Unanimous.
