CONSERVATION COMMISSION MEETING MINUTES
MONDAY, APRIL 3, 2017

A meeting of the Conservation Commission was held on Monday, April 3, 2017. Ms. Brown called the meeting to order at 7:07 PM.

ATTENDANCE:
PRESENT: Linda Brown (Chairman), Michael Greco, Tracy Sharkey (Vice Chairman), Stephen Zisk (Conservation Agent)
ABSENT: Brandi Van Roo

7:07 PM (NOI-DEP #143-0920) PUBLIC HEARING CONTINUED: 229, 187 & 175 Main Street / RILEY, ALLEN G. & HARE, ROBERT C & MARIBELLE.
Eric Bazzett of Heritage Design Group and Allen Riley joined the meeting. Mr. Bazzett stated that the Planning Board has voted in favor of the project. The Planning Board has a different set of plans. Ms. Sharkey asked Mr. Bazzett to be sure that the developer has the correct plans. Mr. Bazzett explained the difference between the two sets of plans, which is mostly construction details.
Ms. Brown wants to be certain that no cutting, clearing, earth removal, grading, excavation, etc. can take place until a bond is posted for the crossing and replication area. Mr. Zisk will make that notation as a special condition.
Ms. Sharkey made a motion to close the public hearing, (NOI-DEP #143-0920) 229, 187 & 175 Main Street, Allen G. Riley and Maribelle and Robert C. Hare. Mr. Greco seconded the motion. Vote: Unanimous.
Ms. Sharkey made a motion to issue an Order of Conditions for (NOI-DEP #143-0920) 229, 187 & 175 Main Street, Allen G. Riley and Maribelle and Robert C. Hare with clarification on the activities and the condition that a bond be posted prior to the start of any activity within the jurisdiction of the Conservation Commission. Mr. Greco seconded the motion. Vote: Unanimous.

7:16 PM (NOI-DEP #143-0925) PUBLIC HEARING: 130 Southeast Main Street/ L’HEUREAUX, DAVID.
Ms. Brown opened the public hearing. Mike Yerka of Civil Site Engineering joined the meeting. He stated that there are existing Orders of Conditions for 130 and 134 Southeast Main Street, which have expired. No work has been done on those Orders. The Commission voted to issue Certificates of Compliance (see Discussion items #4 and #5 below).
Mr. Yerka stated that there is no difference between this plan and the one that was previously approved, except that the driveway has been shortened a bit. The driveway will be regrind.
Regarding the grading that goes right up to the erosion control at the edge of the wetlands, Ms. Sharkey stated that straw wattles will not be sufficient. Mr. Yerka will be using 9”compost socks for the entire project.
There is no erosion control proposed on the wetland boundary. Mr. Yerka stated that that area is all ledge. Mr. Yerka will indicate a fence at the bottom of the slope to run 25’ off the wetland line. Mr. Yerka will also add a stockpile area to the plan.
Lorraine Lague, 137 Southeast Main stated that the wetlands on her side of the road have doubled in size since the Town cleaned out the culvert. She is concerned that making changes to the property and adding additional runoff would flood her property. Mr. Yerka said that the runoff would not go to that culvert, but would run off to a different culvert and to the abutting lot.
Ms. Sharkey made a motion to continue the public hearing for David L’Heureaux, (NOI-DEP #143-0925), 130 Southeast Main Street to April 18, 2017 at 8:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.

7:46 PM (NOI-DEP #143-0926) PUBLIC HEARING: 134 Southeast Main Street/ L’HEUREAUX, DAVID.
Ms. Brown opened the public hearing. Mike Yerka of Civil Site Engineering joined the meeting. Mr. Yerka stated that this plan differs from the previously approved plan. Instead of one 15’ driveway, the entrance has been moved and they are now proposing two 11’ wide driveways and a 2’ wide planting strip between the divide and the shared driveway. A discussion was held.
For the next meeting, Mr. Yerka will overlay the old plan and the new plan to show the driveways. The area between the wetland and the driveway, on the downslope, will be wooded. The area of disturbance to the wetlands edge is 15’at the closest point. Ms. Sharkey is concerned about loam and seeding 15’ to the wetland edge. A discussion was held regarding whether or not diverting new runoff into the street is allowed.
Mr. Yerka is proposing planting some dwarf trees, shrubs, winterberry, etc. in the planting strip. Ms. Brown asked that the plantings be added to the plan. Ms. Sharkey asked for clarification of what is happening “down in that corner” and where the water is. Ms. Brown asked that the edge of the driveway be staked. A site walk was scheduled for April 10, 2017 at 5:00 PM.
Ms. Sharkey made a motion to continue the public hearing for David L’Heureaux, (NOI-DEP #143-0926), 134 Southeast Main Street to April 18, 2017 at 8:15 PM. Mr. Greco seconded the motion. Vote: Unanimous.

8:11PM (NOI-DEP #143-0924) PUBLIC HEARING CONTINUED: Gilboa Court Extension/GOGOLINSKI, CAROL, A. & COGLEY, WILLIAM S.
Mr. Zisk stated that the applicant has asked for a continuance.
Ms. Sharkey made a motion to continue the public hearing for (NOI-DEP #143-0924) Gilboa Court Extension, Carol Gogolinski and William S. Cogley to April 18, 2017 at 7:30 PM. Mr. Greco seconded the motion. Vote: Unanimous.

DISCUSSION:
1. Jeffrey Taylor, 12 Martin Road: Tree Removal. Mr. Lake of 14 Martin Road joined the meeting. Mr. Zisk stated that a certified letter was sent, but the green card has not been received. A discussion was held.
Mr. Zisk will consult Town Counsel for their opinion regarding a person who may be in violation and is nonresponsive to the Commission’s attempts to contact them.
2. Timothy Nealon: Deer Crossing Lots/Revise Plans. Mr. Zisk stated that the applicant will be coming to the next meeting.
3. EcoTec, Inc.: Wetlands Delineation Proposal/Gilboa Court Extension. Mr. Zisk solicited a price of $800 from EcoTec to walk the site and do some field testing. The consultant fee is covered in the application fee. BNC originally flagged the wetland. Ms. Brown has visited the site.
Ms. Sharkey made a motion to use EcoTec, Inc. to review the Gilboa Court Extension filing on the delineated wetland area. Mr. Greco seconded the motion. Vote: Unanimous.
4. Request for a Certificate of Compliance: David L’Heureaux, 130 Southeast Main Street (DEP #143-0700).
Ms. Sharkey made a motion to issue Certificates of Compliance for David L’Heureaux, 130 & 134 Southeast Main Street (DEP #143-0700 and DEP #143-0701) due to no work having commenced on those Orders. Mr. Greco seconded the motion. Vote: Unanimous.
5. Request for a Certificate of Compliance: David L’Heureaux, 134 Southeast Main Street (DEP #143-0701).

6. Highway Department: Placing Snow on Davis Street Town Property-DOR issued. Mr. Zisk stated that an RDA was approved in 2001. The Commission had determined a negative impact. If the area is still the same and the situation is the same, then the RDA is valid. Mr. Zisk will email Mr. Cundiff to see if it is still a valid determination.
7. Request for a Certificate of Compliance: Christopher & Concepcion Goodwin, 11 Manzi Way, Shady Knoll Estates, Lot #27 (DEP #143-0402). This item is continued until spring.
8. Sign Voucher.
9. Planning Board Zoning Public Hearing Notices (3): FYI to clarify wording for the Accessory Apartment, Assisted Living Facilities, and the Earth Removal bylaws.
10. Minutes: December 5, 2016 and March 20, 2017.
Approval of the December 5, 2016 and March 20, 2017 Conservation Commission meeting minutes was deferred to the next meeting.

OPEN SESSION:
Ms. Brown stated that the Interim Town Administrator, James Purcell, approached her about transferring some funds from the Conservation Wetland fund to the Municipal budget. Right now, there is $70,000 in the fund. Mr. Purcell joined the meeting and spoke about the financial difficulties of the Town and the Town’s request for $10,000 from Conservation funds. Mr. Purcell presented the proposed FY18 Operating Budget. Mr. Purcell proposed, if the Commission agrees to contribute a sum of money to the FY18 Operating Budget, he will lower the wage contribution to Community Development in the same amount. A discussion was held and the Commission was not in agreement of lowering the wage contribution to Community Development.
Ms. Sharkey made a motion to contribute $10,000 from the Wetlands Protection Fund to the FY2018 General Fund Budget. Mr. Greco seconded the motion. Vote: Unanimous.
